Bernand Barquilla of Manapla MPS

I. AUTHORITY:

1. Letter from Atty. Gail B. Fernandez in behalf of the complainant Mr.

John Rey T. Mendoza and Landmark Tarlac dated November 29, 2023.

II. MATTERS TO BE INVESTIGATE:

2. To verify the fact and circumstances surrounding the alleged commo-

tion incident that transpired at Northland Resort Hotel, Barangay 1-A, Manapla, Ne-
gros Occidental last October 27, 2023 involving the PNP personnel identified as
PMSg Nilo Deypalan, PMSg Bernard Barquilla, Pat. Reynaldo Bedoya and Pat.
Jushane Clamiano.

3. To determine if there were alleged misconduct committed by PMSg

Nilo Deypalan and PMSg Berrnard Barquilla of Manapla MPS.

III. FACTS OF THE CASE:

4. Based on the letter from Atty. Gail Fernandez she stated that on Octo-
ber 27, 2023 Mr. John Rey T. Mendoza and Mr. Landmark Tarlac attended a Hal-
loween Pool Party of Northland Resort Hotel located at Barangay 1-A, Manapla, Ne-
gros Occidental.

 5. at around 1:10 AM of March 31, 2023, shooting and stabbing incident
transpired in the Handi’s Restobar situated at Barangay Salvacion, Murcia, Negros
Occidental involving PSSg Rammelou H Sapu-an, PSSg Jaytie G Misme and PCpl
Gabby T Castillo (Deceased). Investigation disclosed that while the said Three (3)
Police Officer were on their way back to the platoon, they stopped over at Handi
Restobar to drink some bottle of liquor. When they were inside the restobar, they no-
ticed that there was a commotion outside involving customers Jojie Gallano and Mar-
vin Guardavilla. Later Marjune Gallano, uncle of Jojie, stabbed Marvin Guardavilla.
After which, police officers immediately went outside to pacify the said commotion
but unfortunately PCpl Castillo was stabbed by Marjune Gallano hitting on his ab-
domen. Afterwards, suspect Marjune also stabbed those who approached him. That
PSSg Sapu-an was also stabbed by the suspect on his right armpit. PCpl Misme ap-
proached the suspect but unfortunately, he was stabbed on his back, that prompted
him to drew his issued firearm but one of the suspects grabbed his firearms and ac-
cidentally discharged hitting his left thigh.

6. That PCpl Gabby Castillo, Benedict Maguad, and Marvin Guardavilla

were declared dead on arrival by the Attending Physician Dr. Clarence Anne Barrios
of Corazon Locsin Montelibano Regional Hospital, Bacolod City. While PSSg Ram-
melou Sapu-an, PSSg Jaytie Misme and Fernando Diaz, owner of the Handi Resto-
bar, were confined at Corazon Locsin Montelibano Regional Hospital for medical
treatment.

7. That on June 10, 2023, Mrs. Eugenia Hanaya and Fernando Diaz
owner of the Handi’s Restobar, personally appeared to this Office to complain
against PSSg Erwin R Celez, Investigator-On-Case, PSMS Stephen G Jingco, PCpl
Rodel G Garzola and PCpl Rey Joseph T Gawan Alert Team of Murcia MPS with re-
gards to the erroneous reporting of the said incident. That according to them the cor-
rect time of incident was at around 12:00 mid night of March 31, 2023 and not 1:10
AM of March 31, 2023, the time reflected in the report of Murcia MPS. They added,
that few minutes after of the incident, one of the helpers of Handi Restobar went to
Murcia MPS to seek police assistance, but according to the helper he spent an hour
knocking in the Police Station until the duty police officer responded. Further, Fer-
nando Diaz presented his Medical Certificate issued by Corazon Locsin Montelibano
Memorial Regional Hospital, Bacolod City indicated therein the Time of Incident
(TOI) (Attached is the Medical Certificate of Fernando Diaz issued by Corazon
Locsin Montelibano Memorial Regional Hospital, Bacolod City)

8. That on June 19, 2023 PLTCOL EDUARDO B CORPUZ, Chief PIDMU

sent a memorandum to Murcia MPS to answer the above stated allegation of the
complainant.

9. In the Explanation Letter of COP, Murcia MPS dated June 20, 2023, he
averred that the responding Police Officer did not notice that clock of the Police Sta-
tion had a mechanical problem that caused them to take the correct time. He added,
that upon receipt of the said report by the duty Police Officer, they responded imme-
diately which resulted to the arrest of the suspects and file subsequently criminal
case against them. (Attached is the Explanation Letter of Murcia MPS dated
June 20, 2023)

 10. Based on the Duty Detailed of Murcia MPS dated March 30-31, 2023
PSSg Edwin Celez was the Duty Investigator and PSMS Stephen G Jingco, PCpl
Rodel G Garzola and PCpl Rey Joseph T Gawan Alert were the duty Alert Team.

11. According to the report of Murcia MPS the Time of Incident (TOI) was
at around 1:10 AM of March 31, 2023. (Attached is the Police Blotter Excerpt of
Murcia MPS)

VI. DISCUSSION:

12. It can be gleaned that the responding Police Officers of Murcia MPS
failed to certain their report specifically the Time of Incident (TOI) which resulted to
erroneous recording.

13. That the responding Police Officers of Murcia MPS had responded on
the said incident and conducted pursuit operation which resulted to arrest of the sus-
pects and filed criminal case against them.

V. CONCLUSION:

14. After a thorough investigation of the facts and surrounding circum-

stances based on the pieces of evidence on hand, it is noteworthy to state that the
Investigator-On-Case and the responding police officers of Murcia MPS committed
Simple Neglect of Duty.

VI: RECOMMENDATION:

15. WHEREFORE, this Office recommends for the relief and reassignment
of PSSg Erwin R Celez, PSMS Stephen G Jingco, PCpl Rodel G Garzola and PCpl
Rey Joseph T Gawan of Murcia MPS.

16. Recommend approval of paragraph 14.
