Letter No. 2505/R/2015, dt. 29.06. 2015 of the Transport Commissioner, Telangana State, Hyderabad 4 2, _In-the reference 2” cited, Government ‘ssued clarification to the Municipal Commissioners of all ULBs not to collect Octroi, Asselu or Rusume from goods vehicles owners but they can collect market fee on all goods brought for sale from the traders only and in the reference 3 cited, the same wae communicated by this to the Municipal Commissioners of all ULBs, reference 5" cited, the Commissioners of all ULBs of the State are directed to bring the above instructions to the notice of Field Level Officers i.e. Revenue Officers/ Revenue Inspectors/ Sanitary Inspectors etc. to follow the same. 4. In the reference 6" cited, the Hon'ble High Court passed the following orders at. 13.04.2004 in W.P.No. 3234/2004: .in that view of the matter, we think the controversy could be resolved by disposing of the Writ Petition directing the respondents to implement the scheme announced by the Government through Memo.No. 7679/TC1/2003, at. 31.07.2003 and Memo.No. 7707/Pts.lIVA1/2003-1, dt. 25.04.2003 whereby Government had taken a decision not to collect Octroi, Asselu or Rusume from the owners of the lorry which passes through territorial jurisdiction of various districts. Accordingly, we dispose of the Writ Petition directing the respondents to strictly implement the orders passed by the Principal Secretary to Government of Andhra Pradesh in Memo.No. 7679/TC1/2003, dt. 31.07.2003.......” 5. In the references 7" & 8" cited, circular instructions were issued to all the Regional Director-cum-Appellate Commissioners of Municipal Administration in the State to instruct the Municipal Commissioners of their region not to collect Octroi Tax only, Asselu or Rusume from goods vehicles owners as per the judgement of Hon'ble High Court and instructions of Government and also to place the matter in the agenda during their monthly review meetings for strict compliance of the instructions. 6. _In this regard, it is to inform that, a meeting was convened by the Principal Secretary to Government, TR & B Department on 01.07.2015 at 3:30 P.M. with the officials of Police Department, Municipal Administration Department, Panchayat Raj Department and other line departments on the grievances of Telangana Lorry Owners Association wherein it is reported that though there are clear orders from Government in G.O.Rt.No. 551 MA & UD (TC1) Dept, dt. 24.04.2003, judgement of Hon'ble High Court dt. 13.04.2004 in W.P.No. 3234/2004 and instructions of CDMA vide Circular Roc.No. 50/2009/N1, dt. 09.01.2009 & Circular Roc.No. 2059/2014/N1, dt. 06.02.2014, some Urban Local Bodies are still collecting the Octroi Tax, Asselu or Rusume from the Lorry Owners in deviation of rules particularly in Wanaparthy, Tandur and Bhongir Municipalities. 7. In view of the above, the circular instructions issued by this office earlier vide references 7” & 8” are hereby reiterated once again and the Commissioners of all Urban Local Bodies of the State (except GHMC) are directed — (i) Not to collect the Octroi Tax, Asselu or Rusume from the owners of goods vehicles in pursuance of judgement of Hon'ble High Court and orders of Government (il) To incorporate a condition in the contract agreement of Thai Bazars, Markets etc. not to collect Octroi Tax, Asselu or Rusume from the owners of goods vehicles {ii) To book Police case against the contractor in case of collection of Octroi Tax, Asselu or Rusume in deviation of judgement of Hon'ble High Court, instructions of Government and CDMA and contract agreement (™) To place the issue in the agenda of review meetings convened by the District Collector & Regional Directors regularly (The Municipal Commissioner will be personally held responsible for any deviation of these instructions Sd/- B, Janardhan Reddy Commissioner & Director Enck- Copies of ref.cited To The Commissioners of all Urban Local Bodies of the State (except GHMC) The Chairpersons/ Mayors/ Special Officers of all Urban Local Bodies of the State (except GHMC) To the Regional Director-cum-Appellate Commissioners of Municipal Administration, Warangal & Hyderabad with a request to take necessary action in the matter Copy to the Transport Commissioner, Telangana State, Khairatabad, Hyderabad Copy to all the District Collectors and Magistrates in the State for necessary action Copy to the President, Telangana Lorry Owners Association, Plot No. 647, Vivekananda Nagar Colony, Kukatpally, Hyderabad-500072.
