disposing state of mind, and I have made the following arrangement in regard to my properties. I hereby revoke all previous WILLs, codicils and all testamentary dispositions if any, herein before made by me in respect of my movable and immovable properties including the schedule property. WHEREAS, I the Testator hereby state that, my parents are no more. I have wife namely Smt Ramma B. Shetty, aged about 71 years and 3 Sons i. e., Sri Sandeep Shetty, aged about 47 years, Sri Sumanth Shetty, aged about 44 years and Sri Hemanth Shetty, aged about 41 years. All my sons are married and they are residing with their families. Out of 3 Sons, 2 Sons i. e. Sri Sumanth Shetty, aged about 44 years and Sri Hemanth Shetty, aged about 41 years are well settled and living with their families. My sons Sri Sumanth Shetty, aged about 44 years and Sri Hemanth Shetty, aged about 41 years are looking after me and taking care of all my needs, till date. Further my 2 Sons i. e. Sri Sumanth Shetty, aged about 44 years and Sri Hemanth Shetty, aged about 44 years and their families are economically sound and they are not dependent on anybody. WHEREAS, I own and possess immovable property i. e. the residential apartment bearing unit No. 219, 2 BHK flat on Second Floor in the multistoried building known as “MUKUND APARTMENTS”, with total built up area of 850.92 Square feet along with 0.952% of undivided right, share, title and interest in the residential premises old No. 1. New No. 22 and 22/1 totally measuring 33,279.63 Square feet situated at Palmgrove Road, old Municipal division No. 6, Richmond Town Bangalore with one (1) Car parking, having old PID No. 76-111-22/3-19, New PID No. …………. being more fully and particularly described in the schedule hereunder and hereinafter called as the ‘SCHEDULE PROPERTY. WHEREAS I have acquired the Schedule property vide Sale deed dated 24.04.1989 (registered as document No. 345/1989-90 in the office of Sub Registrar, Shivajinagar, Bangalore). From 24.04.1989, i. e., ever since acquiring of the Schedule property, I am in peaceful possession and enjoyment of the schedule property as the absolute owner. WHEREAS, I, the Testator hereby state, that in order to remove the confusion that may arise, in the minds of my family members and the beneficiaries after my death, my Wife Smt Ramma B. Shetty, aged about 71 years, have life interest in the Schedule property. In her life time, she can enjoy the Schedule property as she desired, but she doesn’t have a right to dispose of the Schedule property. After her death, my elder son Sri Sandeep Shetty, aged about 44 years is entitled for is entitled become an owner of the Schedule property. In case my wife pre deceased me, after my death, my elder son Sri Sandeep Shetty, aged about 44 years is entitled for is entitled become a owner of the Schedule property. WHEREAS, I, the Testator hereby state, with love and affection, I bequeath the life interest in respect of the schedule property to my wife Smt Ramma B. Shetty, aged about 71 years and after her death absolute right to my elder son Sri Sandeep Shetty, aged about 47 years in respect of the schedule property. AND WHEREAS, I the Testator hereby state, that while bequeathing the schedule property, I am not influenced by coercion, fraud, or threat by any person. AND by virtue of this WILL, Is bequeathed life interest in respect of the schedule property to my wife Smt Ramma B. Shetty and after her death absolute right to my elder son Sri Sandeep Shetty, aged about ... years in respect of the schedule property out of my own free will. AND WHEREAS my wife Smt Ramma B. Shetty , shall enjoy her life interest and thereafter my elder son Sri Sandeep Shetty, aged about ... years shall make use the schedule property as they deems fit in the circumstances and have the transfer of khatha of the respective portion of the schedule property to his name by producing this WILL to the Competent Authorities. AND WHEREAS, my wife Smt Ramma B. Shetty , shall enjoy her life interest and she doesn’t have a right to dispose of the Schedule property. After my wife’s death my elder son Sri Sandeep Shetty, aged about ... years have got full power to alienate the respective portion of the schedule property after my death. AND WHEREAS, I the Testator further state that except myself nobody else has any right, title and interest in the schedule property hereby bequeathed the life interest in favour of my wife Smt Ramma B. Shetty and after her death to my elder son Sri Sandeep Shetty, aged about ... years. I, the Testator further state that, my other legal representatives have no right, title and interest whatsoever in the schedule property. I, the Testator further state that, this WILL will come into effect only after my death. AND WHEREAS, I the Testator hereby state that, I have paid up to date taxes towards the schedule property.
