Subject : Investigation Report and Recommendation
INVESTIGATION REPORT:
1. In our investigation of the last incident was May 04, 2023, Mr. Benologa was instructed to
accompany Mr. Minguillan at the hearing but he was hesitant because it is already night. But according
to Mr. Benologa, it was Mr. Minguillan who insisted on not accompanying him.
2. Stated in the Incident Report with reference no. ECECS-23-05-002, Ms. Quiapo was instructed to
order meals at Jollibee Gaisano Tabunok, Talisay City, and Mr. Benologa was instructed by Ma’am
Eleguin to pick Ms. Quiapo at the Jollibee. Ms. Quiapo thought that they would just walk back to the
office but instead, he rode a tricycle without informing the Finance Manager if it is okay to pay for the
transportation fee. And Mr. Benologa told the tricycle driver who is his friend that Mr. Minguillan has
all the responsibility to pay for the expenses of the SUV repair. And he said that the owner of the
Geordanson Project was not going to pay and the project will stop.
3. According to Ms. Quiapo, Mr. Benologa has had twits every morning since she started to work in this
company. And he always complains about what Mr. Eleguin instructed him.
4. Mr. Benologa talked about Mr. Eleguin and the company. He said that he is always interrupting the
works of others even the Engineers can’t do their job. Mr. Benologa told me that the reason why the
work is always delayed is because Mr. Eleguin keeps on calling. Mr. Eleguin complains whenever he
asks for a ₱ 100.00 for fuel. And he told me that the Purchasing Officer should have a Liaison officer,
and he should have a commission from the materials. And the Purchasing Officer should have a
company phone to use for business transactions. He spoke about the termination of the Geordanson
Project. I told him to stop circulating rumors but he didn’t even listen to me.
5. Mr. Benologa asked for a ₱ 150.00 for fuel but the Finance Manager should have given him ₱100.00
and based on the computation for fuel expenses there is more than what was given to him at that time.
6. Mr. Benologa did not cooperate with the full payment of the Fabrication and Installation of the
Ramp. He pushes the full payment even though it is in the Work Order that there is a 10% retention to
be given after the complete checking and complete turnover of the ramp. He pushes the full payment
without the final approval of Mr. Eleguin.
7. Based on the Notice to Explain of Mr. Benologa that there must be misleading information regarding
all the incidents that happened and his involvement. For Minguillan’s incident, he had only limited
information coming from Mr. Minguillan and he offered his presence to accompany Mr. Minguillan but
he refused.
8. And for the other incidents, it was not his intention and was not intended to demoralize the
company.
9. Mr. Benologa admitted his actions which are contrary to the company policy stated in the ECE
Handbook, and that he will accept whatever punishment is appropriate for him and he regrets and will
take responsibility for his past actions.

RECOMMENDATION:
SERVICES
1. Since Mr. Benologa’s actions are contrary to the policy stated in the ECE’s Handbook. He
may be sanctioned for his action violating the Office Protocol and Decorum, Neglecting his
duty, fraud, and similar acts prejudicial to the company’s interest, Insubordination,
Confidentiality of work and information.
2. Mr. Benologa committed the following as stated below:
1. Article C Sec. 3 - Maligning, making discriminatory remarks, uttering obscene
and offensive remarks, and/or intriguing against the person or honor of another
employee which tends to cast dishonor, discredit, or contempt, upon the latter.
Violating this policy is subject to First Written Warning.
2. Article C Sec. 4 – Circulating rumors at any time in the company and its subject
for First Written Warning.
3. Article D Sec. 14- Loss of trust and confidence, unsuitability commission, or
omission of action/s that provide a reasonable ground that the employee is no
longer reliable, trustworthy, or that his integrity or sense of responsibility is not
acceptable and it is subject to dismissal.
4. Article H Sec. 2 – Willful disobedience by the employee of the authorized orders
of his superior in their official capacity.
5. Article I Sec. 4 – Making false or malicious statements, concerning the good
name of the company and its client’s product and services. Subject to dismissal.
6. Article I Sec. 5 – Revealing or issuing without authority, confidential
information, data, reports, or similar documentation, or trade secrets of the
company to persons not authorized to receive the same. Subject to dismissal.
7. Article K Sec. 2 – Maligning and/or intriguing the person in honor by a superior
to his/her immediate subordinate which tends to cast dishonor, discredit, or
contempt, upon the latter. Subject to 15 days suspension.
3. With these offenses committed by Mr. Benologa, we recommend to dismissed him from his
work for he can cause harm and damage to his fellow worker, immediate head, and to the
name and reputation of the company.

Subject : Decision Report

DECISION:

Based on the investigation report and recommendation obtained conducted by the
HR/Admin Department. Mr. Reynaldo A. Minguillan accepted his fault of committing the
accident. However, it was found out that the SUV Driver made also the mistake of not
cooperating on the maneuvering part which accident eventually happened.
In this regard, the Management decided to make Mr. Minguillan pay only 50% of the
amount for the repair of the SUV Nissan Terra and the company shall pay the other 50%
of the amount. The schedule of payment of Mr. Minguillan shall be a deduction from his
salary amounting to ₱2,750.00 in 4 consecutive payrolls, and a total of ₱11,000.00. This
will serve as final and executory.
