Adjustment in the classification of Iron Ore for Export. Dynamic Pricing Policy - Congestion charge

In supersession of RC 14, 15 and 20 of 2008, Sanction of the Central Government is hereby accorded to the following i) ii) iii) To abolish congestion charges levied on Iron Ore traffic booked to the Sidings and Goods sheds serving ports. Continuance of Congestion charge @ 20% on all traffic booked to Pakistan and Bangladesh up to 31.3.2009. To revise the classification of Iron Ores for other than domestic consumption under the Main Commodity Head Mineral and Ores from Class-180 to a new class called Class-200X for both trainload and wagonload movement.

Freight rates per tonne under Class-200X are given in the Annexure.

3. Instructions issued vide Railway Board letter No. TCR/1078/2005/5 dated 17.5.2006 stand cancelled. Zonal Railways need not notify the list of terminals as serving ports. 4. The classification of Iron Ore destined for domestic consumption is Class-170.

Accordingly following footnote should be inserted below the Commodity Head Mineral and Ores at S.No.13 of the IRCA Goods Tariff No.45 Pt.I (Vol.II). ** Iron Ore Domestic will be charged at Class-170 and Iron Ore for other than domestic consumption will be charged at Class-200X.

Following conditions must be complied with while booking and granting delivery of Iron Ore traffic for domestic consumption: (i) For Iron Ore booked to private sidings (including Assisted sidings) of Steel manufacturing units: In order to avail the tariff rates for Iron Ore domestic traffic, all Iron and steel manufacturing units (including integrated steel plants and mini steel plants etc) having their own private sidings for handling inward iron ore will be required to make a one time submission of the following documents. (a) Certified copies of (i) Industrial Entrepreneur Memorandum (IEM); (ii) the Factory License; (iii) Certificate of registration under Contract Labor Act; (iv) Consent For Establishment (CFE); (v) Consent For Operation (CFO) from Pollution Control Board; (vi) Central Excise registration certificate; and (vii) monthly excise return. (b) An affidavit on non-judicial stamp paper of Rs.100/- in the format given below certifying that only iron ore for domestic consumption will be received in their siding. It is certified under oath that all consignments of iron ore received at ----siding is meant for domestic consumption at the manufacturing unit -----located at ------ with Factory registration no -------- and Cenvat no ------. It is also certified that the iron ore received at --------will not be exported out of India under any circumstances. However, if at any stage, Iron Ore received at this siding is intended to be used wholly or partially for export purposes, the company undertakes to advise the concerned CCM and DRM well in time before receipt of such consignment in their siding. (c) On receipt of an advice that Iron ore booked to such sidings are to be used wholly or partially for export, provisions of sub-para 5 (ii) will apply for each rake booked thereafter. (d) The consignee must also furnish a stamped indemnity note to indemnify the railway against mis-declaration or any other misuse of the provision given above.

(ii)

For Iron Ore traffic booked to other than private sidings


(a) At the time of registration of each indent, consignor will make an endorsement in the forwarding note declaring that the consignment is meant for domestic consumption with in India (b) At the time of registration of each indent, consignor will furnish copies of Industrial Entrepreneur Memorandum (IEM); the Factory License; Certificate of registration under Contract Labor Act; Consent For Establishment (CFE); Consent For Operation (CFO) from Pollution Control Board; Central Excise registration certificate; and monthly excise return.

(including Assisted sidings) of Steel manufacturing units:

(c) Conditions as mentioned above at 5 (ii) a & b shall also be fulfilled by consignors whose indents have already been registered, before loading of rakes. (d) After loading of the consignment and before issue of the Railway Receipt, consignors will give an affidavit on non-judicial stamp paper of Rs.100/-which should inter alia include the following averment. It is certified under oath that the consignments of iron ore registered under Indent No ---- dated ------ , invoice no ---- and RR no ------ at ------ Goods shed/siding and loaded on date ---- in wagon nos -------- is meant for domestic consumption at the manufacturing unit -----located at ------ with Factory registration no -------- and Cenvat no -----. It is also certified that this consignment is not meant for export out of India and this consignment will not be exported out of India under any circumstances.

(e) After arrival of the consignment at the destination terminal, consignee will be given delivery of the consignment only after he furnishes an affidavit on non-judicial stamp paper (for each rake) which should inter alia include the following averments.
It is certified under oath that the consignments of iron ore received on date ---- with RR no ---- in wagon nos -------- at ----- Goods shed/siding is meant for domestic consumption at the manufacturing unit ------ located at ------ with Factory registration no ------- and Cenvat no ------ It is also certified that this consignment is not meant for export out of India and this consignment will not be exported out of India under any circum stances. (f)The consignee must also furnish a stamped indemnity note to indemnify the railway against mis-declaration or any other misuse of the provision given above. 6 If at any stage, it is detected that the endorsement of Forwarding Note and/or the affidavit furnished under the provisions of Para 5 was false, inaccurate or misleading, penalty for mis-declaration shall be imposed as per extant instructions. In addition, such consignors and consignees will be blacklisted for a period of three years for transport of iron ore from any terminal of IR. Railway may also take recourse to further legal action in such cases. 7 Only such Iron Ore traffic as fulfills the conditions for treating it as domestic in terms of the provisions of Para 5 above will be entitled to rates for domestic traffic i.e. Class-170. All other traffic of Iron Ore will be charged at Class-200X. 8. This issues with the concurrence of the Finance Directorate of the Ministry of Railways. 9. These instructions will come into force with effect from 22.05.2008.

10. Issue necessary instructions to all concerned and acknowledge receipt of this letter.
