Order below Exh. 1 in S.C.C. No. 1988/2021.

Perused the record. Accused is facing trial for offence

punishable under section 119/177 Motor Vehicle Act. The offence
has taken place on dt.16/09/2021 and report has been filed on dt.
17/09/2021. Since, the prosecution has not secured presence of
accused before the court. The case is old one and lingering on the
same stage since long. There is no possibility to secure the presence
of accused before the court. Hence, I do not find any reason to keep
this case pending further. Hence, I pass following order­
ORDER
(1) The proceeding of the case is stopped under section 258 of
the Code of Criminal Procedure.
