LETTER OF REQUEST FOR DELISTING IN BIR RDO 107’S TOP WITHHOLDING AGENTS

MADAM:

We recently discovered through BIR’s website that we’ve been included in the RDO 107’s
list of top withholding agents published last June 22, 2022. Our organization, Nonviolent
Peaceforce, have not received any notice in tangible form on our business address. The
management advised to convey our intent to be delisted in the TWAs with the reasons discussed
below.

As stated in Revenue Regulation No. 7-2019:

Top withholding agents shall refer to those taxpayers whose gross sales/receipts
or gross purchases or claimed deductible itemized expenses, as the case may be,
amounted to TWELVE MILLION PESOS (P12,000,000.00) during the preceding taxable
year.

Though the above stated RR may be evident with our remittances in the last taxable year,
we would like to further note in reference to Revenue Memorandum Circular No. 143-2019
stating:

It should be observed in the aforesaid revenue regulations that the obligation to

withhold and remit these CWTs to this Bureau is mandated only to those taxpavers whose
business operations have a significant level of economic impact contributory to the collection of
revenues.

NONVIOLENT PEACEFORCE (NP) (TIN 006-365-287-000), is a nonpartisan, non-

governmental international organization with legal entities in: the US, Belgium, France, and
Switzerland; and Philippines is one of its many country offices. NP is a non-profit entity and we
solely rely our funding sources from grants, funding from foreign governments and organizations
and private donations. NP is still in the process of developing a strong fundraising plan,
continuously building relationships with potential donors, and managing global finances effectively

to ensure our long-term sustainability and to continue to deliver its services to those in need,
unfortunately, all resource mobilizations being conducted are subject to lengthy evaluation
process and there is no guarantee or secured funding from the donors as restrictions too may be
established.

We understand the prestige of being listed as one of our RDO’s top withholding agents
and that it entails more accountability, but like mentioned above, there is no assurance on the
organization’s indefinite existence given the nature of our business; hence our request for
delisting.

We hope that you will merit our request with your prompt and favourable action.
