child neglect.

City in Dubai on Saturday.
According to President Masisi,
contemporary youth stand a better
chance to make the world a better
place to live in than any other

Day commemoration ceremony
in Nata on Friday, Assistant
Minister of Health, Mr Sethomo
Lelatisitswe said communities
were the backbone of the battle
against the virus, and that without
behaviour of their parents. She
stated that there were instances
where the school had to intervene
by taking some pupils from their
homes to have them housed in the
hostel because of sexual abuse at
home.
The school head, Ms Neo
Tafa noted that the school was
struggling financially mainly due
to parents’ lack of participation in
school activities.
She said while other schools
made fundraising activities
through Parents and Teachers
Associations (PTA), that was not
the case in her school.
She explained that due to the
socio-economic conditions, most
parents depended on Ipelegeng
for income. She appealed to the
generation that ever existed.
“I know you also face challenges
but you should take advantage
of the enabling environment and
ecosystems around you such as
ICT to advance your cause and
that of your fellow youth and
general humanity,” he said.
He said he was particularly
inspired by young people who
had become solution-seekers
and finders in their respective
communities and cited Kedumetse
Liphi of Ked-Liphi Company from
Botswana, which has innovated
Chedza solar-powered backpacks.
The backpacks are eco-friendly
and useful to learners who do not
have electricity in their homes to
peruse through school materials,
he posited.
All that governments needed
their input and commitment it
would not have been possible to
achieve the results that Botswana
and the rest of the world were
seeing today. This year’s theme:
Let Communities Lead, was fitting
said Mr Lelatisitswe, noting that it
put emphasis on the sustainability

DUBAI - Landlocked Developing
Countries (LLDCs) intend to
participate in climate change
negotiations as a group.
President Dr Mokgweetsi Masisi
revealed this on Saturday during
the World Climate Action Summit
at the 28th Conference of the Parties
to the United Nations Framework
Convention on Climate Change
(UNFCCC) at Expo City, in United
Arab Emirates.
Landlocked Developing
Countries do not have territorial
access to the sea and are to some
extent isolated from world markets
and usually bear huge transit costs.
To this end, President Masisi,
who is the Global Chair of the
Group of over 32 countries made
a clarion call to the UNFCCC not
only to support the position of the
LLDCs but to also extend support
for the group to make this a reality.
“We seek the support of the
United Nations Framework
Convention on Climate Change to
provide the necessary assistance
for the group to achieve this
objective,” he said.
On Botswana’s position on
climate change agenda, President
Masisi told delegates that the
country was doing well towards
transitioning from coal-fired
electricity to renewable energy.
It is for this reason, he said, that
the government had as part of
implementing the Energy Policy
and Renewable Strategy, decided
to increase renewable energy
penetration from two per cent to 30
per cent by the year 2030.
He stated that the Transitional
National Development Plan placed
climate change at the top of the
agenda; a thing he accentuated had
enabled the integration of climate
change risks into all aspects of
planning, decision-making as well
as implementation.
Furthermore, the COP28
2 200 new infections annually. He
added that the same survey showed
that for the first time at the national
level among those aged 15-64
years, the country had exceeded
the UNAIDS global target of 95-
95-95.
He said the target was a fast
track strategy by the UN institution
to end HIV/AIDS by 2030, and
that it indicated that 95 per cent
of people living with HIV in the
country were aware of their status
and that 98 per cent of them were
on anti-retroviral-therapy and that
98 per cent of them had achieved
viral load suppression.
Mr Lelatisitswe added that
further interrogation of the results
showed that men were lagging
behind when it came to testing for
HIV, noting that only 93 per cent of
them were aware of their positive
status.
The assistant minister also said
another category needing attention
in the battle against HIV/AIDS
were adolescents aged between 15
and 24 years. He said only 84.5 per
cent of them were aware of their
positive status , which was way
below the 95 per cent target. BOPA
meeting learnt that the Botswana
gave priority to adaptation actions
that help reduce the vulnerability
of communities to climate-
related hazards thus protecting
livelihoods and the eco-systems as
well as enabling them to develop
resilience.
He cited the development
of drought-tolerant crops and
livestock species and the North-
South water pipeline, which
transfers bulk water to the
Southern parts of Botswana where
there was a deficit as among the
many adaptation actions that were
undertaken by the government.
President Masisi was hopeful
that this year’s COP would present
a perfect opportunity to close down
the curtains of the inventory of the
Paris Agreement.
“The global stock-taking
initiative will no doubt give us
a clear picture that is more than
anecdotal on progress towards
achieving the pact’s goal to limit
global warming to 1.5 degrees
Celsius,” he said.
That withstanding, he said it
was critical that negotiations
at this year’s meeting result
in strengthened actions and
advancement of the Sharm El
Sheik Implementation Plan.
He said the fact that climate
finance had been realised as
an enabler to fight greenhouse
emissions, was imperative to
make such funding available and
accessible to developing countries.
He reminded the assembly of
the need to enhance its action of
building resilience and addressing
loss and damage associated with the
adverse impact of climate change
to accelerate the implementation of
the climate change agenda.
President Masisi was hopeful
that the operationalisation of
the Loss and Damage Financial
mechanism would be concluded
before COP28 drew to a close on

