PETITION FOR ISSUANCE OF NEW OWNER’S COPY OF TRANFER OF TITLE

COMES NOW, Petitioner through the undersigned Public Attorney,

unto this Honorable Court, respectfully avers:

1. That petitioner is of legal age, married, Filipino citizen and residing

at #66 Estetik St., Barangay Pallua, Tuguegarao City, Cagayan Valley
where he may be served with summons, notices and other court
processes;
2. That Respondent Register of Deed of Makati City is a state agency
tasked in the registration of properties in the City of Makati, with
office address at 5th Floor, New Makati City Hall, Dr Jose P Rizal
Avenue, Corner F Zobel Street, Makati, 1208 Metro Manila where
summons, notices and other court processes will be served;

That the Petitioner is the owner of a parcel of land located at Forbes

Park, Makati City, Metro Manila declared under Transfer of Certificate
of Title No. 043-3133112305, more particularly describe as:

LOT NO, 11-C-10-F-3, QTE- (BG)-13-213674

 3. That one Darlene Manaligod executed a Deed of Absolute Sale
selling, transferring, and conveying in favor of the petitioner.

A copy of the Deed of Absolute Sale is attached and made an

integral part hereof as Annex “A”;

4. As a requirement set by the Bureau of Internal Revenue for the

purpose of payment of Real Estate Taxes and Estate Taxes of the
subject property and the right of the petitioner. Herein petitioner
asks for the issuance of new owner’s copy of TCT No. 043-
3133112305;

5. I addition to the documents already mentioned and attached

hereto, the petitioner is submitting the following documents in
support of the instant petition:

a. A certified true copies of the tax declarations for calendar

year 2019, 2020, 2021 of the subject property marked as
Annexes “B”, “C”, “D” hereof.

b. A certified true copy of the technical description and

blueprint of the subject property covered by TCT No. 043-
3133112305 issued by the Land Registration Commission
for purpose of issuance of new owner’s copy of Transfer
Certificate of Title, marked as Annex “E” hereof.

WHEREFORE, petitioner respectfully prays that, after due

proceedings, an order be issued by this Honorable Court declaring the
owner’s copy of Transfer Certificate of Title No. 043-3133112305 which was
lost, as null and void and of no force and effect to order direct the Registry
of Deeds of Makati City, after payment of petitioner of the fees prescribed
by law, to issue in lieu thereof new owner’s duplicate certificate which shall
in all respects be entitled to like faith and credit as the original duplicate, in
accordance with Section 109 of Act No. 496, as amended by PD 1529.

Petitioner likewise prays for such other reliefs and remedies as may
be just, proper, and equitable in the premises.

I, NAGNIL LINGAN, of legal age, married, Filipino citizen and residing

at #66 Estetik St., Barangay Pallua, Tuguegarao City, Cagayan Valley, under
oath, depose and say:

1. That I am the petitioner in the above-entitled petition; that I caused

he preparation of the foregoing petition; that I have read and
understood the contents thereof; that all the allegations contained
therein are true and correct of my own knowledge and authentic
records;

2. That I have not commenced any other action involving the same
issues in any court, tribunal, or quasi-judicial agency
 3. That to the best of my knowledge, no such other action or
proceeding is pending therein;

4. That in the event that I learn that the same or similar action has been
filed or is pending, I shall report that fact within five (5) days
