MOTION TO WITHDRAW CRIMINAL COMPLAINT

MOVANT, JOHN FERNANDEZ Y ORIENTE, by himself, and

unto this Honorable Office, respectfully states that:

1. On ________ herein accused, who was then driving a Toyota Hi Ace van
with plate number _________, owned and registered under the name of
___________ accidentally hit and bumped the farm implement (kuliglig) owned by
the undersigned along the national highway of Barangay Minagbag, Quezon,
Isabela;

2. Consequently, as a result of said incident, the undersigned suffered slight

physical injuries and the said farm implement (kuliglig) was likewise damaged
with an estimated cost of Six Thousand Seven Hundred Pesos (PhP6, 700.00);

3. Apparently, the undersigned was able to talk to the accused in this case
and the latter promised that he will already shoulder the expenses for the repair of
the said farm implement and that he will likewise give financial assistance to me in
the amount of Five Thousand Pesos (Php5,000.00);

4. However, it came to my knowledge that members of PNP Quezon Police

Station, Quezon, Isabela already forwarded the criminal complaint before this
Honorable Office;

5. That in view of the said circumstances, the undersigned now prays that the
Criminal complaint which I filed against herein accused, __________-and which
was received by this Honorable Office on February 5, 2020 be now
released/withdrawn from its records and to be returned to the undersigned movant,
in as much as there has already been a settlement between us.

 WHEREFORE, premises considered, it is respectfully prayed unto this
Honorable Office for the criminal complaint along with its attachments be
withdrawn from its records and be returned to the undersigned movant.
