Re: AKNOWLEDGEMENT & IMPLEMENTATION OF AKTA KERJA 1955 (PINDAAN 2022)

Refer to EMPLOYMENT (AMENDMENT OF FIRST SCHEDULE) ORDER 2022, our company have
agreed to follow such below terms: -
1. Working hours per week of 48 hours reduced to 45 hours.
2. Maternity Leave eligibility from 60 days to 98 days. All female employees who give birth regardless of salary scale
and through legal marriage or not, are entitled to 98 days and 98 days Maternity Allowance.
3. Prohibition of Termination of Pregnant Women. Based on the Employment Act Amendment 1955, termination can
only be made based on 3 things, namely:

 Violation of the terms of the Employment Contract


 Misconduct (Must follow the correct procedure like Show Cause Letter Warning Letter, D.I)
 The company closes like a bankrupt.

4. Sick Leave and Hospitalization Leave is a combined 60 days. However, through the Work Act Amendment 1955,
Sick Leave (ordinary MC) was separated from Hospitalization Leave. Eligibility Paid Sick Leave 14/18/22 days +
Hospitalization Leave 60 days.
5. Paternity leave of 7 days. A maximum of 5 births only. (If the male employee has 2/3 wives, the employee is only
eligible for paid Paternity Leave with a maximum of 5 children. The male employee must be legally married and
must work with the same employer for 12 months. This Paternity Leave includes Rest Days and Public Holidays
(PH).
6. Salary calculation for Incomplete Month is based on Calendar of Month. Not 26.
7. Obliging employers to post notices to increase awareness regarding Sexual Harassment. For example, the type of
sexual harassment or the steps to be taken in the event of sexual harassment at work.
8. Certificate of Accommodation is imposed on Expatriates
