WHEREAS, the protection and promotion of the health, and the right to a clean
environment of its constituency is the primary concern of the City;

WHEREAS, it is the policy of the City to promote the conservation, protection and revival
of the ecosystem through prevention, control and abatement of air, water and land pollution,
nuisance, and spread of hazardous wastes in the environment, hand-in-hand with the sustained
development of the City;

WHEREAS, the city council being the tegislative body of the city and as mandated by
the Local Govemment code of r99r, has enacted and approved ordinances, in addition to and
in adoption of laws passed by the national govemment to protect the environment and impose
appropriate penalties for acts which endanger the environment;

WHEREAS, there is a need 1o update, integrate and codify these environmental laws to
ensure that they are in consonance and in keeping with modem standards of environmental
laws, and provide a comprehensive reference and guide for their implementation and
enforcement;

CHAPTER ONE
GENERAL PROVISIONS

sEcrloN 1. TIrLE - This code shall be known as the Environmental protection,


Conservation and Management Code of Valenzuela C shall be commonly refe to
as the "Environment Code of Valenzueta C ity".

SECTION 2. STATEIIIENT OF VISION FOR THE ENVIRONMENT OF VALENZUELA c|w.


valenzuela city envisions a progressive city, enjoying and sustaining its natural resources
through its clean, green and vigorous environment'.

SECTION 3.
OPERATIVE PRINCIPLES -This code is based on the vision, mission, goals and
objectives of the city to attain sustainable development based on the following principles:

a) The right to development must be fulfilled so as to equitably meet developmental and '
environmental needs of present and future generations;
b) ln order to achieve sustainable development, environmental proteciion shall constitute
an integral part of the development process and cannot be mnsidered in isolation from
it;
c) Active participation of all residents to attain sustainable development;
dl The use of environment-friendly and appropriate technologies is a basic foundation for a
heahhy and progressive generation;
e) climate change is a reality and adaptation and mitigation to its impacts can be
addressed by intensifying preparedness through access, availability and provision of
accurate information and skills to the people of Valenzuela City;
f) The polluter shall bear the cost of pollution;
gl The state shall protect and promote the right to health of the people.

CHAPTER TWO

LEGAL MANDATES
NATIONAL AND LOCAL LAWS AND POLICIES

sEcrloN 4. Il,landates and Legal Basls. - The adoption of this 2018 Environment code is in
line with the Valenzuela City's policy to promote the conservation, protection and revival of the
ecosystem through prevention, control, and abatement of air, waler, landpollution and nuisance
as embodied in the following national and local laws and policies:

1) Republic Act (R.A.) 1{o. 7160 Local Govemment Code of 1991;

5) Presidential Decree No. '1067. This Code shall be known as The Water Code of the
Philippines;

6) Presidential Decree No. 856, otheMise known as the Sanitation Code of the
Philippines;

GHAPTER THREE
DEFINITION OF TERMS

Abattoir or Slaughterhouse - the establishment or premises used in the slaughter of food


animals for human consumption.

Accommodation & Entertainment Establishment - refers to restaurants, fast foods,

relaxation and rest, offering foods, sleeping accommodation and recreation facilities to the
public for a fee;

Administrative penalty - a legal mechanism that allows the local government to penalize lhe
violation of this ordinance, which consist of the imposition of monetary fine. lt is intended to
provide an alternative enforcement mechanism that is more cost- effective, timely and practical
than prosecuting the offender through the court system.

Ambient noise - is the composite of noise from all sourc€s near and far and in given ,
environment, exclusive or occasional and transient intrusive noise sources and of the particular
noise sources to be measured.

any land, building or struciure used for the keeping, stabling, feeding,
watering, grooming, shoeing, treatment of an animal, or any other veterinary purpose.

Arbor Day - a day dedicated annually to public tree-planting.

Biodiversity -is the variabilily among living organisms from all sources, including terrestrial,
marine and other aquatic ecosystems and the ecological complexes of whichthey are part; this
includes diversity within species, betureen species, and of ecosystems

Black-crowned night hercn - the bird, scientifically known as Nycticorax nycticorax and locally
known as "bakaw gabi" which has found its habitat in Barangay Malanday and other parts of
the City of Valenzuela

Combined Drainage System - this is the conveyance of wastewater from the drainage through
the interceptor lines going to the Sewage Treatment plants.

commercial Establishment - an establishmenl used for commercial purposes, such as bars,


restaurants, private offices, fitness clubs, oil rigs, retail stores, banks and financial institutions,
supermarkets, auto and boat dealership, and other establishments with common business area;
provided thal the term "commercial establishment' shall not include a multi-unit permanent or
temporary dwelling where private home viewing occurs, such as holels, dormitories, hospitals, ,
apartments, condominiums and prisons, all of which shall be subject to the rates applicable to
private home viewing.

motorcycle vehicles.

Decibels - Will refer to the units of volume indicated in a decibel meter.

Designated smoking Area - refers to a designated smoking area within a building, which may
be in an open space, or a totally enclosed delineated room or area with proper ventilation inside
an accommodation and entertainment establishment or enclosed public place where a person is
allowed to smoke without violating the Ordinance. 1) Accommodation and entertainment
establishments or enclosed public places with air conditioning facilities shall establish and
designate a smoking area or room that is fully ventilated and separate from the rest of the
premises where smoking is prohibited. 2) Designated Smoking Areas in Accommodation and
entertainment establishments or enclosed public places shall prominenfly display 'SMOKING
AREA" signages. Non-smoking areas shall likewise have legible, highly visible, and prominenfly
displayed "NO SMOKING AREA" signages.

natural state, flowing out of a drainage canal, septic tank, building, manufac{uring plant,
industrial plant, treatment plant, etc.

EMB - the Environmental Management Bureau

Enclosed area - refers to an area that is physically separated from adjacenf areas by walls or
partitions and a roof of ceiling. The walls or partitions must be continuous, interrupted only
by
doors and windows. The mere presence of a roof or ceiling over the structure, but without walls
or partitions sunounding said struc{ure, does not constitute an enclosed area;

Endangered species - a species of plant or animal that is seriously at risk of extinction.

Endemic species - means species or sub-species which is naturally occurring or found only
within specific areas in the country.

Establishment - a collective term construed to include all firms, institutions, entities, including
its premises, facilities, equipment, machinery, which are engaged in production, handring,
storing, transporting, selling, distributing, using, processing, and disposing any product
or
substance considered as a nuisance, orwhich are engaged in offensive tradeJ and occupation.

Exotic Species is a species living outside its native distributional range, which has anived
there by human activity, either deliberate or accidental.

