FREQUENTLY ASKED QUESTIONS

QUESTION 001
The Liga President is no longer a Punong Barangay. Can he/she still hold the position of Liga President and sit in the Sanggunian?

NO. Hold over positions only apply when the incumbent Liga President is an elected Punong
Barangay in the recently held BSKE elections. Last Term Punong Barangays and Punong Barangays
who ran but did not win are no longer on hold over capacity and must vacate their posts effective upon
the assumption of office of their successor as Punong Barangays.

Article IX. Section 4 of the Liga Election Code states that “In the event that the incumbent Liga
Chapter President fails to get re-elected as Punong Barangay in the General Barangay Election
concerned, and pursuant to Section 1, Article XII of the Liga Constitution and By-Laws, his incumbent
Vice President or Executive Vice President in the case of the National, shall assume the office of the
Liga President; and shall perform all duties and responsibilities required of a President under this
Code and Liga Constitution, until his successor is duly elected and confirmed”

QUESTION 002
The Liga President is still an incumbent Punong Barangay. Can he/she still hold the position of Liga President and sit in the
Sanggunian while waiting for the upcoming elections?

YES. The law provides that the incumbent Liga President will remain in their posts until their
successors have been elected and qualified.

Section 3 of RA 11935 states that “ Until their successors have been duly elected and qualified, all
incumbent barangay and sangguniang kabataan officials shall remain in office, unless sooner
removed or suspended for cause: Provided, that barangay and sangguniang kabataan officials who
are ex official members of the sangguniang bayan, sangguniang panglungsod, or sangguniang
panlalawigan, as the case may be shall continue to serve as such members in the sanggunian
concerned..”

QUESTION 003
The Provincial Liga President is still an incumbent Punong Barangay but lost or did not run as Municipal Liga President. Can he/she
still hold the position of Provincial Liga President and sit in the Sangguniang Panlalawigan while waiting for the Provincial Liga
elections ?

YES. The law provides that the incumbent Liga President will remain in their posts until their
successors have been elected and qualified. Since this case provides that the incumbent Liga President
is still an incumbent Punong Barangay, such the hold over capacity is extended in this case.

QUESTION 004
The former Liga President did not pay the Liga Dues. Does the incoming Liga President still need to pay the back dues that the
former Liga President owes?

YES. Liga Dues are a responsibility of the barangays or chapters that are members of the Liga.
Representatives of the Liga carries the burden of responsibility in ensuring that the barangay or
chapter he belongs to is upto date in its obligations.

In the case of the Liga ng mga Barangay, It is the barangay and not the Punong Barangay, that is the
member of the Liga. Punong Barangays are merely representatives of the Barangay that they belong
to. Such if the barangay is delinquent, then the current representative of the barangay carries with it
the liability of updating the Liga Dues.

QUESTION 005
I represent a barangay or Chapter who is delinquent or does not regularly pay their dues. Can I run for a position in the upcoming
2023 Liga ng mga Barangay elections ?

NO. Liga Dues are a responsibility of the barangays or chapters that are members of the Liga.
Representatives of the Liga carries the burden of responsibility in ensuring that the barangay or
chapter he belongs to is upto date in its obligations.

In the case of the Liga ng mga Barangay, It is the barangay and not the Punong Barangay, that is the
member of the Liga. Punong Barangays are merely representatives of the Barangay that they belong
to. Such if the barangay is delinquent, then the representative of the delinquent barangay is
disqualified from running for an elective post in the upcoming Liga elections.

QUESTION 006
Our chapter has not paid the annual Liga Dues. Can we still request for an authority to conduct special elections?

NO. Full payment of Liga dues is a prerequisite for the conduct of elections at any level.

QUESTION 007
My members did not pay their Liga Dues. Can a Liga President request for a discount ?

NO. There is no provision in the code for a discount. The amount remitted to the National Liga is only
a small portion of the dues that a chapter collects. As a Liga President, it is your responsibility to
collect the Liga Dues and your responsibility to report delinquent barangays or chapters.

Willful withholding of Liga Dues is grounds for suspension or removal from the Liga.

QUESTION 008
Both Liga President and Vice President Positions are already vacant. Can we appoint an interim President ?

NO. The 50% + 1 of the General Membership must call for a meeting for the purpose of electing a
Temporary Presiding Officer who shall then preside for a meeting and request for an Authority to
Conduct a Special Election from the National Liga. Only after the exercise of a Special Election can
a Liga President and Vice President assume.
