JUDICIAL AFFIDAVIT

I, Daniello E. Padillo, of legal age, Filipino, single with address at Purok-2 Pag-
antayan, Cantilan, Surigao Del Sur, after having been duly sworn in accordance with the
law, hereby depose and state, by way of answers to the questions propounded by Atty.
Ryan Dave L. Garcia on November 29, 2023 on Chief Garcia Hall of Justice, Capitol
Compound Road, Tandag City, Tandag.
I further state that in answering the questions asked of me, I am fully conscious
and do so under oath, and that I may face criminal liability for False Testimony of
Perjury.

Gipahayag ko usab nga sa pagtubag sa mga pangutana nga gipangutana
kanako, hingpit ako nga adunay salabutan ug gibuhat kini sa panumpa, ug nga ako
mag-atubang sa kapangakohan sa krimen alang sa False Testimony o Perjury.)

Purpose

i. To offer the testimony of private complainant as regard the events that

transpired on August 16, 2023 at Crossing Road St. Brgy. Pag-antayan,
Cantilan, Surigao Del Sur when accused, while driving “Bao-Bao” motor

 vehicle, hit private complainant, resulting to hospitalization and the filing of the
criminal complaint herein.

nagreklamo, nga miresulta sa pagka-ospital ug pagsang-at sa kini nga
criminal nga reklamo.)

Q1: Mr. Private Complainant, can you please tell me your name, civil status, age,
residence, and work?

A1: I am Daniello E. Padillo, single, twenty eight (28) years old, with address at Purok-2
Pag-antayan, Cantilan, Surigao Del Sur. I currently work as a security guard at North
Eastern Mindanao State University (NEMSU) – Cantilan Campus.

A2: Yes. I am here to offer my testimony as regard the events that transpired on August
16, 2023 at Crossing Road St. Brgy. Pag-antayan, Cantilan, Surigao Del Sur when
accused, while driving “Bao-Bao” motor vehicle hit me, resulting to my hospitalization
and inability to continue my work as a security guard.

A4: As stated in the Complaint, it is a Criminal Case for Reckless Imprudence resulting
in Serious Physical Injuries.

Q5: Where were you at the time the crime happened?
(Q5: Asa ka man sa oras nga nahitabo ang krimen?)
A5: I was at Crossing Road Street at the front of “7/11” store.

Q6: At what date and time did the crime happen?

(Q6: Unsang petsa ug oras nahitabo ang krimen?)
A6: At around 4:00 PM to 4:30 PM on August 16, 2023.

Q7: Why were you at the 7/11 store at around 4:00 PM to 4:30 PM on August 16,
2023?
(Q7: Ngano nga ania ka sa tindahan 7/11 mga alas 4:00 sa hapon to 4:30 PM sa
Agosto 16, 2023?)
A7: I was there to purchase my afternoon snacks. I bought a “Mismo Sprite” softdrinks
and “Piattos” corn chips.
(A7: Didto ako aron makapalit sa akong snacks sa hapon. Nakapalit ko ug
softdrink nga “mismo sprite” ug “piattos” nga chichirya.)

Q8: Can you describe the chain of events that transpired before, during, and after
the incident?
(Q8: Mahimo ba nimo mahulagway ang kutay sa mga panghitabo nga nahitabo
kaniadto, sa panahon, ug pagkahuman sa aksidente?)

A8: As I was leaving the 7/11 store, I looked on the right and left side of the road to
make sure that no motor vehicle was passing by. When I was sure that I can safely
crossthe road on the pedestrian lane in front of the bakeshop, I made my attempt to
cross. Unfortunately, a “Bao-Bao” red three wheeled vehicle car driven by the accused
was speeding at the crossing near 7/11 store caught and hit me, the resulting force
thereof caused my body to be flown into the other side of the road eight (8) meters away
from my original position.

nakasiguro ako nga makaluwas ako sa kalsada sa pedestrian lane sa atubang
sa bakeshop, gisulayan nako pagtabok. Sa kasubo, usa ka “Bao-Bao” pula nga
tulo’g ligid nga sakyanan nga gimaneho sa akusado ang nagdagan sa pagtabok
duol sa tindahan nga 7/11 nga nadakup ug naigu ako, ang sangputan nga
pwersa niini hinungdan nga ang akong lawas gipalupad sa pikas dapit sa
kalsada mga otso (8) metros ang kalayo gikan sa akong orihinal nga posisyun.

