ANNEXURE-5 (a)

Copy of Section 10 of Environment (Protection)Act 1986.

Powers of entry and inspection.

10(1) Subject to the provisions of t his section, any person empowered by the
Central Government i n t h i s b e ha lf shall h a ve a r i gh t t o e n t e r, a t a l l
re a so n a b le t im e s wit h su ch assistance as re reconsiders necessary, and
place –

(a) For the purpose of performing any of the functions of the Central
Government entrusted to him;
(b) for the purpose of determining whether and i f s o in what manner,
any such functions are to be performed or whether any provisions
of this Act or the rules made t h e r e under or any notice, order,
direction or authori s a t i o n served, made, given or granted under
this act is being or has been complied with;
(c) for the purpose of examining and testing any equipment, in d u s t r i a l
p l a n t , r e c o r d , register, document or any other material object or
for conducting a search of any building in which he has reason to
believe that an offence under this Act or the rules made
thereunder has been or is being or is about to be committed and for seizing
any such equipment, in d u st ria l p la n t, re co rd , re gist e r, document
or other material object if he has reasons to believe that it may
furnish evidence of the commission of an offence punishable
under this Act or the rules made there under or that such seizure
is necessary to pre vent or mitigate environmental pollution.

(2) Every person carrying on an industry, operation or process or handling


any hazardous substance shall be bound to render all assistance to the
person empowered by the Central Government under sub-section(1) for
carrying out the f unctions under that sub -section and if he f ails to do
so without any reasonable cause or excuse, he shall b e g u i lt y o f a n
offence under this Act.

(3) If any parson willfully delays or obstructs any person empowered by the
Central Government under sub-section(1) t h e p e rf o rm a n ce of h is f un ct io n s,
h e sha ll b e gu ilt y of an offence under this Act.

(4) The provisions of the Code of Criminal procedure, 1897; or in relation to t h e


S t a t e o f J a m m u a n d K a shmir, or any area in which that c o d e i s n o t in
f o r c e , t h e p ro vi s i o n s o f a n y co rre spo n d in g la w in f o rce t ha t S ta t e o r
a re a sh a ll, so far as may be, apply to any search or seizure under t h is
se ct io n a s t h e y a p p l y t o a n y se a r c h o r se i zu re made under section 94 of
the said Code or, as the case m ay be, under the corresponding provision
of the said law

Copy of Section 11(1) of Environment (Protection) Act, 1986

Power to take sample and procedure to be followed in connection therewith;

11(1) The Central Government of any officer empowered by it in this behalf,


shall have power to take, for the purpose of analysis, samples of air, water,
soil, or other substance from any factory, premises or other place in such
manner as may be prescribed.

S.O. 445 (E) In exercise of the powers conferred by clause (a) of sub-section (1) of section

Central Government hereby directs that the powers under Clause (b) of sub-section (2) of
section 5 of the said Act, exercised by it, shall also be exercised by the Controller General.

Indian Bureau of Mines.