Food Establishment - any structure used/ engaged in food business.

Habitat - a place or environment where a species or suFspecies naturally occur or

Hazardous Tree -means a tree that is in inminent danger of falling and causing injury to a
person or damage to properly.

Hygienic septic Tank - a septic tank that is conducive to maintaining health and preventing
disease, especially by being clean, germ-free, unpolluted, uncontaminated and or in good
sanitary condition-

sale and distribution of goods or processing of raw materiars into end products.

Organic Waste - a material that is biodegradable and comes from either a plant or animal-
Organic waste is usually broken down by other organisms over time and may also be referred to
as wet wasle. Most of the time, it is made up of vegetable and fruit debris, paper, bones and
human waste which quickly disintegrate;

Ornamental Plants - are plants that are grown for decorative purposes in gardens and
landscape design projects, as houseplants, for cut flowers and specimen display.

Owner - when applied to buildings or land, shall include any part owner, joint owner, tenant in
common, joint tenant or tenant by the entirety of the whole or part of such building or land.

Percon - is a person, firm, association, co-partnership, joint venture, corporation or any entity,
private or public in nature.

Person in charge - in case of public places or other establishments, this refers to the president
or manager in case of a company, corporation or association, the owner/proprietor as well as
the operator in case of a single proprietorship, or the administrator in case a government
property/building is involved. ln case of a public conveyance, the owner, the driver, the
conductor, and the caplain of a public conveyance.ln case of workplaces, lhe employer who
may be an individual employer, or a sole proprietor.Or if the employer is a corporation, all the
corporate officials.

Point'of-sale -
refers to any location at which an individual can purchase or otherwise obtain
tobacco products. For the purpose of these Rules, itineranuambulant vendors are not covered
by the term "point-of-sale';

Premises - refers to a tract of land and building or buildings thereon, including the open spaces
between the buildings located on the same tracl of land and within the perimeter of said tract of
land.

Pre-treatment Facility - means any apparatus or equipment used to modify the characteristics
of effluent prior to a wastewater disposal system, and includes grease traps, oil separators,
dilution pits and similar devices;

Public Building-refers to any of the following: 1) A buildingistruc{ure owned by the government


or owned by a private person, but used, rented, or occupied by the government or any of its
instrumentalities. 2) Any building or structure used or controlled exclusively for public purposes
by any department or branch of the government, whether national or local government unit,
within Valenzuela City without reference to the ownership reference to the ownership of the
building.

Public conveyance - any vehicle, whether mobile or stationary, available to the public as
mode of transport, such as, but not limited to jeepneys, buses, trains, tricycle and the other
similar vehicles:

R,A. 9147 - An Aci Providing for the Conservation and Protec{ion of Wildlile Resources and
their Habitats.

Rolocation Tree - means a living tree that, according to a tree plan, an owner intends to
relocate or has relocated or that, according to this Ordinance, an owner must plant to replace a
tree on a site.

Separate Sewerage System - this involves the collection of sewage from households which '
will be conveyed through the sewer pipelines going to a Sewage treatment Plant or STP;

Septage- a combination of scum, sludge, and liquid from household septic tanks, thickened
and partially treated sewage that is removed from a septic tank;

Septage i,lanagement - also known as 'desludging" this involves the depository of the
households sewage to a properly designed septic tank and collected by a desludging truck
going to a Septage Treatment Plant (STP);

septage Trcatm€nt Plant - a series of structure purely for the process of treating septage in
order to comply with DENR effluent standards;

septic Tank - a water-tight receptacle that receives the discharge of a sanitaryplumbing


system, or part thereof, and is designed and constructed to accomplish the sedimentation and
digestion of the organic matter in the sewage within the period of detention or retention, and to
allow the liquid to discharge to a leaching field, sewer lines, a combined sewerage network, or
directly to a secondary wastewater treatment facilily, in accordance with the standards set forth
by the Revised Plumbing Code of the Philippines

sewage - any wastewater containing human, animal, or vegetable waste matter in suspension
or solution, including human excreta and urine, and may possibly contain liquids consisting of
chemicals in solution;

Sewer or sewer lines - pipes or conduits for carrying sewage and/or wastewater;

sewerage Disposal system - is the proper disposal of effluent using either a separate
Sewerage System, combined Drainage system, or Septage Management whichever is required
or accepted by existing environmental laws and policies;

Sludge - a solid particle of domestic sewage which settles at the bottom of the sedimentation
tank, and is digested by anaerobic bacteria purely from domestic sources,

Smoking - refers to the act of carrying a lighted cigarette or other tobacco products, whether or
not it is being inhaled.

Sound Amplifying Equipment - is any machine or device for amplification of the human voice,
music or any other sound, but shall include: 1. Automobile radios, stereo players, or television
receivers used and heard only by the occupant of the vehicle which the same is installed;
Radio, stereo, players, phonographs or television receivers used in a house orapartment withi
any residenlial zone or within 500 feet thereof 3. Horns or other devices authorized b
law on any vehicle when use r traffic purposes

Sound Level (Noise Level) in decibels (dB) - is the sound measured with an "A weighing
and slow responses by a sound level meter, except an impulsive or rapidly varying sounds
levels, the fast response shall be used.

Sound Level Meter - is an instrument including a microphone, an amplifier, an output meter


and "A" frequency weighing network for the measurement of sound levels.

Sound Truck - is any motor vehicle or any other motor vehicle regardless of automotive power,
whether in motion or stationary which carries or is equipped with or which has a mounted '

Tobacco Products - refers to any product that consist of loose tobacco that contains nicotine

smoking, oral or nasal use. Unless stated othen rise, the requirements of this Ordinance
pertaining to cigarettes shall apply to other lobacco produc{s.

Trees - means a self-supporting, perennial, woody plant thal has a trunk or stem and a root
system.

Tree Planting lay out - means a simple graphical representation in form of sketch indicating
the location of the trees and plants to be planted or shall be incorporated to the site
development plan.

Tree Protection Plan - are annotated to demonstrate necessary tree prolection measure
required during the construction process.

vertical Gardening - is a garden that grows upward (vertically) using a trellis or other support
system, rather than on the ground (horizontally). Anything grown on a trellis or even a fence is
technically part of a vertical garden.

videoke / video Karaoke Machine, unit - Any equipment or musical contrivance comprising
of television set or monitor, video player, amplifier, speakers, microphones and any sound
system used for sing-along whereby lyricsof a song with accompanying visual backdrops are
seen on a monitor or screen.

Videoke / Videoke Karaoke Joints / Establishments - any establishment operating and / or


maintaining videoke / video karaoke machines / units.

