ARTICLE 1: PREAMBLE
We the concerned citizens of Kicwamba B LC1, Kicwamba Parish, Lyakajjula sub county,
Lyantonde district aware of our national obligations and duties regarding the natural and
concerted development of our nation Uganda, interested in building , strengthening and
improving livelihood of the people in our area.

Do hereby establish a group known as Kicwamba B, Farmers Group.

This group started on 30th September 2020 with twenty members. We have decided to
write a constitution that will guide all the members and the activities of the group.

Current number of members: 22

ARTICLE 2: NAME AND ADDRESS


The association shall be referred to as the names and addresses as shown below;

ARTICLE 3: MISSION AND VISSION OF THE GROUP

Mission: Transforming our community through Crop growing, Livestock farming and
trading.
Vision: To help the needy and the orphans.

ARTICLE 4: PRIMARY OBJECTIVES


 To provide excellent services and skills to the members that can enable a person
to live a better life.
 To instill the values of living and working together in the community.
 To develop the ability to use the problem solving approaches in various life
situations.
 To enable people in of our society to be job creators rather than job seekers
through practical skills.
 To create jobs to our fellow members through practicing farming and trading.
 To help the needy and the orphans.

ARTICLE 5: ACTIVITIES OF THE ASSOCIATION
 Saving and Credit for the group members.
 Livestock farming.
 Crop growing.
 Trading.

ARTICLE 6: MEMBERSHIP

(a) Eligibility.
(a) To be a member of Kicwamba B farmer’s Group , a nonrefundable membership
fee of Shs.20,000 will be paid to the treasurer of the group.
(b) A Ugandan youth aged 18 and above years.
(c) A resident of Kicwamba B and neighbouring areas within Lyantonde District.
(d) Is a community member of sound mind and law abiding.
(e) Is acceptable to all group members to be a member.
(f) Is willing to participate in group activities and fulfil group obligations
including repayment of loans.
(g) Should have land where to carry out crop growing.
(b) Rights of Members.

Every group member shall:


(a) Be entitled to attend all group meetings.
(b) Vote and be voted to any committee position.
(c) Share profits and losses arising from the activities of the group.
(d) Have unrestricted access to all books of accounts maintained by the
group.
(e) Take part in activities of the group.
(c) Responsibilities of Members.

Every group member shall:


(a) Attend all meetings of the group.
(b) Participate actively in project implementation in accordance with the group
activity schedule.
(c) Participate as a committee member.
(d) Initiate and formulate policies for approval in the annual general
meeting.
(e) Exercise control on effective use of resources.

(d) Liability of Members to the Group
(a) Members shall:
i. Co-guarantee one another.
ii. Ensure that individually and collectively they meet all the obligations spelt
out.
(b) Group members who leave the group shall remain liable to the group until the
end of year.
(c) Group members who leave the group shall not be entitled to benefits derived
from group projects.

(e) Cessation of Membership.


A member shall lose membership only when he/she:
(a) Dies.
(b) Decides to vacate the group on his/her own and such a member can’t enjoy
group benefits.
(c) Has been expelled by the group for misconduct.
(d) Fails to attend group activities as prescribed by the group.
(e) Fails to attend three consecutive group meetings of the group without genuine
reason in writing.

(f) Meetings of the group.


The executive committee of the group shall hold a meeting once in every month hence in
case of emergency; the committee shall convene a meeting at any time.

ARTICLE 7: DISMISSAL FROM THE OFFICE


In case if misbehavior by the members of the executive, the council shall have the right
to send away the member of the executive.
The member of the executive shall leave the office by the vote of no confidence from at
least a half of the members of the group.

ARTICLE 8: VOTE OF NO CONFIDENCE


Any executive member who is guilty of abuse of the constitution of the association and
any other misbehavior which is contrary to the group objectives shall be deemed to a
vote of no confidence.

ARTICLE 9: FINANCE / SOURCES OF FUNDS


The group shall raise funds, acquire property, manage and maintain the same as per the
representatives of these rules and guidelines embodied

Sources of Funds
The group shall raise funds, from any of the following sources;

 Member ship fee
 Subscription fee
 Grants / gifts
 Fines
 Fund raising

Management of Funds
The association shall collect funds through the treasurer who shall bank the funds and
keep the bank slips until withdraws shall be done by a minimum of three (3) signatories
and these are,
1. Chair person
2. Secretary
3 Treasurer
Financial statements shall be presented every month by the treasurer.
The group shall open up a saving account in any bank established around our district.

ARTICLE 10: GROUP LOANS


The group shall give loans to only members at an interest rate discussed of 5%.
A member shall pay back the loan within 1 year.
A member who fails to pay the loan shall be fined.

Loan securities
These may include;
 Land titles and agreements.
 Motor vehicle.

Note: Any member who intends to get a loan from Kicwamba B farmers group shall
bring 2 guarantors from this group.

