LNB MC 2023-002 Elections Guidelines 2023-11-28
A. Article One, Chapter I, Title Six, Book Ill of the Local Government Code of 1991 provides that:
"there shall be an organized Liga ng mga Barangay (LnB) Chapters at the Municipal,
City, Provincial and Metropolitan Political Subdivision levels which shaII elect their
respective officers and members".
B. RA 11935 in Section 2 states that Section 4 of RA 9164, as amended, is hereby further amended
to read as follows:
“SEC. 4. Assumption of Office – The term of office of the barangay and sangguniang
kabataan officials elected under this act shall commence at noon of November 30 next
following their election “
“The Synchronized BSKE was scheduled on October 30, 2023 pursuant to Section 1 of
Republic Act (RA) No. 11935.
C. DILG Memorandum Circular 2023-166 on the Guidance on the assumption of office of the
barangay and SK officials elected on October 30, 2023 synchronized barangay and sangguniang
kabataan elections (BSKE) states that;
The Supreme Court, in G.R. No. 2635902 and G.R. No. 2636733 declared RA No. 11935
as unconstitutional, and ruled that the BSKE set on the last Monday of October 2023
shall proceed as scheduled. Further, the Supreme Court likewise ruled that "The sitting
BSK officials shall continue to hold office until their successor shall have been elected
and qualified."
"… if the candidate for the October 30, 2023 BSKE obtained the highest number of votes
among the remaining candidates for the same position in the same barangay, and later
on proclaimed, and subsequently took his or her oath of office, the said candidate, now
referred to as the winning candidate and/or newly elected official, may immediately and
effectively assume office."
D. The same memo directed all barangay and SK officials to comply with Comelec rules and DILG
directives on turnover amongst which are the following:
“…comply with the requirement under Section 14 of RA No. 7166 to file in duplicate with
the Comelec the full, true and itemized statement of all contributions and expenditures
(SOCE) within thirty (30) days after the day of the elections..”
“… Validate the list (Barangay Inventory and Turnover Form No. 2) of the Barangay
PFRD’s and Money Accountabilities and the actual physical count of the
properties/finances to be turned over by the outgoing Barangay Officials...”
E. The widespread confusion brought about by different interpretations on the field regarding the
on date of assumption of office and the rules for turn over makes it difficult for the National
Liga to conduct the elections in accordance with its original schedule.
The 2022 Liga Election Code in Section 1 states that “ When the circumstances warrant
the National President may order the rescheduling of any of the aforementioned Liga
elections.”
F. The 2022 Liga Constitution and By Laws provides for the rules that govern the Liga Elections
as stated in Article XI. Section 1..
“All other election matters not covered in this article shall be governed by the Liga
Election Code or such other rules as may be promulgated by the National Executive
Board in conformity with the provisions of existing laws.
G. As a pre-requisite to any election meeting, the 2022 Liga CBL provides on Article XI. Section
2..
“Any member or delegate to the election meeting in any level of the Liga shall register
with the secretariat of the meeting and shall be accredited as such in accordance with
the rules and procedures set forth in this Constitution and By-Laws, the Liga Election
Code, and other rules and regulations that may hereafter be promulgated by the National
Executive Board.”
H. In the NEB Meeting conducted last 11 November 2023 at Sheraton Hotel Manila, the Neb has
set the following additional qualifications for the conduct of the elections
a. All Candidates running for the position of Provincial / HUC / ICC Chapters are
required to present a Certificate of Eligibility from the National Liga prior to
qualifying to run for any position.
b. Any representative of a barangay / chapter who fall under the following, shall not
be eligible run for office:
c. Any Barangay or chapter who failed to regularly pay the annual Liga Dues by the
August 31, 2023 deadline prescribed by the National Liga, in the case of Provincial
/ HUC / ICC Chapters, or the deadline prescribed by the incumbent Liga President,
in the case of Municipal / CC Chapter; Representatives of such barangays or
chapters are eligible to vote, upon full payment of their Liga Dues and Annual
Subscription to the Liga National Official Publication, at the time of voting.
However, such representatives of barangays or chapters who fall under the above
conditions are not eligible to be voted upon.

