1. RE-ACQUIRE PHILIPPINE CITIZENSHIP, WHO WANTED TO ENGAGE IN THE PRACTICE OF


ARCHITECTURE, BE REQUIRED TO TAKE ANOTHER LICENSURE EXAMINATION TO BE GIVEN BY
THE PRC AND THE PRBOA?

IF A PERSON HAS RE-ACQUIRED PHILIPPINE CITIZENSHIP AND HAS TAKEN THE


ARCHITECTURE LICENSURE EXAMINATION, HE OR SHE SHALL NOT TAKE ANOTHER
LICENSURE EXAMINATION; ACCORDING TO THE ARTICLE III, SECTION 23, WHICH STATES
THAT THE SITUATION IS NOT PART OF OR RELATED TO ANY OF THE LISTED GROUNDS
FOR THE SUSPENSION OR REVOCATION OF CERTIFICATES OF REGISTRATION. IF THE
LICENSED IS FORMED ON OTHER COUNTRY THE LICENSED THAT HE/SHE HAVE WILL
ONLY APPLICABLE ON THAT SPECIFIC COUNTRY.

2. WHY DOES THE PRC AND THE PRBOA NEED TO SUPERVISE THE PRACTICE OF THE FOREIGN
NATIONAL IN THE PHILIPPINES AFTER SECURING A SPECIAL TEMPORARY PERMIT AS WELL AS
THE PRIVATE OR FOREIGN ENTITY WHO SECURE SERVICES OF THE SAME?

ACCORDING TO THE ARTICLE IV OF SECTION 38, FOREIGN NATIONALS WHO HAVE


GAINED ENTRY TO THE PHILIPPINES TO PERFORM PROFESSIONAL SERVICES AS
ARCHITECTS OR CONSULTANTS IN GOVERNMENT PROJECTS THAT ARE FOREIGN-
FUNDED OR ASSISTED, OR WHO ARE EMPLOYED OR ENGAGED BY FILIPINO OR FOREIGN
CONTRACTORS OR PRIVATE FIRMS, MUST FIRST OBTAIN A SPECIAL/TEMPORARY PERMIT
FROM THE BOARD, WHICH MUST BE APPROVED BY THE COMMISSION, BEFORE
BEGINNING THEIR DUTIES, FUNCTIONS, AND RESPONSIBILITIES AS ARCHITECTS OR
CONSULTANTS. IN ORDER TO PRACTICE ARCHITECTURE, THERE ARE FOLLOWING
CONDITIONS THAT MUST FULFILLED, ONE OF WHICH IS THAT FOREIGN NATIONALS
MUST WORK WITH A FILIPINO COUNTERPART AND MUST PAY PUBLIC UTILITIES AND
TAXES TO THE PHILIPPINE GOVERNMENT IN CONNECTION WITH THEIR PARTICIPATION
IN, OR PROFESSIONAL SERVICES RENDERED TO, THE PROJECT, IN ACCORDANCE WITH
THE ESTABLISHED IMPLEMENTING RULES AND REGULATIONS SETTING FORTH THE
PROCEDURE FOR THE REGISTRATION AND/OR ISSUANCE OF TEMPORARY/SPECIAL
PERMITS TO FOREIGN ARCHITECTS PERMITTED BY LAW TO PRACTICE THEIR
PROFESSION. THE BOARD SHALL IMPLEMENT THE IMPLEMENTING RULES AND
REGULATIONS FOR SUCH A REQUIREMENT FOR PRACTICE. THE PRBOA ALSO GOVERNS
THE PRACTICE OF FOREIGN ARCHITECTS (FA), WHO ARE DEFINED AS NATURAL (RATHER
THAN JURIDICAL) PERSONS WHO WISH TO ENGAGE IN THE PROFESSIONAL PRACTICE OF
ARCHITECTURE FOR ANY BUILDING PROJECT ON PHILIPPINE SOIL FOR A LIMITED TIME,
AS WELL AS ARCHITECTURAL FIRMS (SOLE/SINGLE PROPRIETORSHIPS, PARTNERSHIPS,
CORPORATIONS, ASSOCIATIONS, AND JOINT VENTURES BY FILIPNO ARCHITECTS). ONLY
INDIVIDUAL FOREIGN ARCHITECTS/FAS (NOT FOREIGN ARCHITECTURAL FIRMS/FAFS)
ARE PERMITTED TO PRACTICE ARCHITECTURE IN THE PHILIPPINES WITH EQUIVALENT
FILIPINO ARCHITECTS, AND ONLY IF A SPECIAL/TEMPORARY PERMIT (STP) IS OBTAINED
IN ACCORDANCE WITH R.A. NO. 9266.

3. IS THERE A MANDATORY CPD REQUIRED UNDER THE LAW R.A. 9266?

ACCORDING TO THE ARTICLE IV PRACTICE OF ARCHITECTURE ON SECTION 28,


CONTINUING PROFESSIONAL DEVELOPMENT PROMOTES PUBLIC INTEREST AND
PROTECT LIFE, HEALTH, AND PROPERTY, THEREFORE ALL PRACTICING ARCHITECTS
MUST MAINTAIN A CONTINUING PROFESSIONAL DEVELOPMENT PROGRAM AND MUST
BE RESPONSIBLE FOR THE ADVANCEMENT OF A CONTINUING PROFESSIONAL
DEVELOPMENT PROGRAM. IT IS STATED IN SECTION 28 THAT THE BOARD MAY
ACCREDIT OTHER ENTITIES OR GROUPS TO BECOME CPD PROVIDERS. HOWEVER,
ACCORDING TO THE ARTICLE II OF SECTION 7, IN CONJUNCTION WITH THE INTEGRATED
AND ACCREDITED PROFESSIONAL ORGANIZATIONS OF ARCHITECTS, THERE ARE
ESTABLISHED GUIDELINES FOR THE CONTINUING PROFESSIONAL DEVELOPMENT (CPD)
PROGRAM: PROVIDED, HOWEVER, THAT ATTENDANCE AT SAID CPD IS NOT AN
OBLIGATORY CONDITION FOR PROFESSIONAL LICENSE RENEWAL.

