SUMMARY
Climate Change Legislative and Regulatory
Impacts
on Clean Agent Fire Protection
EU
ƒ Kyoto Protocol >>> EU-F-gas Regulation (Regulation EC
No.842/2006 in force 7/04/07)
ƒ Addresses containment, use, recovery, etc. of industrial fluorinated
gases including HFCs, PFCs and SF6.
ƒ Results in higher cost for systems using HFC’s (registration,
maintenance & service)
ƒ Applicable for all HFC´s and PFC´s but NOT for Novec 1230 Fluid
ƒ Denmark & Switzerland
ƒ HFCs banned for fire protection.
ƒ Norway
ƒ Enacted tax on imports of HFCs.

OTHER
ƒ Australia (SGG & ODS Management Act)
ƒ Consistent definition of target gases including HFC-227ea and HFC-
125; import HFCs and PFCs of $165 per metric ton.
ƒ India
ƒ Government to provide an incentive for manufacturers and importers to
reduce environmental impact of products, including fire extinguishers.
ƒ Montreal Protocol Control Measures – Class I (CFCs, halon)
ƒ Halons phased-out in developing countries by 2010.
ƒ (See details below)

Climate Change

ƒ International
ƒ Montreal Protocol
• Proposals by US and others were considered at the 2009
Meeting of Parties in November that would have added
HFCs to the Montreal Protocol and controlled their
production
• Controls would be similar to ODS (CFCs and halons), but
production would be phased down slowly and not phased
out completely

ƒ Montreal Protocol Proposals for HFC Phase-down

• Mauritius and Micronesia:
- freeze in 2012 - 60% in 2024
- 15% reduction in 2015 - 75% in 2027
- 30% in 2018 - 90% in 2030
- 45% in 2021 2004-2006 baseline)

• United States, Canada and Mexico:

- 10% reduction in 2013 - 70% in 2029
- 20% in 2017 - 85% in 2033
- 30% in 2020 Developing Countries: 10% in 2016
- 50% in 2025 85% in 2043

Climate Change

ƒ Montreal Protocol (Cont’d)

ƒ US and EU supported the carry over of HFCs
ƒ Proposals not expected to be approved. Instead they
were killed due to opposition from China and India among
others
ƒ Reasons HFC amendments not approved:
• Not enough time to fully educate Parties on proposal
• Not enough information on HFC alternatives
• Timing not right – Wait for Copenhagen outcome
• Developing countries unsure of cost issues associated
with the accelerated HCFC phase out
• Scope: UNFCCC/Kyoto, not the Montreal Protocol
ƒ Expected that US, Canada and Mexico will re-propose
HFC amendment for consideration at 2010 Meeting of
Parties (October in Uganda?)
ƒ US seems optimistic, but others think it may take 2 more
years to get approved

SUMMARY
Climate Change Legislative and Regulatory
Impacts
on Clean Agent Fire Protection
US
ƒ USEPA (U.S. EPA 12/20/02 Federal Register)
ƒ “(FK-5-1-12/Novec 1230) provides an improvement over use of
halon 1301, hydrochlorofluorocarbons (HCFCs) and
hydrofluorocarbons (HFCs) in fire protection. We find that C6-
perfluoroketone is acceptable because it reduces overall risk to
public health and the environment in the end use listed.”
ƒ U.S. Supreme Count Decision (4/07)
ƒ HFCs are a pollutant under the Clean Air Act
ƒ EPA ANPR (6/08)
ƒ Authority under climate legislation may be preferable to CAA.
ƒ Four Major U.S. Legislative Proposals
ƒ There will be a substantial $ penalty to produce HFCs for fire
protection.
ƒ California – Assembly Bill-32 (CARB)
ƒ Replacement of high global warming potential (GWP) gases
used in fire protection systems with alternate chemical(s).
ƒ MN Legislation – SF-3337
ƒ Manufacturers must report total of each high GWP gas sold in
the state.

3M™ Novec™ 1230 Fire Protection Fluid

United States (Cont’d)

ƒ American Clean Energy and Security Act of 2009 (H.R.

2454, ACES, Waxman-Markey)
ƒ Includes four titles covering Clean energy, Energy

Efficiency, Global Warming Pollution, and Transitioning to

a Clean Energy Economy
ƒ Title III (Reducing Global Warming Pollution) amends the
Clean Air Act (CAA) to establish an economy-wide cap-and-
trade program covering 85% of US greenhouse gas (GHG)
emissions

ƒ ACES (H.R. 2454)

ƒ Intended to reduce covered GHG emissions by 3% below
2005 levels in 2012, 17% in 2020, 42% in 2030, and 83%
below 2005 levels in 2050
ƒ Covered entities include large industrial sources that emit
more than 25,000 metric tons (MT) of GHGs in a year
ƒ Bill passed the House of Representatives on June 26 by a

219-212 vote.
ƒ Bill did not pass the Senate but appears to be the model for
future climate legislation

ACES (H.R. 2454)- Cont’d

ƒ HFC Provisions
ƒ Hydrofluorocarbons (HFCs) are covered separately from other
GHGs by amending Title VI of the Clean Air Act, which currently
regulates ozone-depleting substances (ODS)
ƒ Overall production of HFCs is phased down 85 % beginning in
2012 and ending in 2032
ƒ Labeling
• Products containing or made with HFCs would be required
to be labeled with the phrase “contributing to global
warming”
ƒ Allowances
• Allowances are required to produce/import HFCs, or import
products containing HFCs.

ƒ HFC Provisions – CBO Allowance Cost Estimates

ƒ At $2.00 /metric ton (2012) and $10.00 (2015):
Added product cost/lb =
2012 2015
• HFC-4310mee $1.49 $7.45
• HFC-365mfc $0.72 $3.6
• HFC-245fa $0.93 $4.6
• HFC-134a $1.30 $6.5

• HFC-227ea $2.92$ $14.6