In the case of extremely delinquent barangays / chapters where no representative is
eligible to be voted upon, the National President shall appoint an interim Liga
President who shall sit in the Sanggunian, until their successor is duly elected and
qualified. Provided that such Special Elections shall be conducted after the conduct
of the Regional and National elections and that all requirements of the National
Liga have been met.**
In the same meeting, the National Executive Board has set forth the conduct of the following
mandatory activities:
The National Liga General Membership Assembly shall be called for after the
conduct of Municipal / Component / Provincial / HUC / ICC Chapter Elections.
Attendance to the National General Membership Assembly is a Mandatory
Requirement for the issuance of a Certificate of Confirmation
Article III. Section 3.a defines the composition of the National Liga
General Membership as “All duly elected presidents representing all
regional, provincial, city, and municipal chapters of the Liga shall be
called the National Liga General Membership.
The National Liga chapter may call for training/certification programs that
shall address the capacity development requirements of the Liga Chapters
and of barangays and its members. To ensure that programs follow the
national agenda, only the National Liga can call for a training/certification
program.
All Provincial / HUC / ICC / Municipal and Component City Chapters are required
to ensure attendance of all Punong Barangays within their chapters to the National
Barangay Certification Program. The completion of all chapter members to the
Certification Program, which shall be conducted in Regional Clusters, is a
requirement for the issuance of the Certificates of Confirmation on all levels.
I. Payment of Liga Dues and Annual Subscription to the Liga National Official Publication
a. Article XIII. Section 2 of the Liga Constitution and By Laws states that “Annual
membership dues in the amount of FOUR THOUSAND PESOS (P4,000.00) or
such amount as may be determined by the National Executive Board shall be
collected from each barangay throughout the country EVERY FIRST QUARTER
OF THE YEAR, and the proceeds shall be distributed as follows:

In the case of HUC/ICC Chapters
b. Article XIV. Section 1 of the Liga Constitution and By Laws states that “The Liga
National Secretariat, under the supervision of the national president, shall publish
an official publication that shall serve as the official artery for dissemination of
information on barangay affairs as well as the plans, programs, and activities of
the Liga national and other aligned agencies.”
II. PURPOSE
A Guide to punong barangays, interim Liga Presidents, concerned local officials, NBOO, Comelec
and DILG field officers on their roles in the conduct of the Liga ng mga Barangay Chapter
Elections at all levels.
B. Updated forms and templates for the conduct of the LnB Chapter Elections.
Ill. COVERAGE
This circular shall cover all Provincial Governors, City/Municipal Mayors, Punong Barangays,
Representatives of the Liga ng mga Barangay National/Regional/Provincial/City/Municipal
Chapters, LnB Chapter Secretary, Presiding Officers of the Sanggunians, DILG Regional,
Provincial and City Directors, City/ Municipal Local Government Operations Officers, BARMM
Regional Governor, Philippine National Police and all others concerned.
A. Nominations Committee
1. The incumbent Liga Chapter President together with the incumbent Local Executive Board
in the case of local chapters, shall appoint a Nominations Committee composed of a
chairman and two (2) members from the general membership;
2. The chairman and members of the Nominations Committee are not eligible to run for office
in their respective chapters while serving in such capacities;
3. The composition of the Nominations Committee, together with the addresses of the members
therein, shall be circularized throughout the general membership together with the notice of
meeting;
4. Candidacy forms shall be made available to the prospective candidates by this committee;
5. The committee shall determine and certify qualified candidates at least five (5) working days
prior to the election in accordance with the Liga Constitution and By-Laws and this Code;
6. The committee shall also post the list of candidates duly qualified for elections in the
respective chapter office at least prior to the election;
7. Failure to post the qualified candidates shall be grounds for disciplinary action against the
members of the committee;