LLDCs climate change challenges unique

DUBAI - The Landlocked
Developing Countries (LLDCs)
are facing high exposure and
vulnerability to an increasing
number of climate-related
disasters such as droughts,
desertification, floods, cyclones
and landslides, says President Dr
Mokgweetsi Masisi.
Dr Masisi, who is also the
Group’s Global Chairperson
made these remarks during the
high-level meeting of the LLDCs
held under the theme; Addressing
Unique Climate Vulnerability of
LLDCs through Partnerships.
The uniqueness of LLDCs, he
said meant that the countries were
destined to face unique challenges
and vulnerability occasioned by
climate change.
He posited for instance that
the geographical locations of
LLDCs forced them to depend on
neighbouring states for business
transactions with the rest of the
world; a thing that he said came at
a cost.
“We have to go through complex
transit routes. These transit
systems often face serious threats
due to extreme weather events,” he
said citing extreme heat, floods, or
snow that he said could seriously
damage road surfaces thereby
jeopardising connectivity.
His audience learnt that all these
hindrances halted trade further
putting strain on the LLDC's
ability to compete in dog-eat-dog
global markets.

Beira in Mozambique and Malawi.
Also, the President said land
surface air temperatures in these
countries had risen nearly twice
as much as the global average.
He said they were affected by
desertification and recurring
dry spells that undermined food
security, livelihoods and economy.
“These challenges have far-
reaching consequences especially
for LLDCs as they trigger a
vicious circle of food-water energy
insecurity, worsening poverty and
increasing the risk of conflicts,”
he said.
These persistent challenges,
Dr Masisi said had led to climate
migration.
Water scarcity has also become
a serious challenge and threat to
the LLDC populace.
With a plethora of challenges,

Genral, Mr Antonio Guterres
took part in the meeting and
commended President Masisi for
his strong leadership of the group
and Botswana.
He expressed his admiration for
the great strides achieved by the
Southern African nation in the
form of good governance, social
cohesion, middle-income status
and sustainable development.
Like President Masisi, the UN
chief was worried by the fact
that the specific challenges that
the LLDCs were grappling with

conference slated for Kigali in
Rwanda next year in June becomes
a success.

leaders’ sentiments and the need
to act with promptness especially
the operationalisation of the loss
and damage fund to address the
climate change chaos that LLDCs

Flagship Programme reminded
the audience that the harsh
realities occasioned by climate
change had led to loss of lives,
displaced people, degradation
of the environment and affected
agricultural throughput.
President Masisi was however,
quick to point out that Africa and
the rest of the developing world
should not just apportion the
blame on the developed world
because they too contributed to
the greenhouse effect albeit at a
small scale.
It is to this end, he stated, that
Africa should forge partnerships
with the rest of the world to bring
about lasting solutions to arrest
climate change.
“We have the responsibility to
avoid pitfalls,” he underscored.
He was happy that COP28 had
reached a major milestone by
delivering a historic agreement
to operationalise the fund,
which would assist developing
nations that were vulnerable to
the adverse effects of climate
change referred to as the ‘loss
and damage’.
The United Arab Emirates
has contributed US$100 million,
the United Kingdom 40 million
Pounds, Japan US$10 million and
the United States has contributed
US$17.5 million.
Dr Masisi’s wish is to have
Botswana have partners in solar
harnessing and water harvesting;

people would stay put and not see
the need to traverse elsewhere in
search of better livelihoods.

the world’s best practices of
mitigation and adaptation that he
said would bring about a win-win

Opportunities abundant - Gaolathe

BOBONONG - In order to fully
harness the abundant opportunities
available in Botswana, visionary
leaders with creative, analytical,
and diplomatic attributes are
required.
This sentiment was expressed by
Mr Ndaba Gaolathe, the President
of the Alliance for Progressives
(AP), during the launch of the
Umbrella for Democratic Change
(UDC) council candidate for
the Borotsi/Lepokole ward bye-
election in Bobonong on Saturday.
The bye-election, scheduled for
December 9, 2023, will see a battle
between Mr Boitumelo Nyambe
of the UDC, Mr Moalosi Afa of
the Botswana Congress Party
(BCP), and Mr Letso Leshiba of
the Botswana Democratic Party
(BDP) within the Bobonong
Constituency.
Mr Gaolathe highlighted the
numerous opportunities presented
by the mining and beef industries,
as well as other natural resources.
He emphasised the need for the
government to fully capitalise
on these prospects to create
employment for Batswana.
He said Botswana, blessed with
diverse natural resources, from
minerals to veldt products, has the
perfect opportunity to establish
processing industries that could
improve the lives of its citizens.
Mr Gaolathe also proposed the
establishment of multilateral beef
companies, owned by Batswana,
akin to popular brands such as
McDonalds Burger and Burger
King in the United States.
This would allow Batswana to
have a stake in the beef industry,
ensuring that the economic
benefits stay within the country.
Regarding mineral resources, Mr.
general elections when they voted
for a member of Umbrella for
Democratic Change (UDC).
Addressing a rally at Borotsi
freedom square Saturday, Mr
Tsogwane appealed to party
members to throng the polls in
large numbers on December 9
Gaolathe stressed the importance
of ensuring that Batswana benefit
more than their partners, as
compared to the current scenario.
Such a shift would ensure that
wealth goes directly into the
pockets of Batswana and serve as
a catalyst for poverty eradication.
Mr Gaolathe believes that the
potential of Botswana’s economy
to generate sufficient employment
for its citizens is immense.
He called for the empowerment
of fearless individuals capable of
voicing their opinions to deliver
Batswana from economic bondage
and other forms of oppression.
Supporting the UDC candidate,
Mr Motsamai Motsamai, MP for
Ghantsi South, urged voters to
support Mr Nyambe. He called on
residents to rally behind UDC, as it
represented the path to a promised
land brimming with opportunities.
Mr Motsamai advised electorates
to scrutinize candidates and vote
for the most capable contender,
highlighting Mr. Nyambe’s
qualifications.
He stressed the necessity of
tapping into natural resources,
particularly water, to enhance
food security and self-sufficiency.
Botswana’s abundance of
perennial rivers provided an
excellent opportunity to bolster
these aspects. Mr Motsamai
emphasized that UDC was a
creative party capable of creating
employment opportunities and
highlighted the significance of
visionary leadership in driving the
country to greater heights.
Moreover, he touched on the
need to establish an elders’ fund
to assist with health care for the
elderly when the need arises.
For his part, Mr Nyambe said
if elected, he would advocate
for development in the area,
and vote for Mr Letso Leshiba in
superior numbers in order to bring
back the ward , which up until 2019
elections, had always been won by
the BDP.
He also called on the members
to use their vote as a yardstick
towards the 2024 elections saying
reducing the burden on residents
who currently had to travel long

