5.2.

21 Tenant Fitout Contractor (TFC) requirements


The Lessee must maintain and ensure that its contractors maintain:

1. In the name of the Lessee and the Lessor and, if required by the Lessor, any other person, for their
respective rights and interests in the amount required by the Lessor:
• Public Liability Insurance to the amount of BHD 500,000
• Contractors’ All Risk policies in respect of the Lessee’s Works, Plant and Equipment. CAR to
cover Third
Party Property Damage and Damage to Adjacent Property to a minimum value of BHD 500,000
• Workers Compensation in respect of all persons employed in connection with the Lessee’s
Works and related employer’s liability extension for at least BHD 100,000 for each and every
incident.

2. Any other insurance policies which are required by law or which in the Lessor’s discretion (acting
reasonably) are required in connection with the undertaking of Lessee’s Works and all persons
employed in connection with any of the Lessee’s Works.

3. The insured will comply with the requirements of MRE 112 and will not deviate therefrom without
prior
approval from the Main Works insurance provider.

4. Each of the policies effected and maintained by the Lessee and its contractors must:
• For public liability, Contractor all risk and Contractor equipment insurance policies contain a
non-invalidation endorsement.
• Contain a waiver of subrogation clause against the Landlord, and /or its subsidiaries and /or
associated
firms and / or parent companies and /or sister companies and/or directors and /or officers
and/or employees and any other person nominated by the Lessor.
• Be with an insurance company registered in the Kingdom of Bahrain and otherwise, approved
by the Lessor (acting reasonably); and be on terms and otherwise for an amount reasonably
satisfactory to the Lessor.
• The Lessee acknowledges and agrees that the proceeds of any insurance claim to be used for
replacement or reinstatement of the insured item unless advised otherwise by the Lessor.
• In respect of the insurances required by this clause the Lessee agrees to and ensure that its
contractors:
» When asked to do so, give the Lessor evidence that it has complied with the relevant
clauses.
» Notify the Lessor immediately if a required insurance policy is cancelled or an event
occurs which may allow a claim or affect rights under an insurance policy in connection
with the Premises, the Centre or property in them.
» The Lessee agrees to produce evidence satisfactory to the Lessor of current insurance
cover (including a certificate of currency or certified copy of each policy) and whenever
the Lessor asks (acting reasonably). The Lessee must ensure that its contractors do the
same in compliance of the aforesaid.
