EXTRAJUDICIAL SETTLEMENT OF ESTATE

WITH WAIVER OF RIGHTS

KNOW ALL MEN BY THESE PRESENTS:

This EXTRAJUDICIAL SETTLEMENT OF ESTATE, is


made and entered into by and among:

FLORENTINA M. TAN, widowed, of legal age, Filipino


citizen, and a resident of No. 54 Visayas St., Brgy. Central
Signal Village, Taguig City;

BILLY JANE M. TAN, single, Filipino citizen, and a


resident of No. 54 Visayas St., Brgy. Central Signal Village,
Taguig City; and

JASON M. TAN, single, Filipino citizen, and a resident of


No. 54 Visayas St., Brgy. Central Signal Village, Taguig City;

WITNESSETH, that:

WHEREAS, the above-named parties, are the legal,


compulsory and forced heirs of the deceased VICENTE B. TAN
JR., who died intestate at Taytay, Rizal on April 15, 2022, as
shown by a copy of the Certificate of Death issued by the
Office of the Civil Registrar General and hereto attached as an
integral part hereof and marked as ANNEX “A”;

WHEREAS, to the best of the knowledge and information


of the parties hereto, VICENTE B. TAN JR., died intestate,
without any Will or Testament, and without any outstanding
debts in favor of any person or entity;

WHEREAS, the said deceased, at the time of his death, is


the registered owner of a parcel of land located at Taguig City,
Metro Manila covered by Transfer Certificate of Title No.
41272, of the Registry of Deeds for the Province of Rizal,
registered/recorded under his name and his herein wife Mrs.
Florentina M. Tan and more particularly described as follows:

Transfer Certificate of Title No. 41272

“A parcel of land (Lot 3-B of the subd. Plan Psd-00-


044584, being a portion of Lot 3 Blk. 329, Psd-13-
002057, LRC Rec. No.), situtated in Brgy. Signal
Village, Mun. of Taguig, M.M., Island of Luzon.
Bounded on the NE., along line 1-2 by Road Lot 37;
on the SE and SW., along lines 2-3-4 by Lot 2 Blk.
329; on the SW., along line 4-5 by Lot 5 Blk. 328, all
of psd-13-002507; and on the NW., along line 5-1 by
Lot 3-A of the subd. plan. Beginning at a pt. marked
1 on plan, being S. 52 deg. 21’g., 2995.95 m. from
BLIM 1, Noadm-590-D, Taguig Cad. Mapping, thence;
s. 11 deg. 58’E., 5.13 m. to Pt. 2; S. 74 deg. 54’W.,
18.16 m . to pt. 3; N. 21 def. 07’W., 2.50 m. to pt. 4;
N. 9 deg. 01’W., 2.50 m. to pt. 5; N. 74 deg. 26’E.,
18.44 m. to the pt. of beginning, containing an area
of NINETY THREE (93) SQ. METERS, more or less, All
pts. Referred to are indicated on the plan and are
marked on the ground by PS cyl. conc. mons. 15x60
cm.; except pt 2 to 4 by Old PS cyl. conc. mons.
15x60 cm; bearings grid;date of orig. survey, during
1907 (PSU-2031), that of the subd. survey, Nov. 17,
1996 and approved on Sept. 5, 1997.”

WHEREAS, A true copy of this extrajudicial settlement of


estate had been published once a week for three consecutive
weeks in a newspaper of general circulation in the National
Capital Region (NCR);

WHEREAS, It is to the best interests of the parties


hereto, we FLORENTINA M. TAN and JASON M. TAN hereby
WAIVED all our rights, ownership, shares interest and
participation over the whole parcel of land described in the
Transfer Certificate of Title No. 41272 as Lot 3-B of the subd.
Plan Psd-00-044584, being a portion of Lot 3 Blk. 329, Psd-
13-002057, LRC Rec. No.), situtated in Brgy. Signal Village,
Mun. of Taguig, M.M. in favor of MS. BILLY JANE M. TAN;

NOW THEREFORE, for and in consideration of the


foregoing premises, this Extrajudicial Settlement of Estate and
Waiver of Right set forth herein is subject to contingent
liabilities to creditors, heirs or other persons who might have
been deprived of lawful participation in the estate of the
decedent, for a period of TWO (2) YEARS, from and after the
settlement and distribution thereof, in accordance with the
provision of Section 4, Rule 74 of the Rules of Court;

In the event that any other property of the decedent


should ever be found which is not included hereinabove, the

parties hereto agreed to settle it under a separate terms and
conditions; and

FINALLY, the parties hereto hereby affirm that they have


executed this instrument out of their own free will without
force, intimidation or violence upon their person in connection
with the adjudication of the above –described parcel of land;

IN WITNESS WHEREOF, the parties have hereunto set


their hands this _____ day of October 2023 at Taguig City,
Metro Manila.