Q9: What happened after?
(Q9: Unsa ang nahitabo pagkahuman?)

A9: Accused Recardo O. Talisay then disembarked from his vehicle, seemingly angry
and confused. He first check the damage on his vehicle before asking my condition.
(A9: Ang akusado nga si Recardo O. Talisay dayun nanaog gikan sa iyang
sakyanan, ingon masuko ug naglibog. Gisusi una niya ang kadaot sa iyang
sakyanan sa wala pa mangutana bahin sa akong kahimtang.)

Q10: What did Accused Recardo O. Talisay do after that?

(Q10: Unsa man ang gihimo sa Akusado nga si Recardo O. Talisay
pagkahuman?)

A10: He just went to sit beside driver’s door of his vehicle. I was still there on the road,
but I could hear him sobbing. Fortunately, some bystanders took the initiative to call the
police. After that, the police arrived around five (5) minutes and they then called the
ambulance to bring me to the hospital. The police also took photos and asked some
witnesses as to what happened in the crime scene. Some police officers were talking to
me to keep me conscious, while others were talking to the Accused Recardo O. Talisay.
After five (5) minutes, an ambulance arrived, and I was brought to the Madrid District
Hospital.

pa ako sa kalsada, apan nadungog ko ang paghilak niya. Maayo nalang, ang pila
ka nanindugan nanguna sa pagtawag sa pulisya. Pagkahuman niadto, nakaabot
ang pulisya mga lima (5) ka minuto ug dayun gitawagan nila ang ambulansya
aron dad-on ako sa ospital. Nagkuha usab sa litrato ang pulisya ug gipangutana
ang pipila ka mga testigo kung unsa ang nahitabo sa lugar sa krimen. Ang pipila
sa opisyal sa pulisya nakigsulti kanako aron ako maulian samtang ang uban
nakigsulti sa Akusado nga si Recardo O. Talisay. Pagkahuman sa lima (5) ka
minuto, miabut ang usa ka ambulansya, ug gidala ako sa Madrid District
Hospital.)

Q11: What happened at the Hospital?

(Q11: Unsa ang nahitabo sa Hospital?)

A11: At the Hospital, I was examined in the emergency room by Dr. Ivana N.
Matanglawin. According to the medical certificate, I suffered multiple bone fractures in
my body and severe concussion on my head. The same medical certificate advised that
I should be confined at the hospital for at least ninety (90) days.

Pinauyon sa sertipiko sa medisina, nag-antus ako sa daghang mga bali sa
bukog sa akong lawas ug grabi nga pagkalati sa akong ulo. Ang parehas nga
sertipiko sa medical nagtambag nga kinahanglan ako makulong sa hospital
bisan dili mubu’g siyam (90) ka adlaw.)

Q12: How long were you confined in the Hospital?

(Q12: Unsa ka kadugay nga nabilanggo ka sa Ospital?)

A12: I was confined at the Hospital about ninety two (92) days and incurred medical
expenses of at least one million (P1, 000,000) pesos.

Q13: When were you discharged from the Hospital?

A13: I was discharged from the hospital last November 18, 2023.
(A13: Nakagawas ako sa hospital kaniadtong Nobyembre 18, 2023.)

Q14: At this period, were you able to work as a security guard?

(Q14: Niini nga panahon, nakapagtrabaho ka pa ba sa pagka security guard?)

A14: At this point sir, I am still struggling to stand on my own due to the bone fracture
that damaged my thigh bone. Because of this, I can’t fully do my job due to my current
condition.
(A14: Sa pagka karon sir, naglisud gihapon ko ug tindog nga ako lang, tungud sa
akong bali nga bukug nga nadugmuk dapit sa akong paa. Tungod niini, dili na ko
makatrabaho pag ayo tungod sa akong kahimtang karon.)

Q15: Do you have any additional Evidences to support your claims?

(Q15: Naa ba kay ikadugang nga mga ebidensya para maka suporta sa imong
ge reklamo?)

A15: Yes sir. Aside from medical certificates, I have a CCTV footage of the incident that
transpired.
(A15: Oo sir. Gawas sa mga medikal nga sertipiko, naa pud koy CCTV nga kuha
gikan sa insidente nga nahitabo.)

Q16: So now, what do you want to happen?

A16: I just want to file the complaint so that the accused will pay the damages I got due
to his negligence in driving?