8. The certificates of candidacy shall be submitted to the Nominations Committee on or before
the deadline provided herein;
1. The registration / credentials committee shall be composed of the incumbent Liga chapter
president who shall serve as the chairman of the committee together with the chapter
secretary and treasurer. In the event of a vacancy in the above positions, the general
membership shall appoint the members of the committee herein; subject to the guidelines
as stated herein;
2. This committee shall take charge of the accreditation and registration of delegates to the
election meeting. It shall prepare the necessary proof of presence of a quorum for the said
meeting, shall prepare and issue the voter’s credentials for election purposes and shall also
render, during the election meeting, a report as to the number of voting delegates duly
registered, certified, and accredited. The voter’s credentials shall be signed by the Liga
secretary and treasurer and duly attested by the Liga chapter president.
C. Election Committee
1. The incumbent Liga Chapter President together with the incumbent Local Executive Board
in the case of local chapters, shall appoint an election Committee composed of a chairman
and two (2) members from the general membership;
2. The chairman and members of the election committee are not eligible to run for office in
their respective chapters while serving in such capacities;
3. The committee shall exercise supervision and control over the conduct of the election proper
and shall proclaim the winning candidate as the duly elected officers and board
D. Board of Canvassers
1. The incumbent Liga Chapter President together with the incumbent Local Executive Board
in the case of local chapters, shall appoint the board of canvassers composed of a chairman
and two (2) members from the general membership;
2. The chairman and members of the election committee are not eligible to run for office in
their respective chapters while serving in such capacities;
3. The board of canvassers shall be responsible for the public canvassing and counting of the
ballots cast and certifying the results as to number of votes garnered by each candidate for
each of the elective positions, and thereafter submitting the same to the committee for
proclamation. The chairman and the members of the Board of Canvassers shall not be
eligible for any office in his/her Liga Chapter.
1. There shall be a Board of Election Supervisors (BES) at every Local Liga Chapter election
to be composed of the either an NGO or Religious Sector Representative and/or COMELEC
Officer as chairman and two (2) members from the general membership
▪ To resolve any controversy that may arise during the election meeting of the local Liga
Chapter;
▪ To resolve any electoral protest..., which must be submitted in writing to the Board of
Election Supervisors (BES) within twenty-four (24) hours from the close of the election;
▪ The BES must render its decision within forty-eight (48) hours from receipt thereof;

▪ All decisions of the Board of Election shall be subject to review by the National
Executive Board, the decision of which shall be final and executory;
▪ Any appeal on the decisions of the Board of Election Supervisors must be filed within
the National Liga Headquarters in Unit 1401, Prestige Tower Condominium, Emerald
Avenue, Ortigas, Pasig City within forty-eight (48) hours from the receipt of its decision.
The National Liga through the National President and its Justice Committee shall decide
on the appeal within sixty (60) days from date of filing of appeal;
F. Special Provisions
Special provisions are provided for in the 2022 Liga Constitution and By Laws for special cases
concerning the formation of committees for chapters with the following conditions, as provided
for in Article II of the Liga Election Code
Section 1. Exclusions. In City, Municipal, and Provincial Liga Chapters with less
than twenty-five (25) members and where certain provisions of Section 2, Article I of
this Code cannot be enforced, the said Liga Chapter President together with the local
executive board shall instead implement and enforce the provisions under this Article
to apply and govern their respective election meetings. In all instances, there shall be
a Nominations Committee, which shall likewise perform the tasks of the
Registration/Credentials Committee as stated in par. 2.1 above. The members of both
committees shall not lose his/her eligibility to seek for an elective position.
The first member shall act as Elections chairman and the two others as members of
the Election Committee. The Election Chairman shall preside over the election
proper, provided said Election Chairman, as well as the two (2) other members, shall
not lose his/her eligibility to seek for an elective position.
✓ The incumbent LnB Chapter President or in its absence, the Temporary Presiding Officer,
preferably assisted by the C/MLGOO/HUC and ICC Directors of the DILG, shall send a
written notice of meeting to the general membership, as well as the incumbent Liga Chapter
Board Members for the purpose of forming the various committees and boards.

