RESOLUTION NO.

SERIES OF 2023

“A RESOLUTION MANDATING THE SANGGUNIANG KABATAAN OF


BARANGAY ______, CEBU CITY TO APPOINT THE SANGGUNIANG
KABATAAN SECRETARY”

WHEREAS, on January 15, 2016, Republic Act 10742 otherwise known as Sangguniang
Kabataan Reform Act of 2015, was passed. Further, this law has been amended under Republic
Act 11768 passed on May 16, 2022. Said laws reinforce the role of youth participation in nation-
building making them into better citizens with internalized values of patriotism, nationalism,
and honor as a Filipino;

WHEREAS, Section 8 (n) (2) Rule II of the Internal Rules and Regulations of Republic Act
11768 provides in substance that the Sangguniang Kabataan through the SK Chairperson,
subject to the concurrence of the majority of all the SK members, shall appoint its secretary
and treasurer, provided that the appointed individuals shall meet all the qualifications and
none of the disqualifications set forth by the same law;

WHEREAS, Section 10 (a) Rule II of the same law specifically provides that an elected or
appointed official of the SK must be:

(1) A citizen of the Philippines;


(2) A qualified voter and registered member of the KK;
(3) A resident of the barangay for not less than one (1) year immediately preceding the
day of the elections;
(4) At least eighteen (18) years old and above but not more than twenty-four (24) years of
age on the day of the election. Provided, that the SK treasurer and secretary must be
at least eighteen (18) years but not more than thirty (30) years of age on the day of the
appointment.
(5) Able to read and write Filipino, English, or the local dialect;
(6) Must not be related within the second civil degree of consanguinity or affinity to any
incumbent elected national official or to any incumbent elected regional, provincial,
city, municipal, or barangay official, in the locality where the appointive or elective
official seeks to be elected; and
(7) Must not have been convicted by final judgment of any crime involving moral
turpitude.

WHEREAS, the powers and functions of the SK Secretary are expressly provided under
Sections 14 of the same law;

WHEREAS, Section 11 (c) of the same law provides that both SK Secretary and Treasurer shall
be co-terminus with the appointing authority, unless sooner removed for cause, found to have
failed from the discharge of her/his duties, or has committed an abuse of authority as
stipulated in existing laws pertaining to the conduct of public officials, through a majority
vote of all the members of the KK in a regular or special assembly called for the purpose;

RESOLVED, that in view of the foregoing premises, Hon. ____________, SK Chairperson,
pursuant to the power expressly vested in him under Section 13 Rule II of the Internal Rules
and Regulations of RA 11768, appoints Mr./Ms. ___________ as the SK Secretary having
possessed all the qualifications and none of the disqualifications under the law;

RESOLVED FURTHER, that the same appointment is duly concurred with by the council
through a motion raised by Hon. ______________ and duly seconded by Hon.
__________________. Said concurrence meets the threshold majority contemplated under the
law;

RESOLVED FURTHERMORE, that in the interim, while the prospect individual to be


appointed in the position herein mentioned is yet to undergo his/her mandatory training, the
SK Chairperson shall appoint, among the duly-elected council members, an acting SK
Secretary to perform the secretariat tasks significant in the disposition of collective duties of
the council;

RESOLVED FINALLY, that copies of this resolution be furnished to the office of Hon.
_____________, Punong Barangay; Mr./Ms. ___________, Barangay Secretary; Mr./Ms.
____________, Barangay Treasurer; Hon. _____________, SK Chairperson; DILG RO VII -
Local Government Operations Officer and the proponents of this resolution for their
information and guidance.
