CONTRACT TO SELL

KNOW ALL MEN BY THESE PRESENTS:

This Contract to Sell made and entered into at ________________,


this _____________________, by and between:

IRENE A. TAYLAN married to FLAVIAN F. TAYLAN, both of legal age,


with residence at Brgy. Tolega Sur, Moncada, Tarlac City, hereinafter
referred to as the VENDORS;

- and -

JAMIE MARIZ HABER LABUGUEN married to PAUL MIKKI DELA


CRUZ SAKURAI, both of legal age, Filipino Citizens, with residence and
postal address at Lot 3 Block 13 Upper Lotus St., Modesta village, Brgy.
Sto. Nino, San Mateo, Rizal, herein referred to as VENDEES;

WITNESSETH:

That the VENDORS are the owners of a parcel of land with TCT No.
009-2011002605 with an area of Two Hundred Ninety-Four square meters
(294) Square Meters located at San Mateo, Rizal, more particularly
described as follows:

TRANSFER CERTIFICATE OF TITLE NO. 009-2011002605

A Parcel of land (Lot 3, Blk. 13 of the subd.


Plan (LRC) Psd-142686 (SHT. 1), being a portion of
the parcel of land described on plan PSU-41852,
LRC, Rec. No. 46332), situated in the Bo. Of Nanca,
Mun. of San Mateo, Pro. Of Rizal, Island of Luzaon.
Bounded on the NE., Points 1 to 2 By Lot 4; on the
SE., Points 2 to 3 By Lot 5; on the SW., points 3 to 4
By Lot 2, all of Blk. 13; and on the NW., Points 4 to 1
By Road Lot 3, all of the Subd. Plan. Beginning at
point Marked “1” on plan, being S. 29 deg. 24’E.,
3657.25 M. from BLLM 1, Mun. of San Mateo, Rizal;
Thence S. 66 deg. 08’E., 20.00 m. to point 2; thence S.
23 deg. 52’W., 14.38 m. to point 3; thence N. 67 deg.
54’W.; 20.01 m. to point 4; thence N. 23 deg. 52’E.,
15.00 m. to point of beginning, containing an area of
Two Hundred Ninety-Four (294) Square Meters
more or less. All points referred to are indicated on
the plan and are marked on the ground By Ps Cyl.
Conc. Mons. 15x60 Cms., Bearings True; Decl. 0 deg.
48’E., Date of the Orig. Survey was executed by
Engr., Isabela U. Munoz, on June 1-10, 1971.
NOW THEREFORE, for and in consideration of the foregoing, the
VENDORS and the VENDEE hereby agree subject to the following
conditions:

1. That the VENDORS will sell the property to the VENDEES for
the amount of Five Million Pesos (Php 5,000,000.00) with respect
to the 294 square meters;

2. That the VENDEES to pay One Hundred Fifty Thousand Pesos


(P150,000.00) by way of a Manager’s Check or personal check
under the name of Novy M. Amado;

3. The VENDEE shall pay the VENDORS the balance of One


Million Three Hundred Fifty-Four Thousand Pesos (Php
1,354,000.00) which represents the remaining balance to the entire
consideration amounting One Million Six Hundred Thousand
Pesos (Php 1,600,000.00) less the earnest money of One Hundred
Fifty Thousand Pesos (Php 150,000.00) and Capital Gains Tax of
6% amounting to Ninety Six Thousand Pesos (Php 96,000.00)
which shall be withheld by the Vendee, on the second week of
September 2023;

4. Upon payment of the full amount by the VENDEES, the


VENDORS shall issue and execute a Deed of Absolute Sale;

5. That the Capital Gains Tax of 6% amounting to Ninety Six


Thousand Pesos (Php 96,000.00) shall be for the account of the
VENDORS which shall be withheld by the Vendee;

6. That Documentary Stamp Tax, Transfer Tax and other


miscellaneous expenses shall be for the account of the Vendee;