OFFICE

SECTION 5. IMPLEMENTING OFFICE -The City Environment and Natural Resources Office
(CENRO), Waste Management Division, Flood Control Division and Clean and Green Division
under the Public Sanitation and Cleanliness Group (PSCG), City Agriculture Office (CAO), City
Veterinary Office (CVO),Task Force Disiplina (TFD),City Health Office (CHO) - Sanitation Office,
Office of the Building Official (OBO), Business Permit and Licensing Office (BPLO),Zoning
Office,Public Safety Division (PSD), Valenzuela City Transportation Office (VCTO) and Traffic
Management Office under the Public Order and Safely Group (POSG)shall be known as
"Office" lor brevity, are mandated to develop and implement Valenzuela City's Comprehensive
Environmental Protec'tion, Conservation and Management Program as provided in this
Environmental Code.

SECTION 6.
RESPONSIBILITIES OF THE OFFICE - The imptementing office shail devetop

and directly administer comprehensive Environmental Proteciion, conservation and
Management Program, with the following specific functions, duties and responsibilities:

1. CITY Ei{VTRONMENT AND NATURAL RESOURCES OFFICE (CENRO)

a. lmplement and enforce laws, rules, regulations and ordinances on the


prevention, control and abatement of air, water and noise pollution in order 1o
protect the health and welfare of the people;
b. lmplement and enforce laws, rules, regulations and ordinances on industrial
pollution in order to ensure that all industries located in Valenzuela City are within
the standards set forth by national regulalory agencies;
c Establish linkages and coordinate with other agencies relative to the
implementation of pollution control program;
d Formulate civic consciousness programs geared towards environmental
sanitation (e.9. cleanliness, proper wastewater disposal to be implemented in
coordination with the barangays and Nongovernment Organizations (NGOs);
e Recommend the issuance of a Cease and Desist Order (CDO) and or Clos
Order (CO) of business to the Business Permits and Licensing Office;
t Conduct lnformation, Education and Communication Campaign on
prevention, control and abatement of pollution;
S Shall inspect the Wastewater Treatment Facilities and Sewage Treatment Plant

City, consistent with the rules and regulations to Republic Act 9003;
2.1.b Ensure lhat all domestic waste and garbage in the City are collected and I
disposed of in places designated by the Cily Government in accordance with the

recommend adaptable and suitable species of native/indigenous trees and
ornamental plants, or shrubs that can be planted along open spaces, parks,
creeksides/riverbanks.

4. CITY VETERTNARY SERVTCES OFFTCE (CVSOI

a. Shall conducl surveillance and monitoring of suspecied selling of endangered


exotic species.

b Recommend to the Sangguniang Panlungsod and advise the Cily Mayor on


matters relative to veterinary services, including but not limited to: the regulation
of the keeping of domestic animals, improvement of the quality of livestock,
poultry, and other domesticated animals used for work and human consumption;

c Develop plan and strategies and implement the same upon the approval of the
Sanggunian orthe City Mayor, particularly those which have to do with
veterinary related aclivities which the Sanggunian or the Mayor is empowered to

6. CITY HEALTH OFFICE

a Act as overall coordinator for the effective implementation of Anti-Smoking policy;


b Develop, produce, disseminate informative and educative materials and/or
conduct information drive relative to the harmful effects of smoking tobacco,
cigarette, and other tobacco products;
c Disseminate the Hotline Number and encourage Valenzuela Cily constituents to
monitor and report violations of the Anti Smoking policy;
d lnitiate development and promotion of a smoking cessation program/facility.

7. SANITATION OFFICE

a. May recommend cancellation of the establishment's business license and perm


and its closure if the establishment fails to comply;

grease trap of existing commercial establishments, factories, and dwelling units

8. OFFTCE OF THE BU|LD|NG OFF|C|AL (OBO)

a The Office of the Building Official shall designate inspectors that will check on the
minimum compliance on the general design, construc{ion of septic tanks andior I
wastewater treatment facilities in residential, commercial, industrial,
governmental, and institutional struclures prior to issuance of Certificate of
Occupancy.

9. BUSTNESS PERMTT & LTCENS|NG OFFTCE (BPLO)

a. The BPLO shall issue a Cease immediale STOP ORDER and/or recommend
Closure Order to the concerned business establishment as recommended by the
concerned offices for non-compliance on its directives to the City Mayor;
b. Application for Business Permit or Mayo/s Permit shall not be issued to violators
of this Code unless the administrative fines are fully settled;
c. The BPLO may recommend the revocation of business permit for establishments
who failed to comply with the requirement set forth in this Code.

10. ZONING OFFICE AND LOCAL ZONING BOARD OF ADJUSTMENT AND APPEAL

a Zoning Office and Local Zoning Board shall require every owner/developer in lhe
City, such as but not limited to lndustrial, Shopping Malls, Residential
Condominium, Residential Subdivision, Commercial subdivision, and Residential
Townhouses a copy or copies of the lnitial Environmental Examination, duly
certified by a licensed Environmental Planner as one (1) of the requirements for
the issuance of a Locational clearance.

Order (CDO) for the pollution source as may be deemed necessary.

AUTHORITY oF THE oFFtcE PERSONNEL -upon the authority of the ofiice
Head, the personnel conducting field\flork such as, but not limited to, Environmental lnspec{ors,

areas under their jurisdiction and assignment, and enforce the provisions of this code.

SECTION 9.

SECTION 10. INTERFERENCE AND FALSE REPRESENTATION -lt shall be unlawful for an
person to resist or in any way interfere with any officer, employee, or authorized representative
of the Office in the performance of his/her duty, or who shall impersonate or falsely represent
any officer, employee, or authorized representative of the Office, or wear without authority any
uniform or logo adopted by the Office. , or who shall deface, change or alter, falsify, remove, or
destroy any notice, poster, or making placed in or on any building, premises, or part thereof, or
any person in charge of any building, premises, or place, or parl thereof, who shall knowingly
permit or allow the same to be done.

CHAPTER FIVE
BIODIVERSITY MANAGEMENT

SECTION 11. UNAUTHORIZED CUTTING OF TREES - lt shall be unlawful to cut or uproot


matured trees along roads, highways, parks, rivemays and other declared public and private
places. Removal of trees can be done through earth balling or cutting. When establishing
infrastructure projects, removal of trees shall be considered the last option. However, removal or
cutting of trees may be allowed if the requesting party could secure a Permit to Cut Clearance
from DENR-NCR. The following requirements shall be provided by the requesting party:

a.) Letter of Application;


b.) Photographs of tree/s to be removed and Sketch map showing the location of the trees
to be removed;
c.) Certificate of No Objection from Barangay;
d.l Copy of Land Title for Private property
e.) Site Development Plan and ECC (for big projecls)

ln case the owner requested the city for the cutting/balling out of the tree/s and its proper
disposal, it shall befree of charges.ln case an accident occurs during the cutting/balling out and
disposal thereof, the City Government of Valenzuela shall not in any way be held accountable
on the accident.