ARTCLE 11: THE EXECUTIVE MEMBERS


1. Chairperson
2. Vice chairperson.
3. Secretary
4. Treasurer
5. Village agent / Information / Mobiliser.
6. Defense
7. Adviser

ARTICLE 12: GROUP LEADERSHIP.


The Association Management Committee shall form the executive of the group
leadership and shall be composed of 5 people who will be nominated and
seconded by members. These will include;
1) The Chairperson who shall:

(a) Organise meetings with the help of the Secretary.
(b) Be the group spokesperson.
(c) Prepare the agenda of the meetings of the group in consultation with the
Secretary.
(d) Ensure that all decisions made by the group are properly implemented.
(e) Be a principal signatory to any group bank account.
(f) Give report of all the activities of the group.
(g) Ensure maximum privacy of the group.

2) Vice Chairperson who shall assist and deputize the Chairperson.


3) The Secretary who shall:
(a) In consultation with the Chairperson, convene all the group meetings by
sending invitation to all members in an agreed manner.
(b) Keep updated records of the group affairs including minutes of meetings and
membership records?
(c) Promptly send notice for group meetings or other matters concerning the
group.
(d) Record decision of group meetings.
(e) Be a principal signatory to any group bank account.

4) Treasurer who shall:


(a) Receive and disburse funds under the direction of the group.
(b) Ensure that all financial transactions of the group are recorded and kept for
audit purposes.
(c) Keep proper records of all financial matters of the group.
(d) Draw up financial accountability statements.
(e) Perform any other duty of a financial nature on behalf of the group.
(f) Be a principal signatory to any group bank account.

ARTICLE 13: ELECTION AND TENURE OF THE EXECUTIVE COMMITTEE.


1) The executive shall be elected from amongst the members and by the
members of the group for a term of three (03) years.
2) The election of the executive committee shall be by secret ballot.
3) The terms of office for which the executive committee is elected shall expire
at the end of the third year.
4) Any executive committee member of the group shall be nominated and
seconded by any other member in a meeting.

5) Any nominated and seconded member to serve on the executive committee
shall receive not less than two thirds votes of all the members of the group
present at the meeting.
6) Any member of the executive may resign his/her office by writing under
his/her hand giving reasons for the resignation. He/she shall stay in his/her
office until the group elects his/her successor.
7) A person who has vacated his/her office shall be eligible for any other office
provided his/her vacation of the previous office had not been due to gross
misconduct.
8) Any executive member may be removed from office for inability to perform
the functions of his/her office arising from infirmity of body or mind or for
misbehaviour and shall be removed for misbehaviour by half of the members
present in a meeting.

ARTICLE 14: MEETINGS.


1) There shall be monthly meeting of the group. The Chairperson may convene
a general meeting anytime to discuss a specific subject as may be necessary
for the proper functioning of the group business.
2) Decisions of the entire group or of its committees shall be by a simple
majority of the votes of members present at the time of voting.
3) The Chairperson shall have a second casting vote in case of a tie at any
meeting of the group.
4) All meeting of the group shall not be used as a platform for discussion of
personal business of any member of the group, and to further ones political
or religious ideology.

ARTICLE 15: DISPUTE RESOLUTION.


1) All disputes shall be resolved immediately by the group through internal
meetings.
2) In case this fails the matter can be referred to a reputable member in the
community including the recommenders and local council leaders.
3) Should this fail, the matter may be taken to the Community Development
Officer at the Sub-County.
4) The District authority shall be the last level of appeal for arbitration.

ARTICLE 16: DELEGATION


 All members of the Executives shall delegate offices and duty where and when
necessity dictates e.g. in case of sickness, absence or away on association
business.
 Delegation shall be in the declining order of the association chart.
 Only the general secretary shall delegate to committee members.

ARTICLE 17GENERAL GROUP RULES AND FINES
 This group shall hold meetings every 30th every month at 04:00 pm.
 A member shall pay subscription fee of 5,000/= in every sitting.
 A member who fails to attend without a genuine reason shall be fined 1,000/=
 A member who comes late in the meeting beyond 03:00 pm shall be fined 500/=
 A member who leave the meeting without the consent of the chairperson shall be
fined 500/=
 A member who fails to attend for three consecutive times shall be fined Shs.5000
 A member who gossip about the group or spreading wrong information shall be
fined Shs.20,000
 Receiving calls within a meeting fine 500/=
 A member who will leave the group willingly shall not be refunded.
 A member who decides to leave the group with debts shall be forced to pay by all
means.

Note: All the above fines should be paid in cash.

ARTICLE 18: AMENDMENT OF THE CONSITUTION


The constitution shall be amended by use of this particular constitution and in the same

Declaration
We the members whose names and signatures/ thumbprints appear below do hereby
adopt, enact and give to ourselves this constitution of Kicwamba B farmers group on this
30th day of September 2020.
