I. Assuming you are the lawyer of the aggrieved party, what will be your
remedies against the following:

1. A judgment rendered by MTC in a collection of sum of money


action.
2. A decision rendered by the RTC affirming in toto the judgment
of the MTC in an action for forcible entry.
3. A decision rendered by MTC in a small claim case.
4. Decision of the CA in an annulment of judgment.
5. Decision of the NLRC reversing the Decision of the Labor
Arbiter.
6. A Decision rendered by the RTC in a Petition for Certiorari
assailing the MTC’s Order granting the Motion to Dismiss.

II. DJ filed a case for unlawful detainer against Andrea before the MTC-
Daraga. The MTC-Daraga rendered a Judgment dated November 10,
2023, finding for DJ and ordering Andrea to vacate the property.

1. As Andrea’s lawyer, what remedy will you avail against the


Judgment dated November 10, 2023?
2. Assuming that on appeal, the RTC rendered a Decision affirming
the MTC’s Judgment dated November 10, 2023, what remedy will
you file to assail the RTC’s Decision?

III. Draft a notice of appeal on the following information supplied by your


client:

• Senior Agila filed a case for annulment of TCT No. 6969,


reconveyance, and damages against Maria Nagsawa before RTC-
Legazpi City, Branch 4.
• A Decision dated November 20, 2023 was rendered by the court
declaring TCT No. 6969 null and void, ordering defendant to
reconvey the property to the plaintiff, and to pay plaintiff the
amount of Php 500,000.00 as damages.
• The Decision dated November 20, 2023 was received by the plaintiff
on November 26, 2023 and by the defendant on November 27, 2023.
• Postal Money Order No. 9966 amounting to Php 5,000.00 for appeal
fees.
