Application for Withdrawal of Domestic Violence Case – On behalf of


Petitioner

1. It is submitted that the petitioner has filed a Domestic violence case D.V.C
No. 121/2016 against the respondents pending before this court for incidents that
happened till 2016.

2. It is submitted that the Protection Officer, Madurai had filed a Final Report
on 23.08.2017 categorically stating that the respondents have perpetrated domestic
violence on the petitioner and to grant all the reliefs prayed for by the petitioner.

3. It is submitted that the Telangana Government Social Welfare Department,


Protection Officer has filed a Domestic Incidence Report, which is pending as
D.V.C No. 148/ 2022 in IV Metropolitan Magistrate Court, Hyderabad against the
above respondents and one more additional respondent for new cause of action/
fresh incidents that happened from 2017 till 2021.

4. It is submitted that the respondents instigated their advocate Ramanathan to


assault the petitioner inside the court premises and she was assaulted right in front
of this Additional Mahila court on 12.02.2019. The petitioner’s complaint is also
on record in this case file. The bar association of the respondent counsel also
admitted to the incident and apologized with undertaking on record that such
incidents won’t happen in the future.

5. It is submitted that the Hon’ble Madurai High court in CRL.O.P(MD) No.


10617 of 2019 has passed order dt 01.02.2022 directing Jurisdictional police to file
FIR final report within 2 weeks but no FIR or action has been taken by the
Jurisdictional police due to influence of the respondents and their lawyer.

6. It is submitted that the petitioner has no safety coming to Madurai and just
because on one or two hearing dates that the petitioner escaped safely from
Madurai by God’s grace does not mean the petitioner has to again and again come
to Madurai where her Life and dignity both are in grave danger. The petitioner
won’t get any justice in Madurai and the petitioner deposed in Criminal case
CC164/2018 only on the assurance given by the AWPS Thilagar Thidal Police that
they will protect her in Court. When anything happens to the petitioner due to the
respondents and their circle then also the petitioner has no chance of getting justice
in Madurai.

7. It is submitted that the petitioner is residing and studying L.L.B at


Hyderabad and unable to pursue the cases at Madurai.

PRAYER

It is therefore prayed that, in the aforementioned facts and circumstances, it


is dangerous for the petitioner to pursue case at Madurai and hence this court may
permit the petitioner to withdraw the present D.V.C case and permit to use the
grounds in the present petition in the D.V.C case pending at Hyderabad, the
protection order dt 06.10.2016, as well as the Protection officer report in the
present case as evidence in the D.V.C case pending at Hyderabad, in the interest of
justice.

I, Vidhya G, Aged 34, Occ: Student, R/at No. 11 Flamingo Residency, Falcon
Valley Colony,Shaikpet, Hyderabad-500008, do solemnly affirm and stated as
under:

1. That I am the Defacto-complainant in the aforementioned case C.C No.


164/2018 which is pending for judgement before this Hon’ble Court, and I am as
such well aware of the facts and circumstances of this case and also depose this
affidavit.

2. That I am presenting the accompanying application u/s 257 of CR.P.C along


with this affidavit.

3. That I read and understood the contents of the accompanying application and
state that the contents are true and correct to the best of my knowledge.