Bye-election litmus test - Kekgonegile

BOBONONG -The upcoming
December 9th Lepokole/Borotsi
Council Ward bye election will
serve as a litmus test for the 2024
general elections, according to
speakers from the Botswana
Congress Party (BCP) during the
launch event of their candidate,
Mr Moalosi Afa, in Bobonong on
Saturday.
Mr Goretetse Kekgonegile,
Maun East MP and BCP secretary
general, said that voters should not
be deceived into believing that the
BCP was still part of the Umbrella
for Democratic Change (UDC).
“We have received reports that
there are people going around
telling electorates that Comrade
Afa is standing under the UDC.
This cannot be further from the
truth,” he clarified, highlighting
that this demonstrates the
untrustworthiness of the UDC and
the reason for the BCP’s separation
from the coalition.
Mr Kekgonegile urged voters to
send a clear message to the ruling
Botswana Democratic Party
(BDP) on December 9 that their
time in power has come to an
end. He highlighted BCP’s unique
standards, setting them apart from
the other contenders, BDP and
UDC, as the BCP firmly believed
that jobs that should benefit
Batswana were being exported to
other nations by the ruling party.
“BCP believes that youth should
all members should start working
hard for the party in order to
overwhelm the opposition with a
landslide victory.
“With a landslide victory,
the opposition would be so
emasculated of their regular claim
of vote rigging. If we win this
ward it will be a perfect launch pad
for 2024 elections where we will
have to retain it. If anyone wants
to stand for this ward in 2024,
they must first work tirelessly
to ensure that Mr Leshiba goes
to the Bobirwa District Council
chambers for the remaining 12
months,” he said.
Mr Leshiba, it is said, requested
to stand and if successful,
complete the remaining 12 months
before paving way for the eventual
winner of the 2024 primary
elections. In 2024 Lepokole will
be a stand-alone ward following
demarcation by delimitation
commission.
While canvassing for votes
for the BDP candidate, Mr
Tsogwane called on the party
youth to familiarise themselves
with the BDP-led government’s
programmes to avoid falling
victims to the ‘opposition parties’
hypocrisy.’
He took a swipe at opposition
Members of Parliament for
criticising the BDP-led government
against unemployment and
poverty.
He said the statistics quoted by
opposition MPs were a product
of research sanctioned by the
BDP-led government in order to
devise strategies, programmes and
policies tailor-made for poverty
eradication.
Despite it being hard to
completely eradicate poverty and

MOLEPOLOLE - One
Motlhabakgomo (19 years) who
went missing on November 15 and
later found dead, has been laid
to rest at Lekgwapheng Ward in
Molepolole on Saturday.
Multitudes of Bakwena,
family and friends thronged
Motlhabakgomo’s residence to
bid her farewell under a sombre
atmosphere.

Morwaeng said the circumstances
under which Motlhabakgomo was
murdered cannot be condoned.
Mr Morwaeng said after her
disappearance, the community
came together to help the family
look for her but their hopes to find
her alive were shattered after she
was found dead.

important that the family looked
to God for comfort in such trying
times.
He applauded those who stood
with the family throughout such a
sad time, adding that standing with
one another encouraged the spirit
of selflessness and togetherness.
“Parents need to befriend their
boy children and always talk to
them about relationship issues and
make them understand that when
love ends, it is not the end of the
world,” he added.
The parent, Mr Raoshimane
Boitumelo said they had to deal
with double tragedy as Phenyo
Jakoba who was recently found
murdered with body parts missing

always knew Motlhabakgomo’s
whereabouts because she spent
most of her time at church or her
grandmother’s house.
“One loved God and spent more
time at church where she grew
up and became a Sunday school
teacher,” she said.
Mr Mathata Bakwadi, the
neighbour said he was friends
with Motlhabakgomo’s parents
and continued to give the family
support and care even after they
passed on.
He said the family however
continued to stick together and thus
encouraged the remaining children
to be comforted and know that God
had allowed His will to be done.
Kgosi Moffat Bakwena thanked
the community for the support they
rendered to the Motlhabakgomo’s
family when they were going
through a challenging time until
the day their daughter was laid to
rest.
Kgosi Bakwena implored the
community to continue supporting
each other and lending a helping
hand and a shoulder to cry on
because that was what made

brighter at the ongoing United

The company’s chief engineer
and founder, 33 year-old Mr
Kedumetse Liphi relayed to BOPA
on the side-lines of UNFCCC that

