Session #3 December 21, 2013

Minutes of the Regular Session of the Sangguniang Barangay of San Pedro held at Barangay Hall, San
Pedro, Buhi, Camarines Sur on December 21, 2013.

CALL TO ORDER:

The Presiding Officer called the Regular session to order at 6:00 o’clock in the evening followed by an
opening prayer led by Hon. Nordom A. Obumani.

ROLL CALL: All members are present

The Presiding Officer stated and instructed the secretary to conduct a roll call to determine the quorum.
Hon. Melogen B. Agnes is not yet around in the beginning of the session. Subsequently, the Brgy
Secretary read the minutes of the regular session last December 7, 2013. The Presiding Officer
acknowledged the arrival of Hon. Agnes and asked the august body for any remarks, comments and
observation regarding the minutes as read.

Hon. Melogen B. Agnes again raised and insistently objected the appointment of Mr. Ronilo A. Obia as
Barangay Secretary. She stated that during the last session, they have not still concurred the said
appointment and the other three (3) Barangay Kagawad namely Hon. Crisanta B. Repatacodo, Hon.
Garry T. Salon, and Hon. Jay Rafael E. Guadaña also affirmed to the statement of Hon. Agnes.

The Presiding Officer once again asked them to cite their legitimate/legal grounds and valid reasons as
to their unwillingness to concur the appointment of Mr. Obia as Brgy Secretary and Hon. Agnes
answered that she has personal grudge to Mr. Obia of what has transpired during last election. The
Presiding Officer reiterated the role of the Sangguniang Barangay in concurring the appointment issued
by the Punong Barangay is only to ascertain whether the appointee has the qualifications and none of
the disqualifications as provided at Section 394 Letters A, B, and C of Local Government Code and not
discretionary in nature but a requirement if no disqualifications is cited. Thus, she mentioned that the
reason raised by Hon. Agnes is not valid and that political and election matter should be set aside and be
forgotten for the welfare of our constituents.
In view of the above, Hon. Efren Joevanni R. Bon raised and recognized, cited reference DILG Opinion
No. 17, s. 2009 and he reads, that while the power to concur is given to the Sangguniang Barangay, said
body is not vested with so much plenary discretionary powers. The power to concur is intended for the
sanggunian to determine whether or not the appointee of the Punong Barangay possesses all the
qualifications prescribed for Barangay Secretary under Section 394 of the Local Government Code and
such other qualifications provided for by existing laws, such as relative within the 4th civil degree;
previously removed from government service for cause, and other grounds. If the appointee therefore
possesses all the qualifications provided by law, then the Sangguniang Barangay has no other far-
reaching powers except to issue the concurrence. He also reminded Hon. Agnes that since the
presentation of the appointment of Brgy Secretary was done last December 1, 2013 and they should
have acted on the concurrence or filing of formal objections citing their valid grounds in fifteen (15)
working days from thereon. The opposing party failed to give a substantial and valid manifestation to
this account within the given period.

Hon. Melogen B. Agnes still stake to her stand and manifested further that said precedence as a matter
of reference does not apply to Barangay San Pedro in fact this Barangay should have a separate and
distinct rule from other Barangay regarding the appointment of Barangay Secretary and should not copy
what other Barangay is doing. She also questioned why Punong Barangay Balagot did not call for a
special session before the fifteen (15) working days had lapsed but PB Balagot replied that it was her
duty to have acted on it as she was the one opposing the appointment and not PB Balagot.

The Presiding Officer finally overruled the above manifestation mentioning that objection is illogical and
baseless in fact and in law citing again her references under Local Government Code Section 394 letters
A, B and C. She also narrated that she had repeatedly cited references and informed their rights to file a
formal letter of complaint citing their valid reasons in the previous session and gave them ample time to
do so, but they failed to comply. Therefore, as they failed to act and failed to enumerate valid reason
for disqualification of the appointee for the position of Brgy. Secretary, the appointment of Barangay
Secretary in the person of Mr. Ronilo A. Obia is hereby affirmed and must be concurred.

Hon. Melogen B. Agnes finally stated to let the Resolution be prepared and let those who want to
concur to sign but still expressed her unwillingness to concur to this appointment.

