AFFIDAVIT OF PASSENGER

I, DIANNE ANTONETTE GUERRERO LI, Filipino citizen, of legal age,

single, and presently residing at Reynaldo St., Estacio Village, Brgy. 27
Bayanihan, Butuan City, after having been duly sworn in accordance with law,
hereby depose and say:

1. On March 1, 2011, I was one of the DOH Caraga personnel who were
designated to fetch from the Butuan City Airport, Brgy. Bancasi, Butuan
City DOH Central Office personnel who will conduct validation of
certain programs, projects and activities of DOH Caraga.

2. On our way out of the airport, two among the DOH vehicles, Nissan
Vans which were respectively driven by DOH employees RENANTE
L. PABELLO and ANECITO P. MEDINA, were flagged down by
LTFRB Caraga Apprehending Team interviewing passengers as to the
mode of engaging the services of the VAN.

3. Being the personnel in charge of the trip, I was able state the estimate of
the hiring rate of private vehicles being commissioned by the DOH
Caraga in its COVID 19 response related activities in the region.

4. The LTFRB Caraga Apprehending Team may have relied on my

statement, the two (2) Vans carrying DOH Central Office personnel
were apprehended, MVIR Nos. 014626 and 014627 dated March 1, 2022
allegedly for a violation “COLORUM – PRIVATE MV OPERATING AS
FOR HIRE WITH CONTRACTING DOH CARAGA P5,000.00 OR
P4,000.00 XXXX.”

5. Candidly, I may have heard the amount of hiring private vehicles for
DOH Caraga COVID 19 response activities, BUT I HAVE NO
KNOWLEDGE OR INFORMATION SUFFICIENT TO FORM A
BELIEF AS TO THE TRUTH OF THE DETAILS OF HIRING, in this
case, the two (2) NISSAN VANS.

6. By and large, hiring of service providers were being undertaken by the

DOH Administrative Division. The terms and conditions of the
engagement are on their record.

7. Contrary to my experience where the service providers provide their

own driver, in this case, the two (2) Nissan Vans were driven by DOH
drivers.

 8. After the incident, I made a query with our concerned unit tasked of
providing vehicles to end-users. It was known the two (2) Vans were
just borrowed to accommodate the extreme necessity of service vehicles
at that time brought by, on top of the priority and urgent activities
within the region, the arrival of number of personnel from DOH
Central Office. To reiterate, said units were driven by DOH drivers.

9. That I retract my statement given to the LTFRB Apprehending Team. I

may have uttered an amount but it was made out of surprise, it was
neither confirmed nor uncorroborated. It was not applicable in the case
of the aforesaid Vans.

10. Finally, DOH Caraga, in its effort to save the Republic of the
Philippines from the wrought of COVID 19 pandemic, TIME IS OF
THE ESSENCE.

11. That I am executing this affidavit to attest to the truth of the foregoing
facts.

IN WITNESS WHEREOF, I have hereunto affixed my signature this 7th day