Liphi said the backpack absorbs
sun rays during the day, and stores
them for later use, which has

component where such students
can be able to charge their

said beaming with joy.

canvas, has a life span of five
years, a solar panel and lithium

endorse Bail bill

GABORONE - Legislators have
appealed to government to ensure
that the proposed amendments to
the bail law should also consider
the opinions of the victim.
The legislators were commenting
on Bail Bill No. 19 of 2023, which
was tabled by Minister of Justice,
Mr Machana Shamukuni on
Thursday.
The bill is an act by government
to provide for bail proceedings and
for matters incidental or connected
therewith.
In support of the proposed bill,
Sefhare/Ramokgonami MP, Dr
Kesitegile Gobotswang said bail
application must take into account
the opinions of the victims.
He said the move would bring
a delicate balance between the
rights of the accused and those
of the victim. “We are aware that
a person is innocent until proven
guilty,” he said.
He said the justice system was
slow in resolving matters within a
reasonable time. He therefore said
that based on the current pace of
disposing cases, denying a person
bail would result in a prolonged
stay in custody.
Dr Gobotswang said there must
be a balance to ensure that the
proposed changes were not in
conflict with any provisions of the
constitution.

concurred with Dr Gobotswang
that issues of bail had been a public
outcry as some of those who were
suspects in serious crimes repeated
such offences while on bail.
Mr Tsogwane said the sight of a
person alleged to had committed

had the potential to incite anger
resulting in people taking the law
into their own hands.
He said bail application must
take into consideration the views
of all affected parties to determine
whether to grant bail or not.
He said the law must be tightened
through stringent penalties for
a person to think twice before
committing a crime.
Mr Tsogwane said even though
cases were delayed, in most cases,
such delays were necessary for
investigations to be carried out
thoroughly.
Dr Douglas Letsholathebe of
Tati East stated that granting bail
was temporary release while an
accused person was awaiting the
finalisation of the matter. As such,
he said cases must be thoroughly
assessed before granting bail based
on the seriousness of the alleged
crime.
He also suggested that repeated
offenders and those alleged to have
a hand in ritual killings must not be
considered for bail. Additionally,

facing offences of dealing in illicit
drugs must also be denied bail.

GABORONE - The Minister of
Justice, Mr Machana Shamukuni
has tabled before Parliament Bail
Bill No. 19 of 2023, which seeks
to answer public outcry regarding
suspects who continues to commit
crimes while on bail.
Presenting the Bail Bill of 2023,
Mr Shamukuni said the objective
of the bail was to provide for
circumstances under, which a
suspect or an accused person may
be granted or refused bail.
Mr Shamukuni said in 2019, a
Bail Pitso was convened at which
various challenges surrounding
bail were discussed.
He said the concerns included
that over the years there had been
widespread public outcry that
accused persons were granted bail
with relative ease.
He said the Pitso also
established that the law obscured
in favour of the accused and that
bail was granted with little or
no consideration for the safety
concerns of victims and witnesses
of the crime.
Additionally, the Pitso reiterated
that persons accused of serious
offences were granted bail and
went on to commit similar offences
while on bail.
The minister said one of the
recommendations of the Pitso was
to come up with a Bill to have a law
on bail codified in one enactment
for ease of reference.

GABORONE - The COVID-19
pandemic and a series of
lockdowns disrupted the civil
and building works of Tsabong
abattoir, resulting in more than a
year delay.
Minister of Entrepreneurship, Mr
Karabo Gare told Parliament that
there had been many extensions of
time that were caused by the then
COVID-19 pandemic.
The pandemic had both direct
and indirect impacts as various
overseas suppliers were also forced
to postpone their production and
delivery plans, he said.
Nonetheless, he assured
Parliament that the expected
codifies the law as well as addresses
the mischiefs surrounding bail
by laying down factors to be
considered by the courts on
whether to grant or refuse bail.
Mr Shamukuni said part nine
of the Criminal Procedure and
Evidence (CP&E) Act makes
provision for bail setting out
procedures and processes to be
followed from when an accused
person makes an application for
bail until it was granted or refused.
“Every person committed for
trial or sentenced in respect of any
offence except treason or murder
may be admitted to bail at the
discretion of a magistrate. Any
person who is aggrieved by the
refusal of a magistrate to admit
him/her to bail may appeal to the
High Court,” said Mr Shamukuni.
He said part of the CP&E Act
was read against Chapter 2 of the
Constitution, which guaranteed
fundamental rights and freedoms
of an individual subject to the
respect for the rights and freedoms
of others and to the respect of
public interest.
He said sections 5 and 10 of the
Constitution made provision for
the protection of personal liberty
as well as providing for criminal
trials within a reasonable time.
“In terms of section 5 (2) of the
Constitution if a person is arrested
upon reasonable suspicion of him/
her having committed or about
to commit a criminal offence
and a person is not tried within a
reasonable time, the person shall
completion date for the civil and
building works of Tsabong abattoir
was set for December.
He said the official ground
breaking of the abattoir was carried
out on December 8, 2020 and the
actual construction commenced
on January 12, 2021 with IPS
Botswana as the main contractor.
Mr Gare said the contractor
was supported by a team of local
civil, building, electrical and
mechanical contractors together
with an international team of
technical specialists from South
Africa, Finland and Denmark.
He pointed out that the initial
cost of the project was over P161

