GENERAL TERMS: 5.1 Signage, outdoor banners/backdrops: No items are to be attached, pinned or glued to the wall of any function rooms, pre-function area or hotel rooms. Signage in hotel public areas must have the prior approval from the management of the hotel. Outdoor banners or backdrops are not allowed to be hung anywhere around the hotel premised, except for the designated area which is above the hotel entrance porch. The client is advised to order outdoor banners or backdrops which measure (to be advised) if they wish to display them for the functions. All Signage's, banners and backdrops must not obstruct any emergency exit and fire prevention and protection equipment. Hotel will not take any responsibility for incidents or accidents occurring because of the negligence of the organizer and not accepting the safety advice of hotel authorities. The outdoor banners or backdrops must be removed immediately at the end of the function. 5.2 Outside contractors: For all exhibitions and staging set-ups performed by outside contractors, plans must be approved by the hotel's Chief Engineer a minimum of 30 days prior to the event. The outside contractor will be responsible for liaising directly with the hotel's Chief Engineer regarding all relevant details. The constructor’s and supplier's attitude and grooming must be in a good condition during function. All tools and machines of the constructors and suppliers must be in good condition and well-functioning, Hotel will not take any responsibility for any incident or accident caused by outside contractors or outside contractor's tools and machines. No smoking, chewing betel nut, loitering, taking off clothes and shoes in the hotel {pre-function area of ballrooms, and function rooms) is not allowed in hotel premises. Organizer will be held responsible as per hotel's rules and regulations in case of non- compliance with above terms and conditions. 5.3 Performance of the Event: In order to avoid any inconvenience to your neighbour clients, should you have any performance or entertainment going on during your event, please inform to the Event Sales Manager before signing the contract. A full details program is required at least 3 days in advance, Otherwise the hotel has a right to move your venue or stop all the performance during your function, Performance of fire dance, decoration with fire, open flames and all hot works are strictly prohibited within the hotel premises. Any performance of dangerous acts and with sharp objects id prohibited. Organizer will be held responsible by non-compliance with the safety advice of hotel authorities. 5.4 Liability: The hotel shall not be tiable for any claim, demand, proceedings, cost, charges and expenses whatsoever for personal injuries (including death} to any person invited or employed by the patron. The client will be responsible for all damages of hotel equipment caused by his guests during the event and consequently will be liable to pay the costs of repairs and losses accordingly, whether this was caused by the client or by a subcontractor working on the client's behalf. The hotel reserves the right to exclude or reject any person from the function or the hotel premises. In the event of force major, government requisitions or act of god, the hotel will not be liable for loss of profit of other similar or dissimilar collateral or consequential damages whether based on breach of contract warranty or otherwise. 5.5 Deliveries: Entry to loading dock is via Kaba Aye Pagoda Road * The operating hours for the loading dock are between 9:00 a.m. to 11:00 a.m. and 2:00 p.m. to 4:00 p.m. ‘+ Need to register at Security Department for visitors gate pass and for the work permit need to register at Engineering Department. * Loading area to deliver documents, goods for functions use the Lift No.14, cargo lift and Stair Case No. (2), beside the side entrance. 5.6 Prohibition of outdoor food and beverages: The hotel doesn’t allow the contractor or organizer to bring in any kind of food to the hotel, especially is ballrooms, function rooms and foyer area before, during, after function, 5.7 Final details: All the final details as: menu, beverage arrangements, room set up, audio-visual requirements, entertainment, starting and finishing times must be confirmed 3 days prior to the function date. VI. TERMS OF FORCE MAJEURE: ‘The two sides will not be responsible in case of any force majeure which leads to the cancellation of the contract. The following cases are considered force majeure are war, strikes, protests, earthquakes, floods, landslides, fire and government policies during the course of the contract. VIL. DISPUTE RESOLUTION: The two sides committed to fully implement their obligations under the terms of this contract, if anything changes, the two sides must agree in writing documents. During the course of the contract, if there is any problem violating the contract, the two sides shall negotiate and settle in a spirit of cooperation. If the problem cannot be resolved by negotiation, conciliation, the matter willbe brought in front of court of (to be advised) to resolve, Court fees would be settled by the side that breach of contract.
