What is an Emergency Arbitrator?

- The ICC Arbitration Rules offer an efficient procedure for parties to seek

emergency measures.

- This procedure offers a short-term solution for parties that are unable to wait

for the constitution of an arbitral tribunal.

- Any emergency measure granted takes the form of an order.

- The order may be later revisited by the arbitral tribunal once constituted.

Truncated arbitration

When a party-appointed arbitrator refuses to participate in a tripartite tribunal’s

work or submits resignation with insufficient reason.

If these situations occur early in the proceedings, they are usually resolved by

filling the vacancy in the same way as the original appointment. However, appointing a

new arbitrator might under some circumstances be impractical and inappropriate,

especially if the situation has arisen towards the end of the proceedings.

The only sensible option, the two remaining arbitrators to continue without the

participation of the third arbitrator. The tribunal is in these situations referred to as a

truncated arbitration

UNCITRAL Model Law UNCITRAL Arbitration Rules

The Model Law is designed to assist States provide a comprehensive set of procedural

Fast track arbitration according to the latest Rules of Arbitration of the

International Chamber of Commerce (ICC) /2017&2021.

- New provisions are aimed at reducing the cost and increasing the transparency

of ICC arbitration.

- The most significant development is the introduction of bespoke rules for

expedited arbitration.

- These apply automatically to disputes of amounts less than USD 3 million

arising out of agreements.
