Subject: Pre-check of NIT No: TLMD I/07 of 2015 dt: 27-01-2015 for supply, installation, testing &
Commissioning of 4No. 132KV C&R Line Panels at Grid Station Bemina.
Sir,
The Para-wise reply to the observations raised by Dy. Financial Advisor & CAO PDD Srinagar is
given here under.
1. The e-NIT for supply, installation, testing & commissioning of 4No. 132KV C&R Line Panels at
Grid Station Bemina has been issued in view of urgency of permanent restoration of assets of
Grid Station Bemina damaged due to September 2014 floods, to ensure the healthiness of the
protection system of the Grid Station. The procurement of these panels through Procurement &
Material Management Wing of PDD would have been a time consuming process. Besides this it
was instructed by the Principal Secretary PDD vide minutes of meeting circulated vide No
DC/PD/Sts/202/JK/2014-15/326-28 dt 01-01-2015 that the restoration works should be
completed within shortest period.
2. The NIT for “Supply, Installation, Testing & Commissioning of 4No. 132KV C&R Panels at Grid
Station Bemina” has been issued at Divisional Office level as per instructions conveyed vide
letter Nos. CE/SOK/T-6871-74 dt: 30-12-2014 and SE-I/S&O/2185-86 dt: 01-01-2015.Further the
works are of two different divisions for different locations and were tendered out through two
NITs published on different dates. The clubbing of the two NITs would have had no effect on the
sanctioning authority competence. The job was beyond the competence of Executive Engineers
and well within the competence of Superintending Engineer even if clubbed.
3. M/S Amtek Energy & Power Pvt. Ltd. had not furnished the test certificate with the bid. For
maximum participation of bidders in financial bid, the bidder was asked to furnish the requisite
test certificates. In response the bidder furnished CPRI test certificates & catalogue of Schnieder
make & Alsthom make relays. In addition the bidder submitted the satisfactory performance
certificate of project “design, engineering, supervision, supply, installation, testing &
commissioning of 132KV Switchyard including distance relay protection” for M/S Larson & Turbo
Ltd.

4. M/S Hydro Magus Pvt. Ltd., in the uploaded techno-commercial bid has submitted performance
certificate of 2No. C&R Panels supplied and commissioned by his joint venture partner M/S
Nelumbo Icona Control Pvt. Ltd. in October 2011. Again for maximum participation in financial
bid to ensure reasonability of rates, the bidder was asked to furnish the requisite documents of
similar equipment supplied/commissioned, year 2011 onwards vide this office letter No: TLMD
I/1503-04 dt: 14-03-2015. In response the bidder furnished past Purchase Orders of his joint
venture partner/manufacturer M/S Nelumbo Icona Controls Pvt. Ltd. during the period 2012-14.
The Bidder has supplied Simplex Type Relay Protection Panels for 132kV UPPTCL Project which
included 06 nos Simplex Type C&R Panel and 06 nos Simplex Type Distance Protection Panel in
2012.

M/S Amtek Energy & Power Pvt. Ltd. had not furnished the test certificate with the bid.
For maximum participation of bidders in financial bid the bidder was asked to furnish the
 requisite test certificates. In response the bidder furnished CPRI test certificates & catalogue of
Schnieder make & Alsthom make relays. In addition the bidder submitted the satisfactory
performance certificate of project “design, engineering, supervision, supply, installation, testing
& commissioning of 132KV Switchyard including distance relay protection” for M/S Larson &
Turbo Ltd.
During the meeting called for deliberation of techno-commercial bids, it was decided that
all the relevant documents required for opening of the financial bids of the participants were
purely asked for greater response and participation in the process for competetive rates.

5(a). The tendered work has been published on http://jktenders.gov.in e-tendering portal for vide
publicity. The tenders published on the e-tendering portal are freely accessible all over the
country and outside to interested bidders.
Also, the e-Nit No:TLMD-I/07 of 2015 dt:27-01-2015 was sent to Dy. Director Information
Srinagar vide letter No: TLMD-I/TS/364-66 dated: 28-01-2015 for wide publicity by publishing in
leading newspapers. The NIT was published in Greater Kashmir on 2nd of February 2015. Due to
poor response, the NIT was extended by eleven days upto 02/03/2015 & extension notice was
again sent to Dy. Director Information vide No:TLMD-I/TS/374-77 dt:19-02-2015 for publishing in
leading newspapers. As such a reasonable time of one month from 02/02/2015 to 02/03/2015
was given to the interested bidders for the submission of documents.

(b) Five number bidders uploaded their bids, out of which M/S JK Engineers failed to furnish the
requisite hard copy of techno-commercial bid and as such his bid was rejected. The remaining
four bidders qualified the techno-commercial bids and their financial bids were opened
accordingly. The participation of three common bidders in two different NITs is not objectionable
& the rates offered for similar natured jobs are different not because of splitting of the NITs but
due to the fact that the panels in the two NITS are of different specifications. The NIT No. TLMD-
I/07 issued by this Division is for 4No. line panels required at Grid Station Bemina. On the other
hand the NIT No:TLMD-II/02 is for 2No. feeder & 2No. transformer panels required at Grid
Station Wanpoh.
(c) The tenders were kept under the safe custody of http://jktenders.gov.in e-tendering portal. This
e-tendering portal provides all safety regarding access to the bids uploaded. Initially the NIT is
uploaded by the authorised officers to whom the digital signatures have been issued. The
interesting bidders having digital signatures are able to down load the standard document and
upload the prices in the BOQ. Later the techno-commercial bids are opened only by the
authorised officers who have uploaded the NIT and it is only after finalizing the techno-
commercial bids and financial bid opening date, the financial bids can be opened. As such the
question of safety of bids does not arise.
(d) The cost of tender documents has been deposited in Govt exchequer under revenue
miscellaneous head.
6. The work of replacement of damaged 132kV panels of Grid Sub-station Bemina was approved by
the Principal Secretary to Govt, JKPDD vide DC/PD/STS/202/J/K/2014-15/326-328 dated 01-01-
2015. The NIT has been floated vide No: CE/SOK/T-6871-74 dt: 30-12-2014 for permanent
restoration of assets damaged at Grid Station Bemina due to September 2014 floods. The
requisite funds have been projected in flood damage reports & funds are expected to be allotted
during the current financial year. The technical sanction of the works is under progress and is
expected shortly.
7. The EMD @2% of estimated cost has been furnished by all the bidders.
8. (i). The bidders have accepted the validity of offers as 365 days.
(ii). The rates quoted by all bidders are firm.
(iii). The rates quoted are inclusive of all the taxes & duties.
9. The advertised estimated cost of Rs.50.08 Lacs has been worked out as per cost data for the year
2006-07 issued by Chief Engineer P&D Wing Jammu. The NIT No. TLMD-I/07 issued by this
Division is for 4No. Line panels required at Grid Station Bemina. On the other hand the NIT
No:TLMD-II/02 is for 2No. Feeder & 2No. Transformer panels required at Grid Station Wanpoh.

In view of these clarifications, it is evident that the rates offered by the lowest bidder viz,
M/S Hydro Magus Pvt. Ltd. are reasonable & realistic. Submitted for favour of further necessary
action at your end please.
