Appointment as Assistant Engineer (Construction) Dear Mr. Sagnik Chanda, This refers to the interview and subsequent discussion with you for the subject post. We are pleased to formalize our offer of appointment to you in Anwesha Engineering & Projects Limited, as Assistant Engineer (Construction) at Project site on the following terms and conditions. 1. As shown in the salary annexure on compensation package: a) Your Annual Target Cost to the Company (TCTC) will be Rs. 3,02,856/-(Rupees ‘Three Lakh Two Thousand Eight Hundred Fifty Six Only) per annum. 2. In addition, you will be reimbursed all official expenses incurred on behalf of the Company as per Company's policy laid down from time to time 3. You will be reporting to the Resident Construction Manager at project site for the Performance of the job assigned to you, who will also set out your detailed functional responsibilities, 4. Your services are transferable and can be seconded or deputized by the Company to: a) Any Anwesha Engineering & Projects Limited or affiliate company operation in India and abroad; whether existing as on date of your appointment or to be established thereafter at the option of the company. b) Any operation in India or abroad under the management and/or ownership of Anwesha Engineering & Projects Limited including a joint venture in which Anwesha Engineering & Projects Limited is a participant. 5. For the continuity of job, the actual / 1* date of joining will be considered and all retirement benefits will be applicable as per the actual date of joining at the time of separation. 6. In case you are working in any overseas offices or sites and is deputed/ transferred to any Indian project sites or office, the tax liabilities will be by the employer and the same will be borne by the individual employee as per the Income tax laws in Jndia. You will be on probation for a period of six months. Review of your performance shall be done every three months during your probationary period. The continuation of your service with the Company depends upon your satisfactory performance during the period under review. In case management is not satisfied with your performance or conduct during this period, your services shall be liable to termination without notice. On satisfactory completion of your probati period, your services will be Regularized/Confirmed. 8. In case you desire to leave andlor resign from the service of the company, it is mandatory for you to give one month notice in writing and in case company wants to terminate your services for any reason, it will give you one month notice or one basic salary in Lieu there off. Totally on the discretion of the management you will be allowed to pay basic salary in lieu of the notice period. If you abstain yourself from duties by refusing to give the said notice or fail to attend work during the notice period, the management shall have the right to recover the unserved period of Notice from your legal dues including wages, leaves, gratuity if any, and such other dues payable by the company. ‘The management however shall have the discretion on accepting your resignation, to relieve you at any time during the notice period. Under such eventualities of the management relieving you, you shall be entitled to the wages/remuneration of the unserved notice period. The Management shall have the right to terminate your services without any notice ‘and/or compensation if you are in moral breach of your responsibility or in case of loss of confidence and /or for offense including moral turpitude. 9. You will be required to join Company's Provident Fund Scheme. 10. You will be governed by the rules and regulations as applicable, enforced, ‘amended or altered from time to time during the course of your employment and then these would be part of your service condition. 44.0n the company paying your Relocation Expenses/Notice Pay/ Any other reimbursement at the time of joining, you agree to work for not less than 12 months. However if you voluntarily leave the company within twelve months on receiving all or part of your relocation expenses or allowances, you will repay the company such expenses or allowances, as applicable or otherwise, the same may be deducted, from your last salary/final settlement and/or expenses reimbursement. 12. Absence for a continuous period of eight days without prior approval of your superior (including over stay or leave / training), would be deemed to be abandonment of employment by you whereby you have relinquished your rights and claims on your employment your services would automatically come to an end without any notice or intimation. In case particulars mentioned in your application are found to be incorrect, false, and not authentic or without documentary proof, your services would be liable for termination at any time without any notice or any compensation in lieu thereof. 14, You further agree that you shall perform your duties with diligence and devotion While in the employment of the Company, you are in no way allowed to be ‘employed in any other Company on a temporary or regular basis or offer your services with or without pay to any person, legal entity or public authority or to be ‘occupied in your own business without the prior consent of the Company. You will ‘comply with all orders and directions given to you by the company and observe the rules, regulations and arrangements applicable to you. 15. You agree not to join our client company or our competitors in India or abroad with whom Anwesha Engineering & Projects Limited is directly executing project any time during your employment with us or in next 6 months from your date of leaving ‘Anwesha Engineering & Projects limited, 18. You confirm that you have disclosed fully to the Company all of your business interests whether or not they are similar to or in conflict with the business(s) or activities of the Company, and all circumstances in respect of which there is or there might be, a conflict of interest between Anwesha Engineering & Projects limited and you or any immediate relatives. 17, You agree to disclose fully to the Company any such interests or circumstances which may arise during your employment immediately upon such interest or circumstances arriving, 18, CONFIDENTIALITY a) The position held by you is of a strictly confidential nature. You shall not disclose to any unauthorized person, either during or after your employment with the Company, any information about the interest or business of the Company or any affiliated Companies b) You shall not communicate to any public papers, journals, pamphlets or leaflets, or cause to be disclosed at any time, any information or documents, official or otherwise, related to the Company except with prior approval of the management ©) Any invention, development, process, discovery, formulae, plan, specification, program, design, process, adaptation or improvement in procedure or other matters or work including any artistic, literary or other work which can be subject matter of copyright whatsoever, made, developed or discovered by the employee either alone or jointly with any other person or persons while in employment of the Company, in connection with or in any way affecting or relating to the business of the Company or capable of being used or adapted for use therein or in connection therewith shall be disclosed to the Company and shall belong to and be the absolute property of the Company. Page 3 of & anwesha commited people together 19, Upon termination/resignation of your employment with the Company, you shall forthwith return to the Company all assets and property of the Company (including any leased properties), documents, files, books, papers, memos or any other property of the Company in your possession or under your control, which you are ‘occasioned to come in possession by the virtue of the employment with the ‘company. 20. Upon termination of this agreement you will not solicit or endeavor to entice away from the company or any of its affiliates, any employee, or any other person engaged by the company or its affiliates (whether or not such person would ‘commit any breach of contract by reason of leaving the service of the company or its affiliates), or any customer of the Company or its affiliates. 21, The terms of this offer are strictly confidential between you and the Company and any breach of this confidence, will be viewed with utmost seriousness being tantamount to breach of appointment leading to termination of appointment and action that will follow, legal or otherwise. 22. Your appointment will be effective from the date mutually agreed upon but not later than 08" July 2018 subject to medical fitness, which is prerequisite of this appointment 23, At the Company's option, you are required to undergo a medical Examination least once a year by a doctor nominated by the company. The acival payout may differ based on individual, Business, Site and company Performance. Performance Linked Rewards shall be forfeited for employees who resign and / or serving notice period on or before the actual date of disbursement, notwithstanding any delay on the announcement of such disbursement. (if Applicat), 2) Accident insurance coverage towards yourself as per the company policy. (If Applicable) 3) You shail be ented for Thirty (30) Privlege Leave and Ten (10) Sick Leaves per annum.
