Article 240 of the Labor Code : Equity of the incumbent. All existing
federations and national unions which meet the qualifications of a
legitimate labor organization and none of the grounds for cancellation
shall continue to maintain their existing affiliates regardless of the
nature of the industry and the location of the affiliates.
The Labor Code contains several provisions which are beneficial to labor.
It prohibits termination from employment of Private employees except
for just or authorized causes as prescribed in Article 282 to 284 of the
Code. The right to trade union is expressly recognized, as is the right of a
union to insist on a closed shop.
Strikes are also authorized for as long as they comply with the strict
requirements under the Code, and workers who organize or participate
in illegal strikes may be subject to dismissal. Moreover, Philippine
jurisprudence has long applied a rule that any doubts in the
interpretation of law, especially the Labor Code, will be resolved in favor
of labor and against management.
Article 241 section c states that: (c) The members shall directly elect
their officers, including those of the national union or federation, to
which they or their union is affiliated, by secret ballot at intervals of five
(5) years. No qualification requirements for candidacy to any position
shall be imposed other than membership in good standing in subject
labor organization. The secretary or any other responsible union officer
shall furnish the Secretary of Labor and Employment with a list of the
newly-elected officers, together with the appointive officers or agents
who are entrusted with the handling of funds, within thirty (30) calendar
days after the election of officers or from the occurrence of any change
in the list of officers of the labor organization; (As amended by Section
16, Republic Act No. 6715, March 21, 1989).
Consequently, unfair labor practices are not only violations of the civil
rights of both labor and management but are also criminal offenses
against the State which shall be subject to prosecution and punishment
as herein provided.
