Dear Sirs,

Sub. : Flat No. _______ on ______ floor in the building named as ____________ of our
society, situated at ____________________________________________.

1. This is to confirm that our above named society registered under No.
________ dated _________. The deed conveying/transferring the land and the
said building to our society is not yet executed which will be done in
due course.

2. Mr. / Mrs. ______________________________________________ has been allotted


and possessing the above said flat and is an existing member of our
society and Share Certificate No. _______ for shares bearing distinctive
Nos. ______ to _____ stand in his/her name.
OR
The Share Certificate has not yet been issued by the Society to the said
existing member, as and when it will be issued, we will send the original
Share Certificate to you.

3. The existing member has informed to the society that he/she has agreed
to sell and transfer all his/her right, title interest in the said Shares and
the said flat to Mr./Mrs. __________________________________________ (proposed
member).
4. We confirm that our Society has agreed to transfer the above flat to /in
the name of the proposed member (transferee), subject to completion of
the transfer formalities in respect of the said flat and the shares. And in
respect of the endorsement of the name of proposed member in the Share
Certificate, we will give you advance intimation about next general
meeting, (if required).
5. We hereby assure you that the said flat, as well as the said building and
the land appurtenant thereto are not subject to any encumbrance, charge
or liability of any kind whatsoever and that the entire property is free and
marketable.
6. We further confirm that we have a clear, legal and marketable title to the
said property and every part thereof, and that all taxes and dues in
respect thereof have been paid upto the date.
7. We confirm that there are no restrictive/negative covenants in the Bye
laws / Rules of the above mentioned society concerning the transfer of
shares / members interest in the society and other related matters.
8. We hereby confirm and agree that we have no objection to the member
creating security in your favour by way of mortgage of the right, title,
interest of the member’s right in the said flat. We hereby agree to note
your mortgage over the said flat, in our books.
9. We also confirm that there are no outstanding dues/charges payables by
the said member in respect of the said flat and he/she has paid all the
taxes and dues in respect of the said flat upto date.
10. We will not record satisfaction of your mortgage or creation of any
new mortgage, charge or other encumbrance on the said flat without your
prior written permission.
11. Subject to our byelaws, the said shares and the rights arising to
the said member to use and occupy the said flat may be transferred by
you to any person, on your enforcing your security.
12. We assure you and undertake that we will not issue any duplicate
share certificate without your written permission.
