ABOUT

CANCELLATION OF INDONESIA-NEDERLAND RELATIONS

BASED ON THE ROUND TABLE CONFERENCE AGREEMENT

PRESIDENT OF THE REPUBLIC OF INDONESIA,

Considering :
that in the interests of the State and People of the Republic of Indonesia
who were seriously harmed by the Round Table Conference Agreement at
Gravenhage in 1949 and which was registered at the United Nations
Secretariat on 14 August 1950 No. 894, it is deemed necessary to cancel
relations between Indonesia and the Kingdom of the Netherlands on the
basis of this Agreement, including the Statute of the Union, the attached
agreements, as well as the exchange of letters and other inscriptions:

Considering :
That from the Indonesian side, efforts are always being made to obtain
agreement from the Kingdom of the Netherlands to create new normal
relations between fully sovereign States, in several negotiations which
always failed due to the unwillingness of the Government of the Kingdom
of the Netherlands;
Considering :
that based on the above matters it is not appropriate and fair to require from
the Indonesian Government a continuous willingness to hold negotiations to
reach a bilateral agreement for the cancellation referred to above and therefore
there is no other way than unilateral cancellation in accordance with the
meaning and significance of the law international;

Reminder :
Decree of the President of the Republic of Indonesia No. 33 of 1950, Law no.
7 of 1950 and articles 89 and 120 of the Provisional Constitution;

With the approval of the House of Representatives;

Law Concerning the Cancellation of Indonesia-Nederland Relations
Based on the Round Table Conference Agreement.
Article 1.

The Government of the Republic of Indonesia stated that the relations between the Republic
of Indonesia and the Kingdom of the Netherlands were based on the agreement at the Round
Table Conference in Gravenhage in 1949 and which was registered with the United Nations
Secretariat on 14 August 1950 No. 894, is hereby abolished and is therefore void.

Article 2.

The Charter of the Transfer of Sovereignty, the deed of transfer of sovereignty, as well as the
exchange of letters regarding the status quo of West Irian are hereby abolished and are
therefore void.

Article 3.

The Indonesia - Netherlands Union as intended in the Status of the Union is hereby abolished
and is therefore null and void.

Article 4.

The Statute of the Union, including its annexes as well as agreements and exchange of letters
concerning matters of cooperation, both in the fields of Foreign Affairs, Defense and Culture,
as well as in the fields of Economy and Finance are abolished and are therefore null and void.

Article 5.

Laws, decisions and implementing regulations regarding the matters mentioned in articles 1
to 4 are no longer valid.

Article 6.

The relationship between the Republic of Indonesia and the Kingdom of the Netherlands is a
normal relationship between fully sovereign countries, According to the International Law
Article 7.

The interests of the Dutch people within the territory of the Republic of Indonesia are treated
according to the rules contained in the Provisional Constitution of the Republic of Indonesia
and the laws in force or which will apply within the territory of the Republic of Indonesia.

The rights, concessions, permits and methods of running Dutch companies will be respected
if they do not conflict with the interests of state development.

The treatment as intended above cannot be based on special privileges for any reason.

Article 8.

The implementation of this law is regulated by Government Regulation.

Article 9.

This law could be called the "Act for the Cancellation of the Round Table Conference in its
entirety."

Article 10.

This law comes into force on the day it is promulgated and has retroactive power until
February 15, 1956. So that everyone can know, this Law is ordered to be promulgated by
placing it in the State Gazette of the Republic of Indonesia.