Having no more comment, the Presiding Officer declared that December 7, 2013 minutes is hereby
approved.
COMMITTEE REPORT:

1. Hon. Melogen B. Agnes raised and presented a letter addressed to the Barangay Council which was
brought to her by Mr. Obia which pertains to School Improvement Plan (SIP) enhancement live-in
workshop seminar at Naga City last December 16-20, 2013 which she attended. As she continued, she
provided materials to be used such as USB for reference purposes of this barangay and made
information that this barangay shall participate in Brigada Eskwela program and traffic enforcement
within the vicinity of the school. As she stated further, this barangay is a stakeholder and included in
their planning and development strategies for the improvement of the school and of the learner.

The Presiding Officer requested Hon. Agnes to prepare her report for this seminar so that it will be
known by all members of the council. In addition, she was advised to also include this as part of her six
(6) months plans and programs being the Chairman on Committee on Education.

Hon. Melogen B. Agnes requested reimbursement for her transportation and other expenses she
incurred in this seminar and was approved by PB Balagot upon presentation of receipts and all other
supporting documents.

Hon. Melogen B. Agnes continued her report and stated that she asked the Barangay Secretary a file of
Barangay Profile for her reference and reported the losses of many streetlight bulbs in Sitio Puro. Hon.
Guadaña added that he purchased streetlight bulbs for replacement subject for reimbursement.

The Presiding Officer made her approval for the reimbursement of streetlight bulbs in Sitio Puro and
ordered to have our Electrician check all street lights and replace all broken and busted lights.

Still not able to submit her six (6) months plans and programs.

2. Hon. Gary T. Salon He raised and asked kind consideration for he forgot to create his plans and
programs for six (6) months but promised to submit the same in the next session. The Presiding Officer
gave consideration to submit his written copy of his plans and programs.
3. Hon. Crisanta B. Repatacodo reported to the august body that she was assigned as Officer-in-Charge
to the Office of the Punong Barangay where she signed Barangay Certification. She added that last
December 20, 2013 there was a celebration of Senior Citizen Day at Millennium Center and observed the
status of the Senior Citizens of this barangay who needs care and attention. She mentioned that on her
observation she wants to make a change on the programs and policies for Senior Citizens.

Still not able to submit her six (6) months plans and programs.

4. Hon. Nordom A. Obumani submitted his plans and programs for six (6) months for his committee to
the Presiding Officer. He reported that the streetlights at the Freedom Park were not functioning due to
losses of bulbs and loss connection of wires and undertook cutting activity of the common grass near
Freedom Park. He stated further, that on December 13, 2013, his committee had undertake cleaning
besides the school campuses of Buhi Lyceum and Buhi North Central School respectively, and added that
he paid from his personal fund the caretaker of the sanitary landfill and the driver of the truck going to
Barangay Delafe of this municipality for the disposal of waste. PB Balagot advised him to ask the Brgy
Electrician to check the wirings and immediately replace or repair such for immediate restoration of the
streetlights.

5. Hon. Godofredo L. Agravante reported and presented his plans and programs for six (6) months, he
stated that as Chairman on Infrastructure, Hon. Bon has already mentioned in his report about the
construction of concrete post and cited that his priority project is to install a steel railings at the portion
of San Pedro Bridge traversing Rinaga River going to Sitio Puro. As he continued, he informed the
committee on health thru Hon. Agnes about his program on Anti-rabies vaccination.

6. Hon. Efren Joevanni R. Bon submitted his plans and programs for six (6) months for his committee to
the Presiding Officer. He reported that one of his priorities is to pass an ordinance for anti-smoking and
liquor campaign for minors aiming to control the residents especially the minors with the assistance of
the Barangay Peace and Safety Officer (BPSO). As he stated further, he informed the members about the
construction of concrete post to be install at Zone 1, 2 & 6 which shall be implemented this coming year
2014.

7. Hon. Jay Rafael E. Guadaña reported and presented his plans and programs for six (6) months with
regards to Barangay Peace and Safety Officer (BPSO) to undergo training, seminar and give them
insurance due them in such case should an accident happen they can avail assistance thru barangay
funds and consider to increase their Honorarium. In addition, he stated that he assigned Mr. Harriel B.
Morante, Mr. Romeo C. Talangan and Mr. Benry M. Analupa as the rescue personnel. As he continued,
he cited bad feelings and experience with the members of BPSO.

