CONTRACT OF EMLOYMENT FOR SECURITY GUARDS

KNOW ALL PERSONS BY THESE PRESENTS:

This Contract of Employment executed this _____ day of ________________


20____ in the City of Cagayan de Oro, Philippines by and between:
SAGITTARIUS SECURITY AGENCY is a license to establish, manage, operate and
maintain a private security agency for the sole purpose of engaging in the business of
selling, contracting or leasing private security services within the entire Philippines and
under and by virtue of Philippine laws, with employer’s office at President Quirino St.,
cor.,Lim Ket Kai Drive, Cagayan de Oro City, represented herein by MR FERMIN A
BOLLOZOS and referred to as EMPLOYER;

age and with residential address at ________________________________________

referred to as SECURITY GUARD;
-WITNESSETH THAT-
WHEREAS THE SECURITY GUARD applied for work with the EMPLOYER;
WHEREAS, the EMPLOYER has accepted such application subject to certain terms
and conditions;
WHEREAS, the EMPLOYEE manifests and guarantees that he/she possesses the
requisite qualities and competencies needed by the EMPLOYER in the conduct and
course of its business and submit an authentic LESP and 201 Files;
NOW THEREFORE, for and in consideration of the foregoing premises and terms and
conditions set forth hereunder, the parties have agreed as follows:
1. JOB TITLE AND DESCRIPTION – The Employee shall be designated as
SECURITY GUARD.

2. PLACE OF WORK - The SECURITY GUARD shall be assigned to the


EMPLOYER’S client at __________________________________ at
___________________________________________and his tour of duty shall be for a
period of _______ hours per day on the following days of week ______ to ________
subject to overtime work as maybe required by the employer. You will not have a fixed
or definite area of assignment or place of work and you agree to be transferred and/or
to accept any assignment to any location, if and when so requested by the Agency as
may be dictated by business exigencies and/or subject for Return to Agency (RTA)
upon request of the client on infractions committed during his/her tour of duty.
3. SALARY – The EMPLOYEE shall receive a salary of
_______________________________ (P______________) as his daily basic pay,
subject to SSS premiums, PAG-IBIG contributions, Philhealth dues, Insurance and
other required deductions with an Authority to Deduct. In addition, EMPLOYER will pay
mandatory 13th month salary at the end of each calendar year and/or integrated on their
monthly basic salaries subject for the individual discretion of the employee and approval
of the management. Incremental salary adjustments and merit increases may be
effected on a case to case basis and upon recommendation of the immediate Security
Director/Manager and upon approval of the management.
4. STANDARDS OF PERFROMANCE - The SECURITY GUARD is expected to
meet the following standards of performance in the course of his employment:
a. Very good work performance – as shown by his ability to perform the nature
of the work with the quality required and within the time specified;
b. Very good attendance record;
c. Compliance with the EMPLOYER’S and EMPLOYER’S CLIENT’S policies,
rules and regulations;
d. Compliance with the terms and conditions of this contract;
e.Compliance with the RA 11917 (AN ACT STRENGTHENING THE
REGULATION OF THE PRIVATE SECURITY SERVICES INDUSTRY);
5. DUTIES AND RESPONSIBILITIES - You are required to strictly comply with all
the rules, regulations and policies of the Agency and its client where you will be
assigned, including but not limited to those governing order and discipline, honesty,
safety and security, working hours, work assignments and standard operating
procedures, uniform, use of Agency properties and access to matters of confidentiality,
and such other rules deemed necessary in the conduct of the Agency business.
You likewise agree that any problem that you will encounter during your assignment
with a particular client should first be taken up with the Agency and must not in any way
be discussed with the client where you are assigned or decided or acted upon on your
own.
You understand that your engagement as a Security Guard depends upon the
continued trust and confidence of the Agency and its clients on your person, integrity
and trustworthiness. As such, the Agency may terminate your services at anytime, even
prior to the expiration of this Contract, for any of the just or authorized causes provided
by existing law, breach of trust, for unsatisfactory performance, or for any violation of
the of the rules, regulations or policies of the Agency or the client where you are
assigned. The Agency likewise reserves the right to terminate your employment in case
of termination or expiration of the contract of the Agency with the client where you are
assigned.
6. INTELLECTUAL PROPERTY - The Company shall be entitled to sole
ownership of any intellectual property rights including but not limited to software
programs, hardware specifications and other property rights created, developed and
discovered by Employee while in the course of his employment with the Company,
including all registrations for the same.
7. NON-DISCLOSURE AND CONFIDENTIALITY -Employee acknowledges and
confirms that this contract must remain confidential. Except as may be legally required
by competent authority or applicable statutes, the parties hereto shall not make any
unauthorized disclosures of the terms and conditions embodied in this contract.
In order to safeguard the Company’s interest and the confidentiality of its business and
affairs, Employee agrees that during the term of his employment and from and after the
actual cessation of his employment he shall maintain strict confidentiality and shall not
disclose any technical, business, financial or commercial information, methods,
processes, inventions (whether covered by intellectual property protection or not or
whether marked confidential or not) including but not limited to: customers. customer
lists or requirements, price lists, pricing structures, marketing and sales information,
business plans or dealings, employees or officers, financial information, product lines,
research activities, plans, designs and formula, whether authored by employee or
otherwise.
Failure to comply with this confidentiality undertaking shall be construed and considered
as gross Misconduct and shall be deemed a ground for the termination of his
employment.
8. UNDERTAKING - Employee shall work exclusively for the benefit of the
company. Employee warrants that he shall comply with all his undertakings and
obligations set forth in this Contract and shall indemnify Employer of any actual losses,
damages, costs and expenses, including attorneys’ fees incurred as a result of the
breach of this Agreement or his willful act, omission, fraud or negligence.
9. TERMINATION - Employer reserves the right to terminate or cancel this
Contract after observing due process for just or valid causes. Termination may be due
to any of the following grounds, inter alia:
a. Inefficiency;
b. Incompetence;
c. Tardiness;
d. Insubordination;
e. Under the influence of intoxicating liquor or drugs;
f. Theft/Robbery and other criminal acts committed;
g. Breach of confidentiality and non-disclosure
h. Violation of company’s intellectual property rights
i. Just and authorized causes enumerated in Article 282. 283. And 284 of the
labor
code;

j. Other causes provided in the Company Rules and Regulations; and Other
analogous causes.

10. ACCEPTANCE OF TERMS AND CONDITIONS OF EMPLOYMENT -


Employee’s affixing of his signature on the herein Employment contract means that:

Employee has read and fully understood the terms and conditions hereof and accepts
the same;

The terms and conditions for the regularization of his/her employment have been clearly
communicated to and accepted by him/her at the time of his engagement.

IN WITNESS WHEREOF , we hereunto affix our signatures on the date and at the
place first above written.
