PROTEST
PROTESTANT, through the undersigned counsel and unto this
Honorable Court, most respectfully avers:
PREFATORY STATEMENT
At the onset, the proclamation of votes could not have been made
on the 30th of October. The counting of votes made it well into the early
morning hours of the 31st of October. We implore this honorable court
to take judicial notice of this for the exercise of suffrage is the exact
application of the political will of the people. The conduct of fair and
honest elections and the allowance for remedies promulgated by no
less than the Supreme Court should not be frustrated nor facts be
distorted to prevent resort thereto.

voters who actually voted was 1821 while the total votes for the office
of the Punong Barangay for the said Barangay was 1792, the
Protestee appearing to have received 722 votes, the Protestant 712
votes and the other registered candidate voted for, as follows:
6.a. For conduct in blatant violation of Section 206 of the Omnibus Election
Code which mandates the conduct of the counting of votes to be public
and without interruption. It was apparent that unnecessary breaks
occurred throughout the voting process (For the appreciation of the
Honorable Court, herein attached are copies of the affidavits of the
watchers, marked as ANNEXES “B”, “D”, “F”, “H”).
6.b. For acts or omissions violating Section 210 of the Omnibus Election
Code which mandates, in the manner of counting votes, the reading of
the names of candidates voted for and the offices for which they were
voted, assuming such a position as to enable all of the watchers to
read such names. The watchers were not able to check if the tallying
of votes was performed accurately as the teachers had their seating in
such as way as to obstruct visibility of the votes and/or the tally.

6.c. For acts or omissions violating Section 210 of the Omnibus Election
Code which mandates in the manner of counting votes that the reading
of the ballot and the recording of the vote on the tally board or sheet
and in the election returns are consistent and correctly accomplished.

6.d. For acts or omissions violating Section 211 of the Omnibus Election
Code mandating the rules for appreciation of ballots resulting in a
material number of loss of votes counted against Protestant’s favor.
The teachers misapplied the appreciation of ballots in disregard of the
clear intent of the voters and disregarding the rules of appreciation as
mandated in Section 211. (Please see ANNEXES “C", "D", "F", “M”).

6.e. For acts or omissions indicating instances of fraud against usual
practices or conduct during elections and as indicated in COMELEC
Resolution 10924 on Preliminaries of voting. This includes the
following instances: when

a) To the city treasurer of the City of San Pedro, Laguna, to bring and
present before this Honorable Court on or before the day of the
hearing of this protest the ballot boxes, copies of the registry lists, the
election statements, the voters’ affidavits, and the other documents
used in the said election in Barangay Rosario, in order that this
Honorable Court may re-examine and revise same;

Barangay Rosario be annulled and that the Protestant be declared
duly elected instead;
