PROTEST
PROTESTANT, through the undersigned counsel and unto this
Honorable Court, most respectfully avers:

PREFATORY STATEMENT

At the onset, the proclamation of votes could not have been made
on the 30th of October. The counting of votes made it well into the early
morning hours of the 31st of October. We implore this honorable court
to take judicial notice of this for the exercise of suffrage is the exact
application of the political will of the people. The conduct of fair and
honest elections and the allowance for remedies promulgated by no
less than the Supreme Court should not be frustrated nor facts be
distorted to prevent resort thereto.

SUBMISSIONS

1. Protestant Danrico T. Mindanao, Filipino, of legal age, with postal

address at 2nd Floor Mindanao Bldg. Blk 7 Lot 15 Rosario Complex
Main Rd., Rosario, San Pedro City, Laguna, Philippines where he may
be served with notices and legal processes of the Honorable Court.

2. Protestant is a qualified voter and was one of the registered

candidates voted for in the Barangay and Sangguniang Kabataan
Elections (BSKE) held on October 30, 2023 in the City of San Pedro,
Laguna, Philippines, within the jurisdiction of this court.

3. Protestee Lawrence V. Vicedo, of legal age, with postal address at

B24 Miraculous St. Rosario Complex, Barangay Rosario, San Pedro
City, Laguna, Philippines where he/she may be served with notices
and legal processes of the Honorable Court.

4. According to the certificate of canvass of the Barangay Board of

Canvassers of Barangay Rosario, City of San Pedro, Province of
Laguna (a copy of which is hereto attached as “Annex A”), the total

 voters who actually voted was 1821 while the total votes for the office
of the Punong Barangay for the said Barangay was 1792, the
Protestee appearing to have received 722 votes, the Protestant 712
votes and the other registered candidate voted for, as follows:

5. On October 31, 2023, the said Barangay Board of Canvassers

proclaimed the Protestee Fred Lawrence V. Vicedo elected to the
office of the Punong Barangay of Barangay Rosario, City of San
Pedro, Province of Laguna.

ALLEGATIONS AND DISCUSSIONS

6. The Protestant contests the election of the said Protestee on the

following grounds:

6.a. For conduct in blatant violation of Section 206 of the Omnibus Election
Code which mandates the conduct of the counting of votes to be public
and without interruption. It was apparent that unnecessary breaks
occurred throughout the voting process (For the appreciation of the
Honorable Court, herein attached are copies of the affidavits of the
watchers, marked as ANNEXES “B”, “D”, “F”, “H”).

6.b. For acts or omissions violating Section 210 of the Omnibus Election
Code which mandates, in the manner of counting votes, the reading of
the names of candidates voted for and the offices for which they were
voted, assuming such a position as to enable all of the watchers to
read such names. The watchers were not able to check if the tallying
of votes was performed accurately as the teachers had their seating in
such as way as to obstruct visibility of the votes and/or the tally.
(Please see ANNEXES “B”, “C”, “F”, “I”, “J”, “K”, “M”).

6.c. For acts or omissions violating Section 210 of the Omnibus Election
Code which mandates in the manner of counting votes that the reading
of the ballot and the recording of the vote on the tally board or sheet
and in the election returns are consistent and correctly accomplished.
(Please see ANNEXES “C", "D", "E", "F", "G", "H", "I", "K", "L”).

6.d. For acts or omissions violating Section 211 of the Omnibus Election
Code mandating the rules for appreciation of ballots resulting in a
material number of loss of votes counted against Protestant’s favor.
The teachers misapplied the appreciation of ballots in disregard of the
clear intent of the voters and disregarding the rules of appreciation as
mandated in Section 211. (Please see ANNEXES “C", "D", "F", “M”).

6.e. For acts or omissions indicating instances of fraud against usual
practices or conduct during elections and as indicated in COMELEC
Resolution 10924 on Preliminaries of voting. This includes the
following instances: when

a) the ballot boxes were not shown to be empty at the beginning of

the voting (Please see ANNEXES "B", "E", "F", "H", "K");
b) the minutes pertaining to one cluster was placed in another cluster
(Please see ANNEX “C”);
c) thumbmarks were not tallied with the ballots (Please see
ANNEXES "D", "F", “M”);
d) thumbmarks of voters were not read (Please see ANNEX “I”);
e) watchers did not sign the election returns (Please see ANNEXES
“D”, “E”, “G”);
f) The chairperson did not show the total of votes after the end of the
counting period (Please see ANNEX “E”);
g) The masterlist of voters were not tallied with the ballots to be
counted (Please see ANNEX "E", "K");
h) The reading was done in a hurried manner which prevented
complaints by the watchers when appropriate (Please see ANNEX
“G”);
i) The booklet showing total number of voters was not tallied against
the total votes (Please see ANNEX “H”);
j) Suspicious votes (Please see ANNEX “J”, “M”);
k) Unused ballots were not counted (Please see ANNEX “K”);
l) Others (Please see ANNEX “L”).

7. Protestant is willing to give a bond, as this Honorable Court may

determine to cover all reasonable expenses and costs and damages,
incidental to these proceedings.

PRAYER

WHEREFORE, premises considered, it is most respectfully

prayed unto this Honorable Court that an Order be issued:

a) To the city treasurer of the City of San Pedro, Laguna, to bring and
present before this Honorable Court on or before the day of the
hearing of this protest the ballot boxes, copies of the registry lists, the
election statements, the voters’ affidavits, and the other documents
used in the said election in Barangay Rosario, in order that this
Honorable Court may re-examine and revise same;

b) For for a recount of the votes;

c) That after due proceedings, the election of the Protestee Fred

Lawrence V. Vicedo for the office of the Barangay Captain of

 Barangay Rosario be annulled and that the Protestant be declared
duly elected instead;

d) That the expenses and costs incurred in these proceedings be

assessed against the Protestee.

4. Pagkatapos bilanging ang 1-131 ay biglang hininto ang pagbibilang upang ipag
tally ang sinusulat ng 3rd member at nang teacher at pinayagan kami lumabas sa
silid.
5. Pagkatapos bilangin lahat ng nasa balota, nagtanong ako kung mayroon
kailangan gawin o pirmahan sumagot naman ang teacher na wala na. Hindi po
ako nakapirma sa baranggay election return. Ang nasaksihan ko lang na may
pumirma ay yung sa mga SK.

4. Sa pagbabasa ng mga boto, ang teacher ay nakatagilid sa paraang hindi makita
ng watcher ang binabasa ng teacher.
5. Si Atty. Vange Arriba lang nagsabi na ilagay sa minutes ang nangyari sa Cluster
431 sa Cluster 430.
6. Ang bumoto ay 214 pero ang binasa lang ng teacher ay 212 at nag recount dahil
hindi nagtugma ang bilang ng tara ng third member at ng teacher.
7. HIndi pinabilang sa aming mga watchers ang listahan ng mga bumoto na may
thumbmark para itally sa mga balota

at makita ng watchers
7. Hindi binilang ang listahan ng mga thumb mark ng mga nakaboto para
maitally sa mga balota. Sinabi lamang ng teacher ang total.
