Mr. Sanjay Bhatt, learned counsel for the
applicant.
2. Mr. S.C. Dumka, learned A.G.A. for the State.
3. A second bail application has been moved by the
applicant, who is in custody in connection with F.I.R.
No.34 of 2020, under Section 8/20 of N.D.P.S. Act, 1985
in Police Station Champawat, District Champawat.
4. Facts of the case are that the applicant was found
in possession of 5 kg. 710 grams of charas when he was
intercepted by the Police party on 16.12.2020.
5. The first bail application of the applicant was
rejected by this Court on 18.06.2021 mainly, on the
ground that he was found in possession of commercial
quantity of charas by Co-ordinate Bench of this Court.
6. In the second bail application, this Court is aware
of the fact that there is very limited scope to interfere, but
learned counsel for the applicant argued that the
applicant has already spent three years in custody and the
trial is still not concluded.
7. List this case on 09.01.2024 enabling learned
counsel for the State to get instructions regarding the
stage of trial.