SECTION '12, The planting of indigenous trees, fruit-bearing trees and ornamental plants shall
be the center of activities during the celebration of "Arbor Day" in Valenzuela City every l5h
of June.

SECTION 13. At the Barangay level, all Barangay Officials, Public and Private Partners, Civic
Organization, Community Members and School Authorilies including officers and members of
Parents and Teachers Association (PTA) in coordination with CAO, CENRO and Clean and
Green Division shall be the prime movers in pursuing the objec{ive of Arbor Day celebration by
implementing tree planting projects and giving instructions and guidance to participants, and
infusing in their minds the significance and importance of planting trees to one's environment.

SECTION 14. ENDANGERED AND EXOTIC SPECIES - lt shall be unlawful to sell endangered

violates Section 14of this Chapter shall, upon conviction, be punished with a fine of not less
than Three Thousand (P3,000) Pesos nor more than Five Thousand (P5,000) Pesos,
confiscation of the prohibited endangered and exotic species, or with imprisonment of
not less than six (6) months, or both, atthe discretion of the Couft.

SECTION 18. TREE PLANTING PLAN AND REQUIREMENTS. -

Trees not on the list may be approved by the CENRO.

1. When a building permit is requested for renovation of a previously developed


site where the required perimeter planting strip does not exist, trees are still
required.
2. When a building permit is requested for the renovation of a site previously
developed, internaltree planting is still required. . However, only five percent
(SYo) of the total impervious cover must be set aside for landscape purposes.

h.) Parting arleas, lnternal planting requirements for parking areas are as follows

1 Residential commercial zones. Planting in suburban commercial zones


shall be in accordance with the following:

1.1 Trees must be planted so that each parking space is no more than
twelve(12) meters from a tree trunk, unless the parking lot has continuous
islands running the length of the parking lot with minimum 2.4 meters width;
then the requirement will increase to five(S) meters from a tree trunk.

1.2 Bus and taxi lots will be required to plant trees ten(10) meterc apart around
the perimeter of the parking lot in a minimum 3 meters wide planting strip. lf
there is parking on the perimeter of the bus and tractortrailer lots, bollards
or wheel stops are required.

2. Ufuan zones. Planting in urban zones shall be in accordance with the


following:

2.1 Trees must be planted so that each parking space is no more than three
(3) meters from a tree trunk. Trees planted must be large maturing shade
trees.
Minimum planting area per large maturing shade tree shall be 3 square
meters.
2.2 Small maturing trees may be planted where overhead power distribution
lines would interfere with normal growth. Minimum planting area per small
maturing tree shall be one(1) square meter. The entire planting area must
contain amended on-site soil, as specified in the tree ordinance guideli
to a depth of eighteen(18) inches.

1. The property owner must include in the tree suNey all existing trees of two (2)
inch DBH or greater which heishe proposes to satisfy these planting
requirements.
2. Only healthy trees and those that have been protected during the entire
development period, beginning prior to the commencement of site work and
continuing through to issuance of the certificate of occupancy in accordance
wilh approved tree protec{ion requirements, may satisfy these tree planting
requirements.
3. lf an existing tree will obstrucl the construction site, a permit must be secured
prior to the removal or relocation, more so the removed tree must be replace by
the same species or other approved species of trees within the vicinity of the
area.

SECTION 19. TREE SURVEY AND TREE SURVEY FORM,

a. The land owner when required to submit an existing tree planting lay out for tree
save area boundaries shall be required to be surveyed and be described in metes
and bounds.

b. All applications for grading, building, demolition, land use, change of use or rezoning
permits on all property, except single-family subdivision shall require a tree survey.
The survey shall identify all trees within the tree protection zone and all planted trees
that grow parlially or wholly within the city righlof-way.

c. The Cily Environment and Natural Resources Office shall make an inveniory of the
trees in the Public Property such as Schools, Cemeteries, Hospitals, Parks and all
other property use for public purpose governed by any contract or MOA .

d. City Govemment of Valenzuela thru Public lnformation Office, two (2) months before
the effectivity of this ordinance, must inform all Private property owners having a lot
of 200 square meters and above to secure and fill-up Tree survey form from
CENRO.

e. Tree Survey form must be submitted on the time of payment of Real Property Tax or
Renewal of their Business Permit, However, if the required Tree Survey Form is not
yet available on the time of paymenl of Real Property Tax or Renewal of Permits, it
will be a post audit requirement in the issuance of building permit and business
permit.

f. The property owner must submit furnished copy of the accomplished Tree Survey
Form to the CENRO.

g. The CENRO shall furnish a copy to OBO, Zoning Office and City Agriculture.

h. lf the property owner was found no trees planted in the vicinity of their property, they
must submit a Tree Planting lay out in compliance of Section 4 of this Ordinance.

i. ln case that a commercial land or building do not have a vacant lot for planting trees,
the owner of the said commercial land or building is required to install a vertical
gardening wherein its size is appropriate to the size of their building or premises.
They may choose an omamental plants suggested by the Valenzuela City
Agriculture Office found in letter (f) of section 4 of this ordinance.

k. ln case an industrial land or building does not have enough space or vacant lot to
plant trees, the owner of the said industrial land or building must adopt a property, it
may be public or private for them to plant trees suitable to the said area.Owner of the
industrial lot may seek an assistance and recommendation from their Punong
Barangay. A Memorandum of Agreement (MOA) shall be made between the '
industrial lot owner and the owner of the adopted property for their mutual
responsibilities in taking care and protecting the existing trees. On the other hand,
the Punong Barangay will act as the witness to the said MOA. However, if the
Punong Barangay re@mmends a certain public property owned by the school, the
MOA will be between the Department of Education, represented by the school's
division superintendent and the industrial lot owner. Whereas, if the property is
owned by the City Government, the agreement will be made between the City Mayor
and the department head in-charge of the particular government entity.

l. All Punong Barangay shall make a land inventory and maintain a data base of vacant
lots maybe utilized for tree planting in relation to letter (k) of this section. The Punong
Barangay must furnish a copy of the said data base to Zoning Office, OBO and
CENRO.

