ASSIGNMENT CRIMINAL JUSTICE 100 marks

It is expected that Namibian Case Law is used for each ground, where there are lacking
facts you must invent such. The 17th of May 2023 2pm is the due date at the JTC offices
to Ms Farmer or Ms English

QUESTION:

On 7th of April 2023, Mark Jones heard a voice at his kitchen door at his house in
Swakopmund, Tamariskia at 80 Amuranta street.

He got up at 3 am. He forgot that his son Simon Jones went out clubbing.

Mark Jones got up grabbed his gun a silencer A4500, and went to look what noise he
heard.

He saw a person moving in the corridor Mark Jones asked who it was. The person
remained silent.

He could clearly see a person’s shadow in the moonlight that was shining through the
window. The shadow was coming closer to him Mark Jones. Mark Jones then faced the
person and shot 3 times. The person immediately collapsed. Mark Jones switched on
the light and realized he killed his son (at the same time his wife + 3 other children of
ages 16, 18, 21 were in the house and heard him shouting who is there.)

Mark Jones has been arrested for murder, Mark Jones is an entrepreneur he has 4
Businesses with a net value of 3 million Namibian Dollars pertaining to each business.

An Angolan citizen owns a passport, has a pending drunk and driving case, no previous
convictions.

Draft a formal bail application via affidavit.

It is known that the state is objecting to bail on the following grounds:

1. Fear of abonnement he is a foreign national.


2. Interest of society.
3. Administration of Justice
4. Serious office
5. Pending Case
6. Interference with state

Draft an affidavit for the bail application which will be lodged on behalf of the
Applicant.