✓ The newly-elected PB shall personally receive the written notice, or in his/her absence, by
other officials of the barangay. Said written notice shall notify him/her of the following:
1. Date, Time, Place, and Agenda of the General Membership Meeting of the
Chapter FORM 1
✓ The incumbent LnB Chapter President or in its absence, the Temporary Presiding Officer,
preferably assisted by the C/MLGOO/HUC and ICC Directors of the DILG, shall convene
the meeting for the formation and designation of the members of the Committees and Boards.
✓ The incumbent LnB Chapter President or in its absence, the Temporary Presiding Officer,
preferably assisted by the C/MLGOO/HUC and ICC Directors of the DILG, shall send a
written notice of election meeting to the general membership.
✓ The newly-elected PB shall personally receive the written notice, or in his/her absence, by
other officials of the barangay. Said written notice shall notify him/her of the following:
✓ The Nominations Committee, or the LnB Chapter Secretary, shall make available to the
prospective candidates the candidacy forms FORM 3.
✓ The Nominations Committee shall determine and certify prior to the election as to the
qualifications of the candidates in accordance with the LnB Constitution and By-Laws
(CBL) and Election Code and other rules and regulations that may hereafter be promulgated
by the National Executive Board.
✓ It shall also post in the chapter office prior to the elections a list as to those candidates who
have duly qualified for election to their respective offices.
• Exercise supervision and control over the conduct of the election proper.
• Proclaim the winning candidate as the duly elected officers and board members of
the respective LnB Chapter, on the basis of the election results certified by the Board
of Canvassers.

✓ The Board of Canvassers shall:
• Be responsible for the public canvassing and counting of the ballots cast and
certifying the results as to the number of votes garnered by each candidate for each
of the elective positions.
• Submit to the Election Committee the results of the election using FORM 7.
• Resolve any controversies such as breaking tie through toss coin, application of
neighborhood rule, appreciation of marked ballot and absolute adherence to
compliance to all pre-requisites in an all or nothing rule that may rise during the
election meeting of the local LnB Chapter.
• If the situation warrants, call upon the Philippine National Police (PNP) for
assistance to ensure the smooth conduct of the election.

to the newly elected Presidents of the LnB CC and Municipal Chapters, as well as the
incumbent Liga Chapter Board Members for the purpose of forming the various committees
and boards.
✓ The newly-elected Presidents of the LnB CC and Municipal Chapters shall personally
receive the written notice, or in his/her absence, by other officials of the barangay. Said
written notice shall notify him/her of the following:
1. Date, Time, Place, and Agenda of the General Membership Meeting of the

✓ The incumbent LnB Chapter President or in its absence, the Temporary Presiding Officer,
preferably assisted by the DILG Provincial Directors, shall convene the meeting for the

On December 30 to 31, 2023 (Saturday to Sunday) (Sending of Notice of Election Meeting)
✓ The incumbent LnB Chapter President or in its absence, the Temporary Presiding Officer,
preferably assisted by the DILG Provincial Directors, shall send a written notice of election
meeting to the general membership.
✓ The newly-elected Presidents of the LnB CC and Municipal Chapters shall personally
receive the written notice, or in his/her absence, by other officials of the barangay. Said
written notice shall notify him/her of the following:
✓ The Nominations Committee, or the LnB Chapter Secretary, shall make available to the
prospective candidates the candidacy forms FORM 3.
✓ It shall receive, in writing, Certificates of Candidacies before 5:00 PM of January 04, 2024.
✓ The Nominations Committee shall determine and certify prior to the election as to the
qualifications of the candidates in accordance with the LnB Constitution and By-Laws
(CBL) and Election Code and other rules and regulations that may hereafter be promulgated
by the National Executive Board
✓ It shall also post in the chapter office prior to the elections a list as to those candidates who
have duly qualified for election to their respective offices.
• Exercise supervision and control over the conduct of the election proper.
• Proclaim the winning candidate as the duly elected officers and board members of
the respective LnB Chapter, on the basis of the election results certified by the Board
of Canvassers.
• Be responsible for the public canvassing and counting of the ballots cast and
certifying the results as to the number of votes garnered by each candidate for each
of the elective positions.
• Submit to the Election Committee the results of the election using FORM 7.