SECTION 20. PERMIT

a. Persons requesting to do any removal, trimming, cutting, or relocation of trees


subject to this Ordinance, or any of the ac{ivities prohibited by this article, shall
secure a permit for tree work from the City Environment and Natural Resources
(CENRO) before the activities commence. For purposes of this subseclion, a
landscape plan approved by the city constitutes a permit.

SECTION 21. MAINTENANCE AND PROTECTION OF TREES AND PLANTS.


I

I. PRIVATE PROPERTY

a. Any person owning or occupying real property bordering on any street where
trees and plants have branches, limbs, trunks, or other parts projecting into the
public street or property shall prune such trees or keep them trimmed in such a
manner that they will not obstruct or shade the stree ights, obstruct or interfere
with the passage of pedestrians on sidewalks, obstruct vision of traffic signs, or
obstruct views of any street or alley intersection.

b. Any person owning or occupying real property bordering on any street, park or
other public properly, on which there may be trees and plants that are diseased
or insect infested, shall remove, spray or treat any such trees in a manner that
will not infect or damage nearby public vegetation or cause harm to the
community or citizens therein.

c. lt shall be the duty of the property owner to maintain all trees and plants planted
pursuant to, or protected by, this ordinance in a heahhy condition in accordance
with this section and the tree ordinance guidelines developed by the CENRO.
Trees shall be allowed to grow to their natural height and form.
d. When trees that are subjec{ to or protected by this ordinance die, missing, or are
otherwise deemed unheahhy by the CENRO, they shall be removed and
replaced by the property owner to comply with any existing planting plan or as
directed by the CENRO. New owners of properties already in compliance must
maintain that compliance. Trees of the same, approved species as those existing

Nothing in this section is intended to impose a requirement that the property
owner maintain more trees than those required for the site even if 'he' hai

e. lf the owner or occupant of such properg does not perform the dulies set out in
subsections (a), (b) and (c), the city may order the pruning, removal or treatment
of trees on private property that cau se obstructions, present insec{ or disease
problems or otheMise present a da nger to public health or safety. The order
shall be in writing to th e owner or occupant responsible for such condition and
shall be acted upon within 30 days from the time of the receipt of the order. lf,
after 30 days, the owner or occupant has not responded or acted to prune,

public heahh, safety, or welfare, the CENRO may act without prior notification to
the property owner or occupant.

II. PUBLIC PROPERTY


a. No person shall plant any tree or shrub on any public slreet right-of-way or public
property without first obtaining a permit from the CENRO and without complying
strictly wi(h the provisions of the permit and the provisions of this ordinance.
'
b, No person shall spray, fertilize, remove, destroy, cut, top, or othenrvise severely
prune, including the root system, or treat any tree or shrub having all or any
portion of its trunk in or upon any public property without first obtaining a written
permit from the CENRO and without complying strictly with the provisions of the
permit and this ordinance.
c. No person shall damage, cut, or carve any tree or shrub having all or any portion
of its trunk in or upon any public property; attach any objec{, including, but not
limited to, rope, wire, nail, chain or sign, to any such tree or plant or attach any
such object to the guard or stake intended for the protection of such tree and
plants.
d. No person shall place, store, deposit, or maintain, upon the ground in any public
street or public place, any compac{ed stone, cement, brick, sand or other
materials which may impede or obstruct the free passage of air, water and
fertilizer to the roots of any tree or plant growing in any such street or place
without written authorization from the CENRO.

SECTION 22. INVESTIGATIONS AND INSPECTIONS OF SITES.

a. Agents, officials or other qualified persons designated by the city are authorized to
inspect the sites subject to this chapler to determine compliance with this chapter or
rules or orders adopted or issued pursuant to this Ordinance.
b. No person shall refuse entry or access to any authorized city representative or agent
who requests entry for the purpose of inspection, nor shall any person resist, delay,
obstruct or interfere with such authorized representative while in the process of
carrying out official duties.
c. lf, through inspeclion, it is determined that a property owner or person in control of
the land has failed to comply or is no longer in compliance with this Ordinance or
rules or orders issued pursuant to this Ordinance, the city will serve a writen notice
of violation. The notice may be served by any means authorized, or any other means
reasonably calculated to give actual notice, such as facsimile or hand delivery. A
notice of violation shall identify the nature of the violation and shall set forth the
measures necessary to achieve compliance with this Ordinance. The notice shall
inform the person whether an administrative penatty or other penalty provided by the
Ordinance. The notice shall advise that failure to correc{ the violation within the time
specmed will subject that person to the Administrative penalties or any other
authorized penalty action as provided.
The City shall have the power to conducl such investigation as it may reasonably
nec€ssary to carry out its duties as prescribed in this Ordinance, and for this
rpose may enter at reasonable times upon any property, public or private, for the
purpose of investigating and ins pecling the su

SECTION 23. ADMINISTRATIVE FINE.

a) Any natural orjuridical person who violates any provision of this ordinance shall be
subject to administrative penalties in the following manner:

SECTION 25. IMPLEMENTING RULES AND REGULATIONS. - While this Ordinance and the
provisions hereof are already operative upon the Ordinance's effectivity, the City Mayor, through
its authorized agency, may issue the additional, appropriate, and relevant rules and regulation
forthe proper implementation of this Ordinance or its provisions.

TITLE TWO

THE BLACKCROWNED NIGHT HERON lNycticorax nyctianxl, LOCALLY KNOWN AS


"BAKAW GABI" AS FLAGSHIP SPECIE OF THE CITY OF VALENZUELA

SECTION2G.ADOPTION OF THE FLAGSHIP SPECIES - The black-crowned night heron is


hereby adopted as the flagship species of the City of Valenzuela, pursuant to the provisions of
Section 35 of RA 9147 and Rule 35.1 of its implementing Rules and Regulations (lRR).

SECTION 27. CONSERVATION AND INFORMATION DISSEMINATION -The City


Government, through the City Mayor, in coordination with the City Environment and Natural
Resources Office (CENRO), and in consultation with the Department of Environment and
Natural Resources ffice (DENR) shall conduct conservation measures to protect the city,s
flagship species. The Public lnformation Office shall initiate programs and activities to inform the
public on the ecological significance of the said birds.

TITLE THREE
ECOTOURISM ZONE

SECTION 28. ECOTOURISM ZONE. -The l0lhectare area of Barangay Tagatag as indicated
and shown in the Zoning Map of Valenzuela City, Metro Manila, is hereby declared as
ecotourism zone.

SECTION 29. DEVELOPMENT AND MAINTENANCE. - The development and maintenance'


program of the area shall be a continuing activity of the City Government, in coordination
the Barangay Council of Tagalag, Valenzuela City.

