Dear sir

Under the instruction and on behalf of my client Mr. Prateek Jain, 70 Kiran Vihar,
Karkardooma, Delhi- 92 I do hereby serve you with the following notice: -

1. That my client Mr. Prateek Jain entered into an agreement with you dated
November 2022.
2. That my client purchased a mobile phone, Samsung Z4 model no.
that comes with a warranty period of one year, so you can get your phone
repaired if it breaks, as long as it doesn't break due to external factors and
misuse as mentioned in your website.
3. That my client entrusted your website to buy the mobile phone but within a
year of purchase the said mobile phone started showing some internal
manufacturing defects.
4. That my client has taken the mobile to the company for the fulfillment of the
said warranty as mentioned on your website but the same has been denied.
5. That your website has clearly mentioned the warranty, but the company
denied giving service, that’s where the cause of action arises.
 6. That thus the warranty has given by your website, you are liable for the
repair of my client’s mobile phone.

Therefore, through this notice finally call upon you to take responsibility to repair
my client’s mobile phone as soon as possible, failing which my client has given me
clear instructions to file civil as well as criminal lawsuit for breach of trust and
specific performance and other Miscellaneous proceedings against you in the
competent court of law and in that event, you shall be fully responsible for the
same.

A copy of this Notice has been preserved in my office for record and future course
of action.
