JUDICIAL AFFIDAVIT OF JINKY S. VALDEZ

JESUS L. DOMINGO is of legal age, Filipino citizen, a resident

of Pinasling, Gerona, Tarlac and whose testimony is being offered for
the following purposes, to wit: 1) to prove that she is the attorney-in-
fact of the petitioner in this case; 2) to prove that Reynaldo Alfonso is
already the absolute owner of a parcel of land covered and described
under TCT No. T-299513 having bought the same from the registered
owner thereof; 3) to prove that the original copy of TCT No. T-299513
is existing and on file in the Registry of Deeds of Tarlac; 4) to prove
that the owner’s duplicate copy of TCT No. T-299513 was lost; 5) to
prove the circumstances surrounding the loss of the owner’s
duplicate copy of TCT No. T-299513; 6) to prove that he executed an
affidavit in connection with the lost owner’s duplicate copy of TCT
No. T-299513; 7) to prove that the Affidavit of Loss was annotated at
the original copy of TCT No. T-299513 which is existing and on file in

the Registry of Deeds of Tarlac; 8) to prove that the owner’s duplicate
copy of TCT No. T-299513 has not been mortgaged to any person or
entity; 9) to prove that the owner’s duplicate copy of TCT No. T-
299513 has not been given or delivered to any person or entity to
secure the payment of any obligation or undertaking; 10) to prove
that the Real Property Tax on the parcel of land covered and
described under Transfer Certificate of Title No. T-299513 has been
paid up to the current year; 11) to identify certain documents relative
to this petition; and 12) to prove other matters relative to this petition.

Preliminary Statement

The person interrogating me is Atty. Ronilo U. Borja, The

interrogation is being held at his office located at Blk 2, Champaca St.,
San Vicente, Tarlac City.

I am answering his questions fully conscious, that I do so under

oath and may face criminal liability for false testimony and perjury.

Questions and Answers

1. Q: Madam Witness, what is your participation in this case, if any?

A: I am the attorney-in-fact of the petitioner in this case.+

2. Q: In what capacity are you filing the instant Petition, if any?

A: I was duly authorized by Reynaldo A. Alfonso to file the instant
Petition.

3. Q: What proof can you show that you were given authority by
Reynaldo A. Alfonso to file the instant petition?
A: I have here a Special Power of Attorney which he executed in my
favor authorizing me to file the instant petition.

Attorney executed by Reynaldo A. Alfonso. We pray that the same be

2. Q: What petition did you file over the parcel of land embraced
under TCT No. T-299513, which is the title subject of this case, if any?

A: I filed a Petition for the Issuance of Second Owner’s Duplicate
Copy of TCT No. T-299513, which is the title subject of this case, since
the owner’s duplicate copy of the said title was lost.

3. Q: Where is the petition that you filed, if any?

A: I have it here sir.

Atty. Ronilo U. Borja: The witness handed to me a document which

purports to be a Petition for Issuance of Second Owner’s Duplicate
Copy of TCT No. T-299513 Registered in the Name of spouses Belorio
S. Donato and Teresita L. Donato. We pray that the same be marked
as Exhibit “__”.

4. Q: There is a signature above the name Jinky S. Valdez on the

verification and certification against forum shopping of the petition.
Whose signature is that?
A: My signature sir.

5. Q: Who is the registered owner of a parcel of land covered and

described under TCT No. T-299513?
A: Spouses Belorio S. Donato and Teresita L. Donato, sir.

6. Q: What proof can you show that spouses Belorio S. Donato and
Teresita L. Donato are the registered owners of a parcel of land
covered and described under TCT No. T-299513, if any?
A: I have here the Certified True Electronic Copy of TCT No. T-
299513 and its Tax Declaration showing that spouses Belorio S.
Donato and Teresita L. Donato are the registered owners of the parcel
of land covered and described under TCT No. T-299513.

Electronic Copy of TCT No. T-299513 and its Tax Declaration. We

7. Q: If spouses Belorio S. Donato and Teresita L. Donato are the

registered owners of the subject parcel of land, in what capacity then
are you filing the instant petition?

A: I am filing the instant petition being Reynaldo A. Alfonso is the
absolute owner of the subject property.

8. Q: What proof/s can you show, if any, that Reynaldo A. Alfonso is

already the absolute owner of the subject property?
A: I have here a Deed of Absolute Sale in which the spouses Belorio
S. Donato and Teresita L. Donato sold the Subject Property in
Reynaldo A. Alfonso’s favor.

Atty. Ronilo U. Borja: The witness handed to me the Deed of

Absolute Sale in favor of the petitioner. We pray that the same be
marked as Exhibit “__”.