SECTION 30. REGULATION OF USE OF LAND AND DEVELOPUENT OF TMPROVEMENT.


- For the purpose of preservation and maintenance of Barangay Tagalag as ecotourism zone a

under Section 30of this Code shall also constitute a criminal offense and punishable as follows:

SECTION 39. PROMOTION OF MULTI.PURPOSE ENVIRONMENTAL COOPERATIVE

SECTION 40. MANDATORY PUBLIC HEARTNGS - Mandatory public hearings for


the
formulation of the City Solid Waste Management Plans shall be mandatory and undertaken
by
the Board and the National Solid Waste Management Commission (NSWMC) respectively.
Provided that, the Board shall ensure that at least three (3) weeks notice be initiated, prior
to the
hearings is given to the public. Such notice shall include an explanation of the hearings process,
located, any other factor, either the Board or the NSWMC consider relevant. Each hearing
shall
be of a substantive nature. lt shall more than just a description of the National Solid Waste
Management Framework and the City Solid Waste Management plans. Every citizen shall be
given the right opportunity to comment on the framework, and to the City Solid
Management Plans, preferably in writing. Atl records of the proceedings of said hearings shall
be filed with the NSWMC and the board; and that they shall be readily available and arcessible
to the public. The Board shall formulate a decision whether to adopt, reject or revise the
reviewed plans on the basis of materials and information, provided their knowledge and
experience, in addition to the materials adduced in public hearings

SECTION 41. IMPLEMENTATION OF THE ECOLOGICAL SOLID WASTE I'ANAGEMENT


SYSTEMS -The City Government hereby recognized its obligations to be the responsible body

for the implementation and enforcement of the ecological solid waste management systems
within the territorial jurisdiction of the Cily. Waste colleclion shall be conducted at the barangay,
and further sorting and segregation at the Materials Recovery Facility,

SECTION 42. WASTE SEGREGATION AND VOLUtIE REDUCTION AT SOURCE - Volume
reduction at the source shall be the first priority of the ecological SWM system. The City
Government promotes among its constituents the reduction and the minimization of wastes
generated at source; responsibility for sorting and segregation of biodegradable and non-
biodegradable wastes shall be at the household level, business, commercial, industrial and
institutional centers, and in all other point sources of solid wastes.

SECTION 43. MINIMUM REQUIREMENTS FOR SEGREGATION AND VOLUME REDUCTION

r SECTION 44. MINIMUM STANDARDS FOR THE COLLECTION, TRANSPORT AND
HANDLING OF SOLID WASTES -The following shall be the minimum standards and
requirements for the collection, transport and handling of solid waste:

a.) All collectors and other personnel directly dealing with collection of solid waste shall be
equipped with personal proteclive equipment and paraphemalia such as, but not limited
to gloves, masks and safety boots, to protect them from the hazards of handling solid
wastes.
b.f The City Health Officer shall provide necessary training to the collectors and personnel
to ensure that the solid wastes are handled propedy in accordance with the guidelines
pursuant to the Act and to the training manuals developed by NSWMC.
c.) The equipment used in the collection and transportation of solid waste (or materials
which have been separaled for the purposes of recycling) shall be fabricated, operated
and maintained in such a manner as to minimize health and safety hazards to solid
waste management personnel and the public.
d,) Equipment shall be maintained in good condition and kept clean to prevent the
harbouring of vectors and the creation of nuisances.
e.! The use of separate mllection schedule and/or separate trucks or haulers shall be
required for specific types of wastes. OtheMise, vehicles used for the collection and
transporl of solid wastes shall be the appropriate compartments to facilitate efficient
storing of sorted wastes while in transit. The waste compartment shall have a @ver to
ensure the containment of solid wastes while in transit.
f.f Vehicles shall be designed to consider road size, condition and capacity to ensure the
safe and efficient collection and transport of solid waste.
g.) For the purpose of identification, vehicles shall bear the body number, the name and
telephone number of lhe contractor/agency collecting solid waste.

SECTION 45. MINIMUM REQUIREMENTS FOR ESTABLISHING ANO OPERATING


TRANSFER STATIONS -Transfer stations shall be designed and operated for efficient waste
handling capacity and in compliance with environmental standards and guidelines set pursuant
to the Ac{, the lmplementing Rules and Regulations and other regulations. ln addition, the
design and operation of transfer station shall conform to the following standards and criteria:

al Leachate and Drainage Control - Facilities shall be designed such that waste shall n
come into contact with run-off and to prevent the generation of leachate.
b) Provisions for veclor, odor, litter and dust control shall be included.
c) The sitting of the transfer station shall consider the land use plan, proximity or collection
area, and accessibility of haul routes to disposal facility. The design shall give primary
consideration to size and space sufficiency in order to accommodate the storage of
waste, and vehicles for the loading and unloading of wastes.
d) The following records shall be kept and maintained, and submitted to the DENR upon
request:

d.l)Record of daily weights or volume of waste received and transferred accurate to


within ten percent (10%) and adequate for over all planning purposes and tracking of
waste volumes.
d.2)Daily logbook or file of the following information shall be maintained: fires,
special occurrences, unauthorized loads, injury and property damage.

e) Waste shall be removed from the transfer station within twenty four (24) hours of its
receipt.

SECTION 46. OPERATIONS OF A MATERIAL RECOVERY FACILITY -All barangays within


the City shall be responsible for the collection, segregation, recycling of biodegradable,
recyclable, compostable and reusable wastes. MRFs will be established in every barangay. The
facility shall be established in barangay cnuned or leased land or any suitable open space to be
determined by the barangay through its Sanggunian. For this purposes, every barangay shall
allocate a certain parcel of land for the MRF. The determination of site and actual establishment
of the facility shall likewise be subjec{ to the guidelines and standards set forth by the Act and
the lmplementing Rules and Regulations. The MRF shall receive biodegradable wastes for
composting and mixed non-biodegradable wastes for final segregation, re.use and recycling.
Provided, that each type of mixed waste is collected from the sourcp and transported to the
MRF in separate containers. The resulting residual wastes shall then be transferred to a long-
term storage or sanitary landfill. Materials recovery facilities shall be designed to receive, sort,
process and store composlable and recyclable material efficiently and in an environmentally
sound manner. The facility shall address the following consideralions:

a.) The building and/or land layoul and equipment musl be designed to accommodate
efficient and safe materials processing, movement and storage;
b.) The building must be designed to allow efficient and safe extemal access and to
accommodate internal flow;
c.) lf the MRF includes a composting operation, it shall comply with the provisions of
Section 2 and of Rule Xl of the lmplementing Rules and Regulations applicable to
composting and composts;
d.) The following records shall be kept and maintained, and to be submitted to the DENR
upon request:

1.) Remrd of daily weights or volume of wasle received, processed and removed from
site accurate to within ten percent (10%) and adequate for overall planning purposes
and tracking of success of waste diversion goals; and

2.1 Daily logbook or file of the following information shall be maintained: fire, special
ocrurences, unauthorized loads, injury and property damage.