The Presiding Officer has given instruction to the Chairman on Peace and Order to have BPSO internal
rules which will serve as guidelines in their daily routine duties. She added that these rules shall be
abided by all members of the BPSO and they affix their signature on it after having the orientation. As
she continued, she also approved the request for the uniforms, flashlights and caps to be used by the
BPSO.

PB BALAGOT ANNOUNCEMENTS/CONCERNS/APPOINTMENTS:

1. PB Balagot reminded the august body that it is necessary to submit their plans and programs in
writing so that once and for all they could assess what program and activities to be prioritized by each
committee including its budget. She mentioned that beginning January 2014, each committee must
have at least one (1) activity to be done therefore, those who were not able to submit still submit by the
next session.

2. Invited all members to attend and participate to the Christmas Party for Day Care the following day
December 22, 2013 10:00am.

3. Buhi Organization of Mountain Bikers (B.O.M.B.) organization requested five (5) indigent families for
their Noche Buena gift giving at Dwinox compound, San Pedro, Buhi, Camarines Sur. She announced the
names of indigent families enumerated to join in the celebration.

The following has been nominated:

1. Caponga, Lino Alberto B.

2. Garcia, Anita F.

3. Obumani, Alberto A.

4. San Antonio, Felicitas S.

5. Tadeo, Regina I.
4. The Office of the Senior Citizen Affairs of this municipality has listed nine (9) Senior Citizens of this
barangay entitled for the social pension to the following:

1. Albuerne, Rosario C.

2. Bacho, Margarita N.

3. Dejelo, Lourdes M.

4. Mendoza, Anita P.

5. Mestiola, Encarnacion DLS

6. Nomo, Virginia C.

7. Sta. Rosa, Pedro R.

8. Sumalabe, Marciana C.

9. Zaballa, Dolores C.

5. Presented the result of Rural Health Unit as to the Mosquitoes density and stray dog population in
Brgy. San Pedro as of October 2013. Requested all council to create a program and campaign to
promote health and safety for our constituents and to implement 4-S Kontra Denque and Dog Bites
under Municipal Ordinance 04-046 to be headed by Health and Peace and Order Committee. Since by
January 2014 a monitoring of stray dogs shall be done by RHU therefore, we must get ready and let our
constituents know about this.

6. PB Balagot announced that the LIGA election of officers was conducted last December 9, 2013and the
new Liga ng mga Barangay President is PB Nelson Velasco. .

7. She also announced that she welcomed the arrival of Sultan Manabilang here in front of our Barangay
Hall.

8. PB Balagot presented to all members her re-appointment of Ms. Julie S. Sabinorio to as the Barangay
Day Care Health Worker. She mentioned that because of her familiarity with the pupils and children in
our Day Care Center and having possessed the skills and already attended various trainings for Day Care,
she opted to retain Ms. Sabinorio which being concurred by all members of the Barangay Council.

9. PB Balagot informed that the Team Sinarapan will be sponsoring FUN RUN activity this coming
December 29, 2013, the starting point and finish line are at the Freedom Park and us to give assistance
on traffic and peace and order by deploying our Bangay Tanod.

10. Since there is no event organized relative this holiday seasons, on December 31, 2013 we shall have
a countdown to welcome year 2014 with street dance, jamming, and little fireworks display free for all
Brgy San Pedro constituents and neighboring barangays to be funded by PB Balagot. Proposed for a
road closure in front of Freedom Park and all council approved and to submit request to Sangguniang
Bayan.

OTHER MATTERS:

Hon. Crisanta B. Repatacodo stated her remarks regarding official documents and written
communications and the likes due for signature by concerned Barangay Kagawad shall be signed at the
Barangay Hall.

Hon. Melogen B. Agnes also stated her remarks about the allocated funds for the Women, Senior
Citizen and Education are very limited.

Hon. Efren Joevanni R. Bon asked the status of the Internal Rules of Procedure of this barangay. The
Presiding Officer replied that this matter shall be tackled on next session.

Hon. Godofredo L. Agravante and Hon. Nordom A. Obumani informed the members that they made a
lantern and traditional Belen to grace the yuletide season.

The Presiding Officer informed the august body that the scheduled session is set on January 4, 2014 and
January 18, 2014.

ADJOURNMENT:

Hon. Melogen B. Agnes presented motion to adjourn the regular session and duly seconded by Hon. Jay
Rafael E. Guadaña.

The session ended at 8:10 PM December 21, 2013.
