The Plaintiff filed a Notice of Settlement as to Certain Defendants [ECF No. 41], informing

the Court that the Plaintiff has settled this case with:

• Qingdao Xibu Zhineng Keji Youxian Gongsi a/k/a Xibutec (Defendant No. 1 on
Schedule A).
• Qingdao Haiyi Muye Youxian Gongsi a/k/a Makey’s (Defendant No. 73 on Schedule
A)

We hereby ORDER and ADJUDGE as follows:

1. The above-styled action shall remain CLOSED without prejudice to the Plaintiff,

Defendant No. 1, and Defendant No. 73 to file a stipulation of dismissal by January 8,

2024. If these parties fail to complete the expected settlement, the Plaintiff, Defendant

No. 1, or Defendant No. 73 may ask the Court to reopen the case.

2. All pending deadlines and hearings are TERMINATED, and all other motions, including

Defendant 1 & Defendant 73’s Motion to Dismiss [ECF No. 36], are DENIED AS

MOOT.