SECTION 47. MINIMUM REQUISITES FOR OPERATING COTIIPOSTING FACILITIES .


Composting facilities with the City sh all conform to the minimu uisites for operating
composting facilities as provided by law.

Composting facilities shall conform to the following sitting, design and operating standards and
criteria:
a) The Facility shall not be sited in areas subject to frequent flooding, unless
engineering controls are provided in the design lo prevent inundation of the facility.

b) Leachate and Drainage Control

1. Facilities shall be designed such that compost piles, windrows, residues and
processed material will not come in contact with surface storm run-off.

2. Where excess leachate storage is provided, discharge of leachate into any body
of water is prohibited unless such discharge meets the limits prescribed by the
DENR standards for effluents. Where leachate needs to be stored, it shall
comply with the provisions of Section 'l(k) of Rule XIV of this lRR. Provisions
shall be made such that leachate is re-circulated back into compost piles or
windrows as much as possible.

c) Provisions for vec{or, odor, litter and dust control shall be included

d) Records keeping shall be maintained at all times in accordance with Section 2(b) of
Rule XIV of this lRR.

e) Residues shall be managed as solid waste and shall be disposed of as such.

f) Temperatures of compost piles, curing piles and processed composts shall be


maintained in safe levels to prevent spontaneous combustion.

g) Aerobic conditions shall be maintained to prevent creation of dangerous gases such


as methane.

Provided that, individual household backyard composting shall be exempted from the provisions
of Section.

All technical reports, technical documents, plans and specifications pertaining to the engineering
of the facility and other waste management facilities shall be certified based on EMB
requirements.

SECTION ,|8.
RECLAMATION PROGRAMS AND BUY-BACK CENTERS -The City
Government shall establish and implement deposit or reclamation programs in coordination with
the National Ecology Center (NEC), manufacturers, recyclers and generators lo provide
separate colleciion systems or convenient droFoff locations for recyclable materials and
particularly for separated toxic components of the waste stream like dry cell batteries and tires
to ensure that they are nol incinerated or disposed of in landfil The City Government shall
coordinate with the NEC during formulation of related ordi on this matter.

SECTION 49. AVAILING OF THE NATIONAL SOLID WASTE MANAGETVIENT FUND - ThE
City Government shall initiate effort to secure the approval of the NSWMC of the City Solid
Waste Management Plan and satisfy the criteria to avail of the Php 1,500,000.00 funding to
implement the plan.

SECTION 50. ESTABLISHMENT OF LOCAL SOLID WASTE MANAGEMENT FUND - A local


Solid Waste Management Fund (also known as the Local Fund). Pursuant to the relevant
provisions of (R.A. 7160 is hereby created. Funds for the Local fund shall be derived from the
City Government's collection of fines. An authority is hereby vested to the City Solid Waste
Management Board to administer the Local Fund as a special account of the City Government.
The City Council shall develop pertinent guidelines on the management of the Local Fund within
fifteen days upon approval of this code. Moreover, stipulating that the City Solid Waste
Management Board shall develop schemes to sustain the Local Fund including resource
generating ventures and placing appropriate monies as Trust. Reporting on the status of the
Local Fund shall be initiated annually by the Board, to the NSWMC or other relevant authority,
by the City Government in collaboration with Commission on Audit four (4) months after the end
of each fiscal year. Furthermore, the following shall be carefully considered by the board:

a) Rationale and basis for establishing sustainable Local Fund pursuant to R.A. 9OO3 and
this l.R.R. and R.A.7160.
bf The Local Fund as a special account of the City Treasurer or lhe Treasurer of the City
Solid Waste Management Board.
c) Generation of the Local Fund as defined herein by the lmplementing Rules and
Regulations (lRR), and provisions for its sustainability.
d) Transparent administration of the Local Fund by the Cily Council and Officers of the City
Solid Waste Management Board.
e) Specific uses of the Local Fund and its use restriction as defined herein by the lRR.
f) Criteria for accessing the Local Fund for solid waste management projec{ or activity.
gl Process for availing of the Local Fund.

SECTION 52. PROCESS FOR AVAILING THE LOCAL FUND -The Cily SWM Board shall
prescribed a simple procedure and proforma for fund application within fifteen days upon
approval of its ordinance. An efficient system of accepting, appraising and approving of
proposals will be established by the Board. Furthermore, report proforma as well as procedures
for the handling of the government funds, will be provided by the board. ln general, the
availment process shall start from the submission of a projecl/activity concept dra\ivn from the
City SWM plan. Once the concept proposal is approved, the proponent shall submit a detailed
version of the proposal for review and final decision by the board. Subjec{ to detailed guidelines
which the City SWM Boards will promulgate, the general process. ln no case shall the
community Fund be used for the creation of positions or payment of salaries.

SECTION 53. POWER TO COLLECT SOLID WASTE MANAGEMENT FEES - The Cily SWM
Board shall imposed fees on the SVVIVI services provided for by the City Government. ln
determining the amounts of the fees, the City SWM Board shall include only those costs direclly
related to the adoption and implementation of the SWM Plan and the setting and collection of
the local fees. This power to impose fees may be ceded to the private sector and civil society
groups which have been duly accredited by the City SWM Board: provided the SWM fees shall
be covered by a contracl or Memorandum of Agreement between the board and the private
sector or civil society group. The fees shall pay for the costs of preparing, adopting and
implementing the Cily SWM Plan prepared pursuant to the Ac{. Further, the fees shall also be
used to pay the ac{ual costs incurred in collecting the local fees and for project sustainability.

