DEED OF LEASE

THIS DEED OF LEASE is made and executed on this 2nd day of


November 2023, by & between:- Mrs. SHAMSHAD BANU, aged about 59
years, wife of Mr. Syed Haroon Bukhari, residing at “S.H.Bukhari”,
Salmanabad, Bhatkal, Uttara Kannada District, Karnataka - 581320.

Hereinafter referred to as “LESSOR” of the ONE PART.,

AND

Mr. SYED ABUL HAISAM BUKHARI, aged about 27 years, son of


Mr. Syed Haroon Bukhari, residing at “S.H.Bukhari”,
Salmanabad, Bhatkal, Uttara Kannada District, Karnataka -
581320.

Hereinafter referred to as ‘LESSEE’ of the OTHER PART.,

The terms LESSOR and LESSEE shall mean and include their
respective heirs, executors, administrators, legal representatives,
successors, and assigns of their part as parties wherever context
admits it and includes the same.

WHEREAS, the LESSOR is the sole and absolute owner and is in


exclusive possession of shop premises, situated at Sy. No.557,
Hissa 9, measuring 00-00-01(A.G.A), of Susgadi village, Bhatkal,
bearing TMC Door No.411, measuring approximately 210 Sq.Ft

WHEREAS, the LESSEE for want of commercial purpose


approached the LESSOR, to let out the same on lease for a period
of 11 (Eleven) months starting from 01-09-023 and the LESSOR
has agreed to let out the said premises with a security deposit of
Rs-1,00,000/- (Rupees One Lakh Only) and the LESSEE has
agreed to pay the said sum of Rs-1,00,000/- (Rupees One Lakh
Only) as security advance under the following terms and
conditions:

1. That in pursuance of the said security deposit of Rs-


1,00,000/- (Rupees One Lakh Only), the LESSEE has paid
the LESSOR, a sum of Rs-1,00,000/- (Rupees One Lakh
Only) by way of cash, the receipt of which the LESSOR
herein acknowledged for having received a total sum of Rs-
1,00,000/- (Rupees One Lakh Only) in presence of the
under mentioned witnesses.

2. The LESSEE shall pay the LESSOR a sum of Rs-10,000/-
(Rupees Ten Thousand Only) on or before 05th of every
succeeding English calendar month as MONTHLY RENT
inclusive of maintenance.

3. The term of this DEED OF LEASE commences from


1st September 2023, and it will remain in force for a period
of 11 months and expires on 1st August 2024.

4. During the term, the security deposit amount shall not


carry any interest and this amount is fully refundable to
LESSEE by the LESSOR on termination of this DEED OF
LEASE after deducting arrears or dues of LESSEE if any,
such as electricity bill, water bill, rent, etc.,

5. During the term of this DEED OF LEASE, if the LESSEE


fails to pay monthly rental on time, then the LESSOR has
the right to terminate this DEED OF LEASE and ask the
LESSEE to vacate the rented premises.

6. The LESSEE is liable to hand over vacant possession, intact


and in good condition to the LESSOR at the time of
termination of this DEED OF LEASE.

7. The LESSEE shall pay the electricity charges, in respect of


the rented property during the period of this DEED OF
LEASE before the due dates specified by HESCOM.

8. The LESSEE shall not sub-let or under let or part with the
possession of the schedule premises with any other third
party without the consent of the LESSOR.

9. The LESSEE is liable to allow the LESSOR or his


representatives to inspect the house premises at any
reasonable hour, in the daytime, with prior intimation, to

view the conditions thereof and to effect such repairs as the
LESSOR is required to do, and to carry out any work and
the LESSEE shall allow the same to be done without any
objection.

10. The LESSEE shall be entitled to fix temporary fittings,


fixtures and appliances in the rented property with the
consent of the LESSOR and shall be at liberty to remove
them while vacating the rented property without causing
damage to the construction and walls.

11. The LESSEE shall not make any structural additions


or alteration to the rented property. If any damages
occurred due to the negligence of the LESSEE, such
damages will be borne by the LESSEE or such charges will
be deducted from the security deposit amount.

12. Either the LESSOR or LESSEE shall be at liberty to


give one month prior notice for vacating the
premises.

13. The LESSEE shall not do any act or deed in


contravention to any GOVERNMENT ACTS, rules &
regulations, or conditions or rules imposed by any local
bodies like the corporation, BBMP etc.

14. The LESSEE shall not create any untoward


disturbance or nuisance and shall not allow any anti-social
person in the said premises.

15. The LESSEE shall hand over vacant possession of the said
premises to the LESSOR on termination of this DEED OF
LEASE

SCHEDULE

The premises of rented portion is in shop premises, situated at


Sy. No.557, Hissa 9, measuring 00-00-01(A.G.A), of Susgadi
village, Bhatkal, bearing TMC Door No.411, measuring
approximately 210 Sq.Ft with electricity.

In witness whereof the LESSOR and the LESSEE above


named have set their hands and signature on the day, month
and year above written at BHATKAL in the presence of witnesses.