contained provisions of section
90 and Part 9 of the CP&E Act

considered by balancing the rights
of the accused person and public
interest.
He said the accused person’s
fundamental right to liberty and
accused person’s fundamental right
to a fair trial within a reasonable
time should be balanced with
the delay in completing the
investigations, public interest and
interest of victims and witnesses of
the crime.
Mr Shamukuni said victims
and witnesses of crimes should
also be afforded an opportunity
to be heard and responded to
before granting bail, especially in
domestic violence cases and sexual
offences.
He said there must be serious
consideration of level of risk posed
to a victim or witness or the nature
and seriousness of the offence.
“Whether the accused was a
repeat offender, including the
accused character, his history
and record in relation to previous
million but due to inflation and
COVID-19, the amount increased
to P179 million.
The increases he said were
driven by high global inflation
specifically affecting freight rates,
and commodity price increases on
inputs like structural steel, copper
cabling, electronics and equipment.
He also clarified that the current
expenditure on the project as of the
last contractor claim was over P147
million.
The minister was responding to
a question from Kgalagadi South
MP, Mr Sam Brooks who wanted a
detailed update on the construction
of the Tsabong abattoir. BOPA

accused person must be considered
on whether to release him/her
on bail or there may be a risk of
retaliation by the relatives of the

into nine parts of which part one
provided for the preliminaries
while part two provided for the
constitutional principles upon,
which bail was premixed and
circumstances under, which bail
may be granted of refused.
He said part two further provided
for what was expected from the
accused person while on bail.
He said the part made it
mandatory for the judicial officers
not to release the accused person
if one of the stated grounds was
established like in a case where the
accused was likely in the eyes of
the court to commit offences like
murder, stock theft, motor vehicle
theft, rape and defilement amongst
others. Mr Shamukuni said part
four provides for the rights of the
complainants in cases of rape and
other offences the right to have
a say in the bail proceedings by
allowing them an opportunity
to give to the prosecution any
information that may be deemed
useful in determining to grant
or refuse bail or in determining
the conditions of recognisances.

GABORONE - There is a need to
revisit the Penalty Code and review
clause 10(2a), which deals with
granting suspects bail, otherwise
all efforts of dealing with the issue
of bail will be in vain.
The clause states that ‘Every
person who is charged with a
criminal offence shall be presumed
to be innocent until he or she is
proved or has pleaded guilty.’
Contributing to the Bail Bill No.
19 of 2023 on Thursday, Palapye
MP, Mr Onneetse Ramogapi said
the clause was a major hindrance
to all efforts as the penalty code
was the most supreme law.
“There is clear evidence on the
ground that most suspects on bail
had a propensity to re-offend,” he
said.
He also advised that caution
should be exercised to ensure that
bail denial was not abused, citing
cases where people had made false
accusations against others just to
punish them.
“The issue of false accusation
should also be harshly punishable,
otherwise this Bill would be a
double sword,” he said.
For his part, Member of
Parliament for Mochudi West, Mr
Mmusi Kgafela however, said it
would not be so easy for Botswana
to repeal legislature that preserved
and protected the rights and lives of
individuals, such as Section 10(2a)
as they were part of international
declarations that Botswana has
entered into.
He also agreed that it was not
easy for a judicial officer to deny
or grant bail.
“Sometimes you grant bail
and the suspect re-offends, and
sometimes you deny them bail
only to later emerge that they were
innocent,” he said.
He also said the Bill did not
change the existing laws much,
but that it was just a codification
of existing clauses into a single
document for consideration by
Parliament.
He also said the challenge with
bail was not the law itself, but
rather the administration part, such
as the slow pace of prosecution.
He also cautioned against the
practice of charging suspects
before concluding investigations,
saying that was the cause of delays
in prosecuting as investigations
would now be done while suspects
were on remand.
“This means that if it later
emerges that the suspect was
innocent, they would have wrongly
spent years behind bars,” he said.
Mr Kgafela also advised that the
four possible tiers.
“It is my wish that the enactment
of this Bill will also cause
Botswana’s ranking to advance to
tier one,” he said.
Mr Shamukuni said Botswana
domesticated the United Nations
Convention of transnational
organised crime through the
enactment of the Anti-Human
Trafficking Act in 2014.
However, he said the current law
had deficiencies, which if ratified,
would facilitate the attainment of
minimal standards for elimination

for finally being responsive to the

magistrate.

