Subject: Legal Opinion on the proposed Contract of Engagement between New Era
University and Ma. Antonette M. Gabua

Dear Bro. Alberto:

This is my legal opinion on the Contract of Engagement entered into between the
University and Physiatrist, regarding the engagement of the physiatrist to provide
clinical supervision to students participating in the physical therapy Internship
Program at various hospitals/clinics.

After a review of the contract, and applicable laws and regulations, I offer the following
assessment and recommendations for both parties Involved in the Contract:

Assessment
 Compliance with ethical standards: The contract places a strong emphasis on
the Physiatrist's obligation to conduct training with the highest degree of
professionalism and to adhere to ethical standards. This commitment to ethical
conduct is commendable and ensures the well-being and education of the
students.
 Competency: The Physiatrist represents themselves as competent and qualified,
which is a crucial aspect of their role as a clinical supervisor.
 Clarity on Relationship: The Physiatrist acknowledges the independent
contractor relationship, which means they are not an employee of the University.

University Assessment

Legitimate Need: The University has a legitimate need for a competent and qualified
physiatrist to supervise students in its Physical Therapy Internship Program, which is
clearly established in the contract.
Recommendation
 Documentation: Maintain thorough records of the services provided, including
any incidents or concerns that may arise during the engagement.
 Adherence to Policies: Ensure strict adherence to the University's policies,
standards, rules, and regulations to maintain a positive working relationship.
 Timeliness: Ensure that the training is completed within the specified time
requirements to meet the University's program schedule.

Recommendation for the University

Monitoring and Evaluation: The University should establish a system for monitoring
and evaluating the Physiatrist's performance to ensure that the training meets the
required standards and ethical guidelines.

Documentation: Keep detailed records of the services provided by the Physiatrist,


including attendance and performance evaluations of students, to maintain a clear
record of compliance and facilitate any necessary reviews.

Legal Review: Periodically review the contract to ensure it remains in compliance with
current laws and regulations governing such engagements.

Both parties should approach this engagement with a commitment to their respective
responsibilities outlined in the contract. Clear communication, adherence to ethical and
legal standards, and the maintenance of accurate records will contribute to a successful
and mutually beneficial relationship.

The Contract of Engagement may now be signed on the part of New Era University.
