AGREEMENT

THIS AGREEMENT is made and entered into at Colombo in the Democratic Socialist Republic of Sri Lanka on
12th day of December 2023

BETWEEN

Mr. ASLAM KHAN (953370980V) Director of Shine Institute situated at 20 E, Sri Saranankara Road, Kalubowila,
Dehiwala (hereinafter called and referred to as “THE PARTY OF THE FIRST PART”);

AND

Ms. Dilshani Praboda Jayasinghe (977713870V) of No. 129D, Karandagahawatta road, Pokunuwita Hereinafter
called and referred to as “THE PARTY OF THE SECOND PART”.

WITNESSETH

WHEREAS the said educational institute desires to engage the services of Teacher to be part of this institute for
teaching in Shine Institute.

AND WHEREAS the party of the Second Part accepts the offer of the Shine institute under the terms and
conditions of the Agreement herein;

WHEREAS the party of the Second Part agrees to conduct classes in the online platform.

The party of the second part hereby agrees to start working from 12th December 2023 as a Part time employee
for a year (includes 3 month probationary period and renewed annually)and shall continue until the parties notify
each other with regards to the termination or material breach of this Agreement herein.

NOW IT IS HERE BY AGREED AS FOLLOWS;

Duties and responsibilities

Position – Economics/Accounting

a) The party of the second part agrees to work to the best of his/her ability within the proper guidelines set
forth by the party of the first part and maintain a good relationship with students.
b) The party of the second part undertakes to cover Theory, examination papers, revision on due time and be
updated on the syllabus.
c) The party of the second part undertakes to set exam papers for students to examine their performance and
to submit their examination results in evaluation.
d) The party of the second part agrees to inform the party of the first part on or before 25 th of the particular
month if additional classes are to be conducted in upcoming month.
e) The party of the second part undertakes to be updated on the subject area and maintain a healthy
relationship with students ensuring an effective learning.
f) The party of the second part agrees not to conduct classes for a considerable period of time upon the
instruction of party of first part.
g) The party of the second part agrees to conduct unit test half the payment of fees will be paid.

SCHEDULE

The party of the second part hereby agrees to conduct classes by switching the camera on via online platform
and to share the recordings after every class. The party of the second part hereby agrees to be available online
10 minutes prior to the commencement of the session ensuring his/her availability on the time slots shared by
the party of the second part.

The party of the second part hereby agrees to use SIS (LMS) System for login.

RESCHEDULING CLASSES

The party of the second part hereby agrees to inform the party of the first part one day prior via email
(shineinstitute19@gmail.com) with due notice. And the party of the second part undertakes not to re schedule
classes without proper reasons.
PAYMENT

The party of the first part hereby undertakes to pay 70% from the total fee for the group class for Graduates and
60% from the total fee for the group class for Undergraduates.

The parties hereby mutually agree to decide individual class rates as Agreed herein;
a. O/L individual classes Cambridge & Edexcel (Rupees thousand seven hundred and fifty)
b. AS & AL Individual classes Cambridge & Edexcel (Rupees Two Thousand five hundred per class)

The party of the second part agrees not to have communication regarding tuition fees individually with kids or
parents and the authority to decide solely lies on the party of the first part and payment for the classes will be
paid only by the party of first part.

TERMINATION
occurs continuously for two months. And also the party of the first part undertakes to terminate the employment
of the party of the second part without prior notice when the party of the second part converts the classes into
his/ her own private classes at the time of employment in the said institute.
NOTICE
When the party of the second part wishes to resign after the probationary period one-month prior notice should
be given in writing. The party of the first part undertakes to pay the arrears only upon one-month prior notice.
The party of the first part undertakes to terminate the employment without any notice in cases of gross misconduct
from the party of the second part.
CONFIDENTIALITY

The party of the second part agrees not to undertake or engage in any task that is in conflict with the interests of
the party of the first part. The party of the second part hereby agrees not to disclose any information of a
confidential nature to unauthorized persons within or outside the institute during or after the employment period.
By signing this contract, the party of the second part agrees to comply with the terms of the Employer’s business
conduct and ethics policy in accordance with the laws of Sri Lanka.
IN WITNESS WHEREOF the First Part and the party of the Second Part hereto do hereunto and another of the
same tenor and date as this Agreement set their respective hands at the place and on the day month and year
hereinbefore mentioned.