Parliament adopts missing people motion

GABORONE - Parliament
on Thursday adopted an urgent
motion tabled by Molepolole
North legislator, Mr Oabile
Regoeng requesting government
to swiftly put in place measures to
curb incidents of people reported
missing and later found dead, or
never found at all.
Presenting the motion earlier on,
Mr Regoeng had raised a complaint
that such cases were on the rise
nationally, hence the matter needed
urgency.
“As lawmakers, it is upon us to
come up with measures to curb
this problem. We cannot risk being
slow in addressing it because this
may lead to people losing trust and
taking the matter into their hands,”

He said the current Act allowed
for fines in lieu of imprisonment,
which was contrary to international
best practices especially given the
evasive and debilitating effects of
human trafficking on the victim.
Furthermore, he said the current
law also imposed penalties,
which were not commensurate
with penalties for other forms of
serious crimes such rape and sex
trafficking particularly where
children were involved.
He said the Bill had 12 clauses
well thought out, especially that
it gave magistrates liberty to use
their discretion even when the
prosecution does not oppose bail.
He said it was also good that
the amendment would allow the
victim to participate during the
trial, which he said would give
them closure.
For his part, Mahalapye East
legislator, Mr Yandani Boko also
applauded the minister for the Bill,
saying he did an exceptional job.
He, however, said it should be
noted that the Bill did not seek to
deny suspects their right to bail,
rather only to make granting of
bail hard. BOPA

Mr Regoeng also called for the
establishment of a special police
unit to deal specifically with such
cases.
“I understand that we already
have special units such as the
CID and DISS, but cases of such
nature are on the rise, therefore
these existing special units are
overwhelmed, hence the need for
an additional one,” he said.
Mr Regoeng also called for a
specialised court to deal with such
issues.
Contributing to the motion,
Member of Parliament for Selebi
Phikwe East, Mr Kgoberego
Nkawana requested a review of the
standard operating procedure that
recognised a person as missing
after 24 hours.

dealing with severe forms of
trafficking in persons which
included a child, a person with
disability or victim who was
particularly vulnerable.
Mr Shamukuni said the penalties
were increased such that they were
sufficiently stringent. He said the
use of drugs and habit-forming
medication in trafficking a person
attracted a sentence of 30 years or
a maximum of life imprisonment
and a fine of not less than P1
million.
He said clause six amended
section 10 of the Act by enhancing
penalties for acts that enhance
human trafficking from sentences
of 25 years and fines of P100 000
to sentences of life imprisonment
and fines of up to P1 million.
Additionally, he said clause seven
amended section 12 of the Act by
aggravating penalties pertaining
to the use of trafficked persons for
sentences of 15 years and P400 000
to sentences of life imprisonment
and fines of up P1 million. He
said clause eight amended section
12(a) of the Act pertaining to the
smuggling of persons such that the
offence attracted new penalties
from 15 years to life imprisonment
and fines P200 000 to P1 million.
As for clause nine, Mr
Shamukuni said it would insert a
new section pertaining to attempts
while it criminalises the act of any
person who attempts to commit
any offence under the Act, while
clause 10 amended section 20
“This is too long a time for
perpetrators to finish their job and
conceal evidence. So I plead that a
person should be declared missing
as soon as reasonably suspected,
and action taken sooner,” he said.
He also called for the resourcing
of the police to enable their speedy
response to reports.

breach of the victim’s privacy from
a sentence of 10 years to 15 years
and new minimum fines of P20
000.
He said clause 12 of the Bill
amended section 30 pertaining to
extra territorial jurisdiction such
that any citizen of Botswana or any
person who permanently resides
in Botswana who commits serious
offences of trafficking in person
were liable to maximum penalties
of life imprisonment and a fine of
P1 million.
Mr Shamukuni said Anti-Human
Trafficking (Amendment) Bill
No. 18 of 2023 was published on
October 20, 2023. He said Human
Trafficking was a multi-faceted,
multi-layered and dynamic form of
trans-national organised crime.
He said the crime often manifests
itself in the most invasive forms
of exploitation and offences
against a person to include forced
labour, sexual exploitation and
organ removal. Mr Shamukuni
said in 2002, Botswana ratified
the United Nations convention on
trans-national organised crime
representing a major step towards
the fight against trans-national
organised crime.
He said the ratification was
supplemented by three protocols
being the protocol to prevent,
suppress and punish trafficking
in person especially women and
children.
“The second protocol is that
against the smuggling of migrants
by land, sea and air while the third
was a protocol against the illicit
manufacturing of and trafficking
in fire arms, their parts and
components and ammunition,” he
said.
Mr Shamukuni said once
amended, the Anti-Human
Trafficking Act would ensure that
government met the minimum
standards for the elimination of
human trafficking as espoused
in the UN convention of trans-
national organised crime and its
supplementing protocol to prevent,
suppress and punish human
trafficking in persons especially
women and children.
He said the Bill takes cognisance
of present-day challenges in the
fluid landscape and complexities
of human trafficking. Minister
Shamukuni said it catered for
corporate criminal liability to
ensure accountability not just
on the part of the individuals
but groups of individuals and