9. Q: Where is the parcel of land covered and described under TCT

No. T-299513 located?
A: It is located at Barangay Carbonel, Gerona, Tarlac.

10. Q: What is the area of the parcel of land covered and described
under TCT No. T-299513?
A: It contains an area of ________________ (_______) square meters,
more or less, sir.

11. Q: Where is the original copy of TCT No. T-299513?

A: The original copy of TCT No. T-299513 is existing and on file in the
Registry of Deeds of Tarlac.

12. Q: What proof can you show that the original copy of TCT No. T-
299513 is existing and on file in the Registry of Deeds of Tarlac, if
any?
A: The existence of the original copy of TCT No. T-299513 in the
Registry of Deeds of Tarlac is evidenced by the fact that a certified
true electronic copy of the said title, which I earlier showed to you,
was obtained at the Registry of Deeds of Tarlac.

13. Q: How about the owner’s duplicate copy of TCT No. T-299513,
where is it?
A: It was lost sir.

14. Q: Could you tell the Honorable Court how the original owner’s
duplicate copy of TCT No. T-299513 was lost?

A: After the sale transaction was consummated, spouses Belorio S.
Donato and Teresita L. Donato turned over to Reynaldo A. Flores the
owner’s duplicate copy of TCT No. T-299513, who, in turn, turned
over the same to me. I then placed the owner’s duplicate copy of TCT
No. T-299513 inside a long brown envelope which was in my
possession while transacting with the concerned government
agencies to secure certain documents being required for the
registration and titling of the subject property. Based on my
recollection, I may have left the said envelope containing the owner’s
duplicate copy of TCT No. T-299513 when I was about to disembark
from the motorcycle. I exerted diligent efforts to locate and recover
the same but to no avail.

15. Q: Since you lost the owner’s duplicate copy of TCT No. T-299513,
what did you do, if any?
A: I went to a Notary Public and executed an Affidavit of Loss.

16. Q: Where is the Affidavit of Loss that you executed?

A: I have it here sir.

Atty. Ronilo U. Borja: The witness handed to me an Affidavit of Loss

executed by Jinky S. Valdez. We pray that the same be marked as
Exhibit “__”.

17. Q: There is a signature above the name Jinky S. Valdez. Whose

signature is that?
A: My signature sir.

Atty. Ronilo U. Borja: We pray that the name and signature of the
witness on the Affidavit of Loss be bracketed and marked as Exhibit
“__-1”.

18. Q: After executing the Affidavit of Loss, what else did you do, if
any?
A: I went to the Registry of Deeds of Tarlac to have the Affidavit of
Loss be annotated at the original copy of TCT No. T-299513 which is
existing and on file in the said Office.

19. Q: What proof can you show that the Affidavit of Loss was
annotated at the original copy of TCT No. T-299513 which is existing
and on file in the Registry of Deeds of Tarlac, if any?

A: The ___ page of the Certified True Electronic Copy of TCT No. T-
299513 shows that the Affidavit of Loss was annotated at the original
copy of TCT No. T-299513 which is existing and on file in the Registry
of Deeds of Tarlac.

Atty. Ronilo U. Borja: The witness again handed to me the Certified

True Electronic Copy of TCT No. T-299513 and pointed out that the
Affidavit of Loss was annotated on the ___ page thereof. The
Certified True Electronic Copy of TCT No. T-299513 was previously
marked as Exhibit “__”. We pray that the annotation of the Affidavit
of Loss on the 3rd page of the Certified True Electronic Copy of TCT
No. T-299513 be bracketed and marked as Exhibit “__-1”.

20. Q: Has the original owner’s duplicate copy of TCT No. T-299513
been mortgaged to any person or entity?
A: No sir.

21. Q: Has the original owner’s duplicate copy of TCT No. T-299513
been given or delivered to any person or entity to secure the payment
of any obligation or undertaking?
A: No sir.

22. Q: What proof can you show that the Real Property Tax on the
parcel of land covered and described under Transfer Certificate of
Title No. T-299513 has been paid up to the current year, if any?
A: I have here Official Receipt issued by the Municipal Treasurer’s
Office of Gerona, Tarlac showing that the Real Property Tax on the
parcel of land covered and described under Transfer Certificate of
Title No. T-299513 has been paid up to the current year.

Atty. Ronilo U. Borja: The witness handed to me an Official Receipt

issued by the Municipality of Gerona, Tarlac. We pray that the same
be marked as Exhibit “__”.

23. Q: What then do you pray unto the Honorable Court to do about
the lost original owner’s duplicate copy of TCT No. T-299513, if any?
A: I am respectfully praying unto the Honorable Court to direct the
Registry of Deeds for the Province of Tarlac to issue second owner’s
duplicate copy of TCT No. T-299513.
