Judge: Samsung Infringed on Apples Patents

Apple has filed 20 lawsuits against Samsung in ten countries, seeking to ban sales of Samsungs tablet, alleging patent infringement and brazen copying Apples designs. While Samsung has denied the charges, Apple has so far been successful in arguing their legal case. To date, Samsungs Galaxy tablet has now been banned from being sold in the United States, UK, European Union and as of a few days ago, Australia. The dramatic highlight of the trial against Samsung in California occurred when Judge Koh held the Galaxy Tab and iPad tablets above her head, and asked Samsungs lawyer Kathleen Sullivan if she could tell the difference between the two devices. Can any of Samsungs lawyers tell me which one is Samsung and which one is Apple? Koh asked. Sullivans reply was honest, but sealed Samsungs fate: Not at this distance, your Honor. Sullivan was standing just ten feet away from Judge Koh. When Samsung released iPad knock off, most of the one million units sold during the first six months on the market were to the distribution channels and not to end users or companies. Less than a stellar hit, disappointing sales prompted Samsung to go back to the drawing board and re-design the product again. The real sales figures have painted a dismal picture for Samsung, in addition to the legal injunctions Apple has won against the company. Lenovos Andrew Barrow, who is the Director of Consumer Products and Pricing for all of Western Europe, disclosed that despite claims of selling one million Galaxy Tabs, Samsungs real sales figures were closer to 20,000 units. Barrow made his comments in early September, after disclosing the fact that Samsung was giving money away by selling their product at a loss.

By comparison, Apples iPad has sold over 30 million units, Apples profit margins on the device also lead the industry due to their engineering and inclusion of a single customized integrated chip, instead of relying on off the shell parts to build it like its competitors do. It is the re-design of the Galaxy Tab that now has the South Korean electronics giant in serious trouble. Ever since Apple sued Samsung, it has successfully managed to obtain legal injunctions against it, keeping it from selling its tablets in the UK, European Union, United States and Australia markets. 1.0v1 Oct 19, 2011 Kal K.
