WILDLIFE RULES AND REGULATIONS

It includes all those orders and administrative


codes issued by government agencies at all levels, municipal, provincial, and federal for
conservation management protection and management of wildlife.

WILDLIFE RULES AND REGULATIONS IN PAKISTAN

Criminal procedure code 1808:


This law outlawed the killing or injury of any animal whose
value exceeded ten rupees and was implemented during British rule.

Wild Birds and Animal Act of 1912:


This law was enacted by the British government in the twentieth
century when animals came under the threat of elimination.

The Sindh Wild Birds and wild animals’ protection act 1940:
In Sindh, the Wild Birds and Animal Act of 1912 was improved in 1940 as "The Sindh Wild
Birds and wild animals’ protection act 1940".

The West Pakistan wildlife protection ordinance:


Wild Birds and Animal Act of 1912 was
updated again in 1959 as "The West Pakistan Wildlife Protection Ordinance"

The wildlife protection" ordinance 1972:


After partition, a strong measure was taken in 1972 and the 1959 ordinance was repealed and
replaced by a far more dynamic law based on scientific principles namely "The wildlife
protection" Ordinance 1972". This ordinance was implemented in Sindh in 1972 & in 1974.
This act was implemented in Punjab.

KHYBER PAKHTUNKHWA WILDLIFE AND BIODIVERSITY (PROTECTION,
PRESERVATION, CONSERVATION AND MANAGEMENT) ACT, 2015

CHAPTER-1
PRELIMINARY

1. SHORT TITLE, EXTENT AN COMMENCEMENT.

(1) This Act may be called the Khyber Pakhtunkhwa Wildlife and Biodiversity (Protection,
Preservation, Conservation and Management) Act, 2015.
(2) It extends to the whole of the Province of the Khyber Pakhtunkhwa.
(3) It shall come into force at once.

2. DEFINITIONS

a) Alien species means the species, which enter into an ecosystem and exert harmful influences
over other members of the ecosystem, where their presence is not desirable.
b) Animal means amphibians, reptiles, birds and mammals, their young and also in the cases of
amphibians, reptiles and birds, their eggs, but excluding livestock and poultry,
c) Animal article means an article made from any wild animal and includes an article or object
in which the whole or any part of such animal has been used.
d) Animal display means exhibiting any wild animal dead or alive publicly for commercial,
gambling, fighting or baiting purposes.
e) Appendix means an Appendix to CITES or CMS.
f) Big Game Hunting License means a License issued under this Act or the rules, for hunting of
Game Animals specified in Part-IV of the First Schedule.
g) Big Game Hunting Permit means a permit issued under this Act or the rules, for hunting of
Game Animals specified in Part-IV of the First Schedule:
h) Biodiversity or biological diversity means the variability among all living organisms from all
sources including inter alia terrestrial, marine and other aquatic eco-systems and the ecological
complexes of which they are part and includes diversity within species or between species and
eco-systems.
i) Indigenous means an animal species native to a specified area, a country or a region but not
introduced.
j) Invasive species means the species introduced in a habitat where they outgrow the native species
and may reach a level where they could become a weed or a pest.
k) Sustainable use means the use of components of biological diversity in a way and at a rate that
does not lead to the long-term decline of biological diversity, thereby maintaining its potential to
meet the needs and aspirations of present and future generations.
l) Wildlife Officer means any person appointed or empowered by Government in this behalf to
carry out all or any of the purpose of this Act.
m) Exotic refers to a species, both floral and faunal, which does not occur in an area naturally and
is introduced or intended to be introduced from outside of its natural occurrence excluding Trout
Fish.
n) Trophy means any dead body or any horn, antler, tooth, tusk, bone, claw, hoof, skin, hair,
feather, egg-shell or another durable part of a wild animal whether or not included in a
manufactured or processed.
3. AIMS AND OBJECTIVES

The aims and objects of this Act are the


(a) Strengthening the administration of the organization for effective management of wild animals
and their habitats.
(b) Management of Protected Areas in a sustainable manner for the best interest of the indigenous
and local communities.
c) Promotion of public awareness and capacity building for proper appreciation of the
environmental significance and socio-economic values of wildlife.
(f) Conservation of biological diversity and realization of its intrinsic and extrinsic values through
sustainable use and community participation.

CHAPTER-II
ORGANIZATION

1. Constitution of the Wildlife Force: This section includes all the rules and regulations related
to wildlife forces and officers.
2. Constitution of the Board: After the commencement of this act, the government shall establish
a board called Khyber Pakhtunkhwa Wildlife and Biodiversity Board consisting of a chairman
and a number of official and nonofficial members.
3. Functions of the Board:
1. Conservation and management of wildlife in the province
2. Review of the progress of development activities in the field of wildlife in the province
3. Appointment of officers
4. Biodiversity and Wildlife Fund: A Fund shall be established to be known as "Biodiversity and
Wildlife Fund" vested in the Board.
CHAPTER-III
HUNTING

This chapter includes rules and regulations about the following:


1. Restriction on hunting:
No person shall
1. Hunt any wild animal by m1eans of a set gun, deadfall, explosive, g bomb, grenade, baited hook,
net any other trap, an automatic weapon, or a weapon of a caliber used by the Pakistan Army or
Police Force or by means of a projectile containing any drug or chemical substance, likely to
anesthetize, paralyze
2. Hunt any Protected Animal;
3. Hunt any Game Animal except under a Big Game Hunting License, Small Game Hunting
License, Big Game Hunting Permit or Small Game Hunting Permit and in accordance with the
provisions of this Act and the rules made thereunder;
4. Hunt any game animal other than birds or hares with a shotgun or with non- magnum rifle of
0.22 caliber or less
5. Use or have in possession any device capable of electrocuting any wild animal or electrifying
any part of its habitat including water bodies and nesting places;
6. Use or have in possession any poison for killing any wild animal or poisoning its food and water
or part of any terrestrial or aquatic habitat;

2. Prohibition to employ hawks and dogs: use of hawks and dog is prohibited.

CHAPTER -IV
POSSESSION AND DISPLAY OF WILDLIFE

This chapter includes rules and regulations about the following:


1. Wild animals to be the property of the Government: All wildlife animals are the property of
the government
2. Animals found dead or hunted unlawfully: Animals found dead or hunted unlawfully are
also the Government’s property.
3. Certificate or Permit of animal display: No display of wild animals of any kind, live or dead
without a permit,
4. Cruelty to animals: Cruelty to animals is not allowed.
5. Transfer of animals: Transfer of animals as a gift, sale or otherwise is not allowed.

CHAPTER-V
TRADE AND TRAFFIC OF WILDLIFE

This chapter includes rules and regulations about the following:


1. Entrance and exit of animals: No person shall transport into the Province any animal of an
indigenous or exotic species, or any trophy, meat or derivative of a kind specified in sub-section
(1) of section 13, except under a permit granted by Government in a manner as prescribed by rules.
2. Dealing in animals and their produce: No person shall in animal trophies and their produce
3. Trade under CITES and CMS: Government regulates the trade of wild flora and fauna.
4. Alien species: Government regulates the entry and release of alien species in the province.
5. Release in the wild: No person shall release into the wild any exotic, alien, or diseased species
of fauna and flora in the Province.
6. Invasive species: Government may take measures to control invasive species to improve
indigenous species.

CHAPTER-VI
PROTECTED AREAS

This chapter includes rules and regulations about the following:


1. Wildlife Sanctuary: Government can declare any area as a wildlife sanctuary by a notification
where no person shall-
• Enter or reside,
• Cultivate any land,
• Damage or destroy any vegetation,
• Hunt, kill or capture any wild animal or fire any gun or other firearm within one mile of
the boundaries,
• Introduce any exotic species of animal or plant,
• Introduce any domestic animal or allow it to stray,
• Cause any fire
• Cause any pollution

2. Site of Special Scientific Interest: Government may, by notification in the official Gazette,
declare any area to be a Site of Special Scientific Interest.
3. Wildlife Refuge: Government or an officer authorized in this behalf may, by notification in the
official Gazette, declare any area to be a Wildlife Refuge where hunting of all wild animals shall
be prohibited.
4. National Park: Government or an officer authorized in this behalf may, by notification in the
official Gazette, declare any area to be a National Park.
5. Biosphere Reserve: Government or an officer authorized in this behalf may, by notification in
the official Gazette, declare any area to be a Biosphere Reserve.
6. National Heritage Site: Government or an officer authorized in this behalf may, by notification
in the official Gazette, declare any area to be a National Heritage Site.

CHAPTER-VII
PARTICIPATORY WILDLIFE MANAGEMENT

This chapter includes rules and regulations about the following:


1. Empowerment and benefit sharing
2. Private Game Reserve
3. Conservancy
4. Community managed Game reserves

CHAPTER-VIII
EX-SITU CONSERVATION OF WILDLIFE

This chapter includes rules and regulations about the following:


1. Wildlife Park
2. Zoological Garden or Zoo
3. Breeding Facility

CHAPTER-IX
POWERS OF OFFICER

This chapter includes rules and regulations about the following:


1. Issuing of licenses, permits, no objection certificate
2. Canceling of licenses, permits, no objection certificate
3. Power to establish check post
4. Search and arrest without warrant
5. Seizure and confiscation of case property
6. Disposal of case property
7. Prevention of commission of offence
8. Compounding of offence
9. Power of wildlife officers
10. Delegation of powers
11. Grant of Exemption
12. Revision of schedules, periods and fee

CHAPTER-X
TRIAL OF WILDLIFE OFFENCES

This chapter includes rules and regulations about the following:

8. Hunting in defence

11. Protection of action by officers

CHAPTER-XI
PENALTIES AND PUNISHMENTS

This chapter includes rules and regulations about the following:


Penalties:
1. Whoever contravenes or attempts to contravene the provisions of this Act shall be punished
as provided in the Fourth Schedule.
2. The person shall be punished with imprisonment which shall not be less than three months,
or a fine which shall not be less than ten thousand rupees or both, and his fire-arm, vehicle,
appliance, or anything used in the commission of the offence and his license, permit or
special permit issued under this act shall be cancelled and he shall not be eligible to such
Licence, permit, or a special permit, as the case may be, for a period of at least two years.
3. The property confiscated under sub-section (1) and the (2) shall become property of the
Government, and may be disposed of by the Department in a manner as may be prescribed.
4. For any other offence under this Act or the rules for which no specific penalty is provided,
the offender shall be punished with fine of rupees ten thousand or one month imprisonment
or with both.
