Sarita Vihar New Delhi do hereby solemnly affirms and declare as

1. I say that I being the Plaintiff No.1 is filling this petition for

succession certificate u/s 372 of Indian Succession, Act for

grant of succession certificate in respect of movable property

left by Shri Kartar Singh as follows under:-

2. I say that I am residing at E-11, Pocket E, Sarita Vihar New

Delhi, and I am the son of Late Kartar Singh.

3. I say that state that my father Late Shri Kartar Singh has

expired on dated 02nd July 2021 at above mentioned

residence. I say that my father was the legal owner of the Flat

no. R/o E-8, Pocket E, Sarita Vihar, New Delhi.

4. I say that my mother i.e wife of the deceased Late Shri

Kartar Singh has also expired on 15th July, 2021 at their

residence R/o E-8, Pocket E, Sarita Vihar, New Delhi. Thus, I

Plaintiff No.2 i.e Sarabjit Singh and Defendant No.4 i.e Kanwal

Pal Singh are the legal heirs of Late Kartar Singh and Late

Harbhajan Kaur.

5. I say that after my parents died on the date mentioned

above intestate plaintiffs and defendant, is the legal heirs as per

Hindu Succession Act, 1956 of movable properties of Late Shri

Kartar Singh.

6. I say that the defendant lives and reside at the residence of

Late Shri Kartar Singh that is E-8, Pocket E, Sarita Vihar,

New Delhi.

7. I say that defendant is in exclusive possession of the

properties mentioned in para 1.

8. I say that I am the Class-I legal heirs of Late Shri Kartar

Singh and they are entitled to claim equal share over the

aforesaid movable property.

9. I say that despite requested and demand, the defendant

keep on delaying the matter for reasons known to him.

Defendant have breached the promise to equally share or

handover the aforesaid movable suit property.

10. I say that I have not filed any type of succession certificate

in any court nor filed any probate or letter of administration.

Late Shri Kartar Singh died intestate and the plaintiffs are

entitled to grant the succession certificate.

11. I say that this court has jurisdiction to try, entertain and

dispose of the said petition.

12. I say that I have affixed the proper court fee stamp to the

application

13. I say that copy of Death certificate of my father namely Late

Kartar Singh is exhibited as PW1/1, copy of death certificate of

my mother namely Late Harbhajan Kaur is exhibited as PW1/2,

copy of list of movable properties/bank account details is

exhibited as PW1/3, copy of list of LR’s of Late Kanta is

exhibited as PW1/4, copy of Aadhar card is exhibited as

PW1/5

14. I say that Petition filed by me is correct and bears my

signature at Point A.
