EXPLANATORY NOTE

“AN ORDINANCE AMENDING SECTION 12, 13 AND 14 OF CITY


ORDINANCE NO. 2018-018, “AN ORDINANCE REVISING CITY TAX
ORDINANCE NO. 2001-006, “AN ORDINANCE PROVIDING FOR A
LOCAL INVESTMENT AND INCENTIVES CODE OF THE CITY OF
MAASIN AND FOR OTHER PURPOSES.”

WHEREAS, Section 76 of RA 7160, otherwise known as the Local Government


Code of 1991, provides that every Local Government Unit shall design and implement
its own organizational structure and staffing pattern whichever is applicable that will
carry out its mandate for a good local governance;

WHEREAS, the City Government of Maasin is likewise mindful of the declaration


of the State Policy under R.A 9593, which is to promote tourism as a indispensable
element of the national economy and an industry of national interest and importance,
which must be harnessed as an engine of socio-economic growth and cultural
affirmation to generate investment, foreign exchange, and employment, and to continue
to mold an enhanced sense of national pride for all Filipinos;

WHEREAS, recognizing the importance of tourism promotion as one of the means


of generating investment, foreign exchange and employment, City Ordinance No.
2001-006 has mandated the Maasin City Investment Promotions Center to serve as
coordinator of all tourism, socio-cultural and manpower services, programs and
activities. For this reason, the Center was known as the City Investment and Tourism
Office (CIPTO);

WHEREAS, in line with DILG MC No. 2020-167 entitled “Guidelines on Promoting


Local Economic Development and Investment Promotion and Establishment of LEDIP
Office/Unit in all Provinces, Cities and Municipalities” and to conform with the existing
organizational structure of the CIPTO, there is a necessity of amending Section 12 of
the City Ordinance No. 2018-018.

ORDINANCE NO. 2018-018, “AN ORDINANCE REVISING CITY TAX
ORDINANCE NO. 2001-006, “AN ORDINANCE PROVIDING FOR A
LOCAL INVESTMENT AND INCENTIVES CODE OF THE CITY OF
MAASIN AND FOR OTHER PURPOSES.”

NOW THEREFORE, BE IT ORDAINED by the Sangguniang Panlungsod of


Maasin City, Southern Leyte in session assembled that:

SECTION 1 - Section 12 of City Ordinance No. 2018-018, is hereby amended to


read as follows:

SECTION 12. CITY INVESTMENT PROMOTIONS AND TOURISM OFFICE


(CIPTO) - The City Investment Promotions and Tourism Office (CIPTO), formerly
Maasin City Investment Promotions Center, created under Section 22, Chapter VIII of
City Ordinance No. 2001-006, shall be under the Office of the City Mayor and shall
composed of the following personnel with corresponding qualifications and salary
grade standards, to wit:

SECTION 2. - Section 13 of City Ordinance No. 2018-018, is hereby amended


to read as follows:

“SECTION 13. BUDGETARY ALLOCATION. An annual budgetary


appropriation of not less than THREE MILLION PESOS (Php 3,000,000.00) shall
be included in the annual and/or supplemental budgets of the City for the
operation and maintenance of the City Investment Promotions and Tourism
Office.”

SECTION 3 – Section 14 of City Ordinance No. 2018-018, is hereby amended to


read as follows:

“SECTION 14. FUNCTIONS AND DUTIES OF THE CIPTO AND THE


CITY INVESTMENT AND TOURISM OFFICER - The CIPTO and the City
Investment and Tourism Officer shall have the following functions and duties:

1. Function of the CIPTO. - The CIPTO shall function as a one-stop-


shop for investors and shall serve as the technical secretariat of the
Board, taking an active role in implementing the Code. It shall take
charge of all activities related to LGU investment facilitation and
promotion activities, local enterprise development, establishment of
support mechanism for the growth of Micro, Small and Medium
Enterprises (MSMEs), provide mechanisms for business retention and
expansion, and other business and economic activities to attract
investments and generate employment.

2. Duties and Function of the CITY INVESTMENT AND TOURISM


OFFICER. The City Investment and Tourism Officer shall perform the
following duties and function:

a. Serve as member of the advisory group that will guide the LGU for
investment promotion;

b. Steer the creation of a business enabling environment to attract,


retain or expand investments;

c. Advocate and promote policies and practices that will encourage


local investments, such as:

1. Preparation of LGU Economic Development aligned with the


Provincial Development and Physical Framework Plan
(PDPFP), Comprehensive Land Use Plan (CLUP),
Comprehensive Development Plan (CDP) and Local
Investments and Incentive Code as may be applicable;

2. Assist in the Formulation of Local Investments and Incentive


Code (LIIC) and –

3. Marketing and Promotion Strategies of the LGU.

d. In close coordination with the Local Planning and Development


Coordinator, indentify revenue generating and enterprise
development projects of the LGU which may be implemented by
the private sector through Public-Private Partnership (PPP)
arrangements.

e. Provide support and facilitation assistance for prospective and new


investors;

f. Establish and maintain a local economic database containing


relevant facts and figures on the local economy to be able to
provide information about business potentials of the LGU including
its services to prospective investors to attract more investment to
flow in the locality.
g. Conduct mission trips in relation to promotion and marketing
activities of the LGU to attract investments;
h. Assist and support local councils whose undertakings are related to
economic development;

i. Assist in the promotion and development of Micro, Small and


Medium Enterprises (MSMEs) in the locality, as well as all other
potential investors, particularly in (1) securing licenses and permits,
(2) indentifying business or joint venture partners, raw materials
suppliers and possible business sites, (3) sourcing skilled
manpower and service providers, and (4) facilitating the resolution
of issues and concerns encountered by business entities;

j. Establish and maintain partnership with Regional Office of National


Economic Development Authority (NEDA), Public-Private
Partnership (PPP) Center; Department of Trade and Industry (DTI),
DTI-Board of Investments (DTI-BOI), National Competiveness
Council (NCC); Department of Science and Technology (DOST),
Department of Finance (DOF), Bureaus and attached agencies
such as: Bureau of Internal Revenue (BIR), Bureau of Customs
(BOC), Securities and Exchange Commission (SEC), and Bureau
of Local Government Finance (BLGF), along with other national
government regulatory agencies and with the private sector,
NGOs/CSOs, academe and other stakeholders in the
implementation of programs, projects and activities that will
promote the business-friendliness and competitiveness of the LGU.

k. Represent the City in trade and investment meetings, conferences,


and other similar activities in both domestic and foreign venues.

l. Prepare and disseminate investments promotion collaterals, e.g.,


brochures, and a website of the LGU for the purpose of information
dissemination, including issuing reminders to Registered
Enterprises, and providing information relevant to investors, among
other information generally relevant to doing business.

SECTION 4. SEPARABILITY CLAUSE. If any provision of this Ordinance is


declared invalid or unconstitutional, other parts or provisions thereof, which are not
affected thereby, shall remain in full force and effect.

SECTION 5. REPEALING CLAUSE. All Ordinances found to be inconsistent with


this Ordinance are hereby repealed in full force and effect.

SECTION 6. EFFECTIVITY. This Ordinance shall take effect upon approval and
compliance with the posting requirement prescribed under R.A. 7160.