5. WHAT IS THE IMPORTANCE OF THE ARCHITECT’S RESPONSIBILITIES IN RELATIONS TO THE


CLIENT?

ACCORDING TO THE ARTICLE III OF THE CODE OF ETHICAL CONDUCT FOR REGISTERED
AND LICENSED ARCHITECTS, THE RESPONSIBILITY OF THE ARCHITECT TO HIS/HER CLIENT
SERVES AN IMPORTANT ROLE IN ENSURING THE CONTINUOUS EXISTENCE OF POSITIVE
RELATIONSHIP. IT IS SIGNIFICANT FOR THE ARCHITECT TO CONSTANTLY STRIVE TO
PRESERVE THE CLIENT'S INTERESTS, BUT NEVER AT THE OUTFLOW OF GREATER PUBLIC
INTEREST AND WELFARE. IT IS IMPORTANT IN ORDER FOR THE CLIENT TO BE INFORMED
REGARDING ON THE BUSINESS RELATIONSHIP, FINANCIAL CONDITIONS, CHARACTER
ESTIMATES, PROJECT CONSTRUCTION ETC. IT IS ALSO IMPORTANT FOR IT SERVES AS A
CLARIFICATION ON THE PROJECT AGREEMENT OF THE ARCHITECT AND CLIENT
REGARDING THE BUSINESS. THIS WILL SERVE AS A BASIS, IN ORDER FOR THE CLIENT
AND ARCHITECT TO HAVE A CLEAR AND PROFESSIONAL RELATIONSHIP THAT IS
DEPENDENT UPON GOOD FAITH.

PART 2: 1) HOW WILL YOU BE ABLE TO EXPLAIN THE IMPORTANCE OF NEW PROVISIONS FROM
HOUSE BILL NO.: 10234? (10 POINTS)

ARCHITECTURE IS A COMPETITIVE PROFESSION; THE PHILIPPINES IS NOT THAT LATE ON


THE ADVANCEMENT OF ARCHITECTURE BUT IT IS BETTER TO KEEP UP AND IMPROVE
WHAT IT ALREADY HAS, AT THE SAME TIME THE LEVEL OF EXPERIENCE OF
ARCHITECTURE ON INTERNATIONAL SCENE MUST ALSO BE APPLIED ON THE LOCAL OR
PHILIPPINE ARCHITECTURE, THIS IS THE PURPOSE OF THE HOUSEBILL 10234. THIS BILL IS
FILED TO ELEVATE THE REGULATION AND PRACTICE OF ARCHITECTURE IN THE
PHILIPPINES, IT REPEALS THE RA 9266, AND APPROPRIATING FUNDS THEREFORE AND
OTHER PURPOSES. ARCHITECTURAL SERVICES ARE GOVERNED BY A NUMBER OF
INTERNATIONAL ACCORDS, INCLUDING THOSE THAT GOVERN STATE-REGULATED
PROFESSIONS. MULTILATERAL ACCORDS ON VARIOUS INTERNATIONAL ORGANIZATIONS
ARE AMONG THEM. THE OBJECTIVES OF THIS BILL IS TO STIMULATE ECONOMIC
ACTIVITY, PROMOTE TRADE, EXPAND EXPORTS, AND IMPROVE CITIZENS PURCHASING
POWER THROUGH NONDISCRIMINATORY ACCESS TO MARKETS AND PROGRESSIVE
LIBERALIZATION. HOWEVER, POLICIES FROM DECADES PAST, INCLUDING THE SUBJECT
OF THIS REPEAL REENACTMENT RA 9266, ARE IN DIRECT CONFLICT AND NOT
COMPLIANT WITH THE TREATIES, THIS BILL AIMS TO ADDRESS THE ARCHITECTURE
PROFESSION'S DECREASING COMPETITIVE SPIRIT, AS WELL AS THE ILLS OF
ARCHITECTURAL PRACTICE AND REGULATORY MANAGEMENTS THAT HAVE DEVELOPED
IN THE LAST TEN TO FIFTEEN YEARS. THE LACK OF ACCOUNTABILITY AND
TRANSPARENCY IN REGULATION, POWERED BY EACH PROFESSION'S DESIRE TO EXPAND
THEIR NUMBERS, HAS ALSO RESULTED IN A DISADVANTAGEOUS LOWERING OF
STANDARDS, UNDERMINING THE VERY PURPOSE OF REGULATION, WHICH IS TO
PROTECT THE PUBLIC INTEREST AND PUBLIC SERVICE. THIS BILL OPPOSES POLICIES
ENUNCIATED BY THE PHILIPPINE GOVERNMENT'S CRITICAL INFRASTRUCTURE,
PROCUREMENT, AND REGULATORY AGENCIES THAT UNDERMINE THE ARCHITECTURAL
PROFESSION.