Kusi boon to agriculture sector

GABORONE - Kusi Ideas Festival
is an interconnection platform that
will give participants exposure to
great investment opportunities in the
agriculture sector, says commercial
farmer and managing director of JP
Roos Vegetables (Pty) Limited, Mr
Jan Pierre Roos.
With African countries heavily
reliant on imports, he says for as
long as there are no manufacturing
entities with agricultural inputs,
African farmers will continue to
depend on imports from other
regions, adding that, “there are
currently no programmes addressing
this issue, while we appreciate
government trying to lure investors
to set up in Botswana there is little
activity.”
Therefore, the coming Kusi Ideas
Festival slated for December 7-8,
Mr Roos said it would give exposure
of great investment opportunities
in Botswana from a funding point
of view, facilitation of long-term
relationship with international
supply chain market players and
facilitation of markets for Botswana
goods internationally and finally risk
mitigations measures for farming
industry.
Expected to speak at the festival,
Mr Roos, encouraged government to
on-board farmer programmes aimed
at lobbying investors so that people
on the ground could provide critical
information and data to investors
about opportunities in Botswana
and the need for capital investment
in Africa and facilitation of free

in the region, there was still lack of
activity from companies that already
with operating internationally, which
could be a result of international
players unaware of existing
opportunities.
“The ease of doing business is also
an issue that African governments
need to attend to. Governments
need to facilitate for investment by
providing some form of comfort to
investors that their money will be
safe,” says Mr Roos.
Further, he commended Botswana
for the vegetable import ban which
he said incentivised farmers to
increase production to meet the
country’s demand, adding that
farmers tackled the opportunity
head-on, and in some product lines,
production exceeded demand during
certain months of the year.
He said all-year production
of some vegetables was very
challenging due to Botswana’s
unfavorable climatic conditions.
Cool-weather crops such as potatoes
and onions were normally only
produced in the winter, but farmers
were stretching production season
to meet the 12-month demand
period. Thus, the need for enormous
investments to acquire special seeds
and planting material, improved
farming technologies, cooling
facilities, and advanced storage
facilities.
Farmers, therefore, needed
investment assistance to achieve the
country’s food security vision.

travel and tourism packages, as cultural
tourism plays a critical role in setting
Botswana apart from the rest of the world.

deserved to take centre stage on the travel
operator’s packages to allow tourists to
explore beautiful Botswana.
Minister of Youth, Gender, Sport and
Culture, Tumiso Rakgare said this when

BK Proctor celebrates milestone in style

artiste Hanceford Magapatona,
better known as Han-C, also
served guests with his Setswana
songs such as Maloba jaanong

Since their establishment in
2017 Collections by BK Proctor
was official launched in August
2018 and it has steadily grown
and now, in 2023, they are proud
to celebrate their fifth year
milestone in the industry.

Artistes spice up BDF

concert in Maun

MAUN - Some upcoming local
artistes in Maun have appreciated
the opportunity accorded to
them by Department of Youth
to participate in this year’s BDF
Bands Concert in Style aimed
to raise funds to assist the less
privileged members society.
The organisers gave upcoming
artistes a platform to spice the
event by showcasing their brilliant
indigenous talents.
Held at Maitlamo Junior
Secondary School multipurpose
hall over the weekend, the
identified artistes included Kwelo
Setlholo, Pantsula Skeem Sam
and the Jazz sensational Sereta
Diwambara commonly known as
‘Histo’ in the music circles.
They hailed the concert saying it
was creating a positive impact by
supporting local musical talent.
First to electrify the stage was
the Maun-based legend, Setlholo,
who performed the popular South
African song Meadowlands using
a traditional flute popularly known
as phala and leaving spectators in a
very festive mood.
He had the audience glued to his
performance to the end.
Diwambara also gave his all,
displaying passion, enthusiasm and
energy, which left the audience in
stitches.
“This is a great achievement for
us as upcoming artistes to share
a stage with the renowned BDF
Bands and this will also help us
in terms of marketing as well
as establishing a strong musical
foundation,” said Diwambara.
He appreciated that the
concert had helped to nurture
and developed them so that
they could become professional
musicians in future and wished
the organisers could continue with
the arrangement saying that would
give upcoming artistes exposure
and, which would lead to growth of
the music industry.
In future, he wished artistes
could also emulate the BDF bands
and extend a helping a hand to the
needy.
However, hundreds of revellers
thronged the much hyped
event popularised by its live
performances and as always the
event lived up to expectations as
different BDF groups displayed
amazing energy, beautiful talents
and skills throughout the night.
Meanwhile, the Maun-based
newly registered, Matamo Men
Society Group received P25 000
from concert’s proceedings.
The group aims to device ways
of fighting social ills such as
gender-based violence, alcohol
abuse, violation of children’s rights
and criminal activities, among
other things.
In an interview, the group’s
acting coordinator, Itumeleng
Takhwiri appreciated the financial
assistance saying it came at the
right time as the movement was
struggling to secure sponsors to
drive its mandate of reaching out to
men in the Nhabe region.
He said they had planned
activities and believed that the
funding would help achieve them.
“Although the funding is
not enough, we appreciate the
assistance and we are hopeful that
we will be able to host some of
our activities in the pipeline such
as panel discussions with men and
bonfire chilling sessions where we
will discuss issues affecting men,”
he added. Takhwiri acknowledged
that since the formation of the
group, they had achieved a lot as
they had reduced defaulters from
their HIV treatment due to alcohol

BNOC faces securing funds challenges

versus Ukraine war, COVID-19,
deglobalisation and oil and
commodity prices seem to have
nothing to do with Botswana
National Olympic Committee
(BNOC), but they actually
have a lot to say in terms of the
committee securing funds for its
programmes.