compliance to all pre-requisites in an all or nothing rule that may rise during the
election meeting of the local LnB Chapter.
• If the situation warrants, call upon the Philippine National Police (PNP) for
assistance to ensure the smooth conduct of the election.

✓ The conduct of the National and Regional LnB Chapter Elections is set on June 14, 2024.
✓ A separate set of guidelines and schedule shall be sent for the conduct of the Regional and
National LnB Chapter Elections which shall be provided to the General Membership
Assembly on the conduct of the National General Membership Assembly on January of 2024
after the conduct of the Provincial LnB Chapter Elections.
Attendance to the assembly is required for all Liga Chapter Presidents and is a pre-requisite
for the issuance of your Certificates of Confirmation.
1. All barangays are required to update the full payment of their 2023 Liga Dues and to sign a
promissory note FORM 9 to pay their 2024 Liga Dues before January 10, 2024 inorder to vote
in the Municipal / CC / HUC / ICC synchronized elections on December 15, 2023.
2. All Liga Chapters are required to remit the full payment of their 2023, 2024 Liga Dues and their
Annual subscription to the Liga National Official Publication in order for the chapters to vote in
the Provincial / Regional and National synchronized elections.
3. All Candidates running for the position of Provincial / HUC / ICC Chapters are required to
present a Certificate of Eligibility from the National Liga prior to qualifying to run for any
position.

4. Any representative of a barangay / chapter who fall under the following, shall not be eligible
run for office:
a. All Candidates running for the position of Provincial / HUC / ICC Chapters are

However, such representatives of barangays or chapters who fall under the above
conditions are not eligible to be voted upon.
d. This rule shall apply regardless of a change of representative in the respective barangay,
if any.
Payment of reasonable registration fees of participants to cover meals, honoraria, supplies, and
other election-related expenses, is authorized in accordance with the Liga Constitution and By
Laws, chargeable against their respective local funds subject to the usual accounting and auditing
rules and regulations.

V. GENERAL RULES
✓ Should any government agency refuse to assume the role, a representative duly designated
and authorized by the National Liga through the authority of the National Liga President
shall serve as the representation.
✓ Section 3. Failure of Elections. In the event that a Liga Chapter fails to hold an election
due to circumstances beyond its control within the prescribed period, the incumbent
National Liga Executive Board shall in accordance with Section 1 Article IX of the Liga
Constitution and By-Laws, order the holding of special elections for the Liga Chapter
concerned. In such an eventuality, the incumbent Liga Chapter President shall continue
to represent the same in the Sanggunian concerned or in any other meetings in hold over
capacity, until his successor is finally confirmed. However, should the failure of elections
be declared due to the incumbent Liga Chapter President or his successor’s failure to send
notices of election meeting as required by this Code, said officials shall lose his/her
eligibility to any elective office in the said Liga Chapter.
✓ Only the National Liga can authorize a special elections. Other Local Chief Executives
and Local Liga Presidents are not authorized to conduct special elections in the absence
of an authority from the National Liga.
✓ FULL PAYMENT OF 2023 & 2024 ANNUAL LIGA DUES, PLUS FULL
PAYMENT OF THE Php 1,000.00/BARANGAY SUBSCRIPTION TO THE LIGA
NATIONAL OFFICIAL PUBLICATION IS REQUIRED PRIOR TO ISSUANCE
OF CERTIFICATES OF CONFIRMATION FOR ANY LIGA CHAPTER.