Same old problems cost Ext Gunners

GABORONE - When former
premier league giants, Mochudi
Centre and Extension Gunners
met under floodlights at the
National stadium on Saturday,
their supporters were expecting
a closely contested First Division
South League encounter.
Many were astonished as
Chiefs walked away with a wide
4-1 winning margin, and the
difference in the score line could
be attributed chiefly to two errors
by Gunners goalkeeper, Ofentse
Tauyatswala rather than poor play.
However, Gunners assistant
coach Stanley Mwanga instead
pointed fingers at their usual
challenges.
Mwanga indicated that their
poor performance was due to
Extension Gunners fans as their team was humiliated by Mochudi Centre Chiefs during First Division
South League encounter in Gaborone on Saturday. Chiefs walloped Gunners 4-1.

Tshenyego said because of the
above mentioned challenges
sport and recreation funding has
become less of a priority.
He called on sport leaders to
join forces and find solutions
to the challenges. Tshenyego
added that deglobalisation meant
increased prices in the short run
at least and inflationary pressures.
He said the challenges had
led to the tightening of belts in
the corporate sector, who were
sources of supplementary funding
for sport development and elite
lack of proper training. “This
was one of the few games that we
did not play well in defence, but
if you looked at the whole team,
physically we were not there. We
did not train well this week as we
only had two days of training, and
in two days there is nothing much
you can do,” he said.
Mwanga would however not be
drawn into reasons for missing
training, instead calling it an
‘administrative issue’.
“I cannot go much into that, I
am a technical person and I can
only talk about technical things,”
he said.
He said that all the four goals
they conceded were really
schoolboy errors emanating from
poor defending.
Concerning the performance
of his first choice goalkeeper,
sport locally and abroad.
However, he said BNOC was
looking ahead and forging a path
towards Paris 2024 olympics,
adding that they continue to amass
milestones on the road to Paris
with varying levels of success.
He said the late release of funds
to prepare athletes for the games
was a contributing factor to Team
Botswana’s poor performance in
recent international competitions.
He said it was clear that
BNOC should work in tandem
with other sport stakeholders
Mwanga said he was not feeling
well. “The medical team did not
tell us that he was not feeling
well, only to realise later that he
was feeling dizzy and all that.
Otherwise we could have long
substituted him or not played him
at all,” he said.
He said that he only realised that
something was wrong with him
when he missed easy pickings.
Concerning the general play,
Mwaanga said they were not that
bad as they managed to move
forward as team.
He said that his team produced
numerous crosses, which they
failed to even attempt to score.
The assistant coach promised
Mapantsula faithfuls that they will
work on the problem and do better
in the coming games.

“On Wednesday we decided to
forfeit our training and instead, sat
down as a team to discuss these
issues. We told the players as the
technical team that we could not
continue not training because of
the off-the-field issues they were
aware of, and am happy that our
talk produced this result,” he said.
He also said that they always
tried to go into their next game
with a positive mind regardless of

Kgamanyane had an off day in

Two minutes later, the referee
awarded GU a penalty after
Sebapalo brought down Tlhalefang
inside the area. Kgamanyane’s
tame spot kick was however saved
by Bosekeng.
The goalkeeper watched
helplessly as GU doubled their
lead through another close range
finish by Kgaswane in the 27th
minute. Kgamanyane then came
close to extending the lead, but his
low shot came off the post.
The Jungle Kings’ attackers
were starved of opportunities and
only managed a few forages inside
the GU penalty area in the first
half.
However, their two good
opportunities were fired narrowly
over Thabo Motswagole’s goal
posts by Thabiso Boti and
Thabang Toko in the closing
stages of the first half.
GU continued missing easy
chances in the second half with
Kgaswane and Kgamanyane as
the main culprits.
However, Kgamanyane
eventually extended the lead in
the 64th minute, tucking home his
eighth goal of the campaign from
close range after good work by
Tlhalefang.
Tlhalefang wrapped up the
victory five minutes later by
flicking a shot from Kgaswane
into the top corner.
GU then eased off with coach

Galaxy coach happy with players

Galaxy and Tanzania’s Simba SC
have played to a goalless draw in
a CAF Champions League first-
round Group B match played at
Obed Itani Chilume on Saturday
in Francistown.
Despite the home draw, Galaxy
coach Morena Ramoreboli said
he was happy with his players’
performance and that it was a
tough game. He however, said they
missed a lot of opportunities that
could have changed the tide of the
game, adding that they would take
the point and move forward.
He said Simba was a very tough
and competitive team and that his
players showed a lot of character.
The game started on a high note
with both teams launching attacks
in search of an early goal with
the likes of Daniel Msendami of
Galaxy missing half-chances.
They launched attacks and
counter-attacks with Simba
enjoying more ball possession.
Galaxy goalie, Goitseone Phoko
made a crucial save from a well
taken free kick by Ossomba
Onana who curled the ball around
the wall.
Jean Othos had the first clear
chance of the game in the 15th
minute, but Phoko rose to the
occasion once again and grabbed
the ball on the line.
Msendami, who was looking
sharp for Galaxy, took on Simba
defenders in the 34th minute only
to find the side of the net.
The game went into recess
with the score sheet reading 0-0
and immediately after the break
Galaxy were awarded a free kick,
but Gilbert Baruti ballooned the
ball over the bar.
As both teams reached the last
stages of the game and players
starting to get tired, many scoring
opportunities were created but
both teams still could not find the
back of the net.
Galaxy defenders played as
a unit and thwarted dangerous
moves from Simba’s players,
particularly Othos who was a
thorn on the side of Galaxy. BOPA