SECTION 54. BASIS OF SOLID WASTE IIIANAGEITENT FEES -Reasonable SWM seNice
fees shall be computed based on but not limited to the following minimum faclors:

SECTION 55. COLLECTION FEES -Fees may be collected corresponding to the following
levels;

af Barangay - The barangay may impose fees for collection and segregation of
biodegradable, compostable and reusable wastes from households, commerce, othe
sources of domestic wastes, and for use of Barangay MRFS. The computation of th
fees shall be established by the respective SWM boards. The manner of collection of th
fees shall be dependent on the style of administration of respective Barangay Coun
However, all instruclions shall follow the Commission on Audit rules on collection of fees.
b) City - The City Councils may impose fees on the barangay MRFs for the collection and
transport of non-recyclable and special wastes and for the disposal of these into the
sanitary landfill. The level and procedure for exacting fees shall be defined by the city

cf Private Sector/Civil Society Group - On the basis of stipulations of contracts or


Memorandum of Agreement, the private seclor or civil society group shall impose fees of

SECTION 56. COLLECTION AND RETENTION OF FINES -The collection of fines under the
penal provisions of the Act may be conducted by the City SWM Board or any other authorized
body. The colleclion shall be receipted. Ahernatively, the Local SWM Board and/or any duly
authorized body shall retain 40% portion of the collected fees from fines and remit 60% of the
same to the fund, as prescribed herein. Thereafter, the retained percentage is deposited under
the Local Fund, the procedure for which shall be defined by the City SWM Boad within fifteen
days upon effec{ivity of this ordinance.

SECTION 57. SPECIAL ACCOUNT -The City SWM Boards shall establish appropriate special
accounts for the fines, fees donalion and other monies collecled or generated under the Act and
this lRR. Thus, establishment of such special account is hereby authorized by the Cily Council
for that purpose.

SECTION 58. PROHIBITED ACTS, FINES AND PENALTIES - To maintain the deterrent

accordance with law, the chief executive officer, president, general manager, managing partner

this ordinance. lf the offender is an alien, he shall, after service of the sentence prescribed
above, the City Government shall exert effort to facilitate the deportation without further
administrative proceedings.

The NSWMC may also issue further guidelines that consider existing and relevant laws, and
regulations, and which may further define the scope and coverage of the above prohibited acts.

SECTION 59. CRIMINAL ACTIONS - Violations as defined under Section 50 of the Act shalt be
subject to criminal proceedings, pursuant to the relevant provision of the revised rules
criminal procedure.

SECTION 60. DEPUTIZATION OF SOLID WASTE MANAGEMEI{T OFFICERS -The City


Waste Management Board shall exert effort to request for deputization of solid waste
management officers by the NSWMC.

SECTION 61. ACTIONS AND PROCEDURE -The City Council shall prescribe the rules and
regulations for the commencement of an action/complaint. Thu City Council shall prepare
the rules and procedures within three (3) months upon this Ordinance.

SECTION 62. PUBLIC EDUCATION AND INFORMATION -The City Government, down to the
barangays, shall allocate a portion of their funds, to public education and information activities
on ecological waste management particularly biodegradable and non-biodegradable wastes
including, but not limited to, installation of billboards on collection days for specific waste types,
other outdoor signages, stickers, flyers, conduct of seminars, and other effctive non-traditional
information strategies.

a) All garbage collection and hauling companies shall also be directed to install visible
signs in their collection and hauling trucks, describing the waste type they are supposed
to collect (for example, NABUBULOK, NARERESIKLO, DI-NABUBULOK).

b) All garbage collection and hauling companies within the City shall also be enjoined to
employ other possible media approached to ensure compliance to mandatory waste
segregation (for example, use of bell, characteristic music, jingle, slogan, color-coded
trucks, and the like) in their garbage collection vehicles

TITLE ONE
"TAPAT KO SAGOT KO"

SECTION 63. PURPOSE - lt shall be the responsibility of the dweller, lessee or the actual
occupant of a residential or commercial establishment, and in the absence thereof, of the
registered owner of the land, house or building to maintain the cleanliness of their respective
frontage and immediate sunoundings, including the nearby sidewalks and street gufters.

For purpose of this Code, frontage of premises, residence or building shall be:

a) The land between a building and the street:


b) The land adjacent to something, such as a building, street, or body of water; and
c) The mid-span of the road, street, alley or avenue (excluding highways and major
thoroughfares) from the edge of the street gutter, sidewalks or residential houses,
dwelling units, business or commercial establishments or offices, whether private or
public.

SECTION 64. DUTIES AND RESPONSIBILITIES OF DWELLER, LESSEE, OR


OCCUPANT OF RESIDENTIAL OR COMMERCIAL ESTABLISHMENTS . It sha|I be the

SECTION 66. NOTICE - Persons like under this Code shall be given written notice of violation,
personally or by registered mail, together with the Violation Receipt and two (2) pictures as
proof of violation of this Code. A copy of the Violation Receipt shall be fonrarded to the
Treasure/s Office of Valenzuela City. Payment of fines shall be paid to the Treasurels Office of
Valenzuela City.

No permits, license, clearance, certifications or any request from the City Government of
Valenzuela shall be issued to violators of this ordinance unless the said administrative fines are
fully settled.

CHAPTER SEVEN
AIR POLLUTION

SECTION 67. THE PHILIPPINE CLEAN AIR ACT -Republic Act 8749 otherwise known as the
Philippine Clean Air Act of 1999 aims at providing for a comprehensive air pollution control
policy in the country.

TITLE ONE

OFFICE (CENROI under the OFFICE OF THE CITY MAYOR. lt shall discharge the function of
apprehending all violators of this Code, within the tenitorial judsdiction of the Cily of Valenzuela.

SECTION 6g.ADirlNlSTRATlON- The City Environment and Natural Resources Office


(CENRO) as mandated shall implement and enforce the vehicle emission standards fixed in this
Ordinance. The Officeand its authorized deputies may conduct mobile emission testing
anywhere within the City of Valenzuela.

Since tricycle drivers are considered as belonging to the marginalized sec{or of society, there
shall be two phases in the implementation of the provisions applicable to them. There shall be a
grace period of six (6) months from the date of enactment of this Code for the conducl of a
massive information campaign and another six (6) months for the warning violation with no
penalties and charges yet imposable.

Any vehicles plying within the City of Valenzuela, which is not complying with the emission
standards set in this Code, may be apprehended and subjected to emission control test.

ln case the vehicle fails the test, the driver shall be issued a Violation Receipt and his/her
drivefs license and/or vehicle license plates will be confiscated. The Drive/s licenseA/ehicle
License Plates will only be released to the violator after the vehicle has passed the emission
control test and upon lhe payment of testing fee and fines provided for, under Sec{ion 73and 74
hereof.

SECTION 7O.PUBL|C EDUCATION AND INFORMATION CAMPAIGN - A continuing air quality


information and educatlon campaign shall be intensified by the City Government through
CENRO and shall encourage the participation of the other offices such as the TMO, CHO and
other govemment agencies, the private sector including NGOs, Pos the academe,
environmental groups, transport sector and other private entities in the implementation of a
multi-sectoral information campaign.

The enforcement and the implementation of the emission standards shall require the active
cooperation of the importers, local assemblers, owners/operators and the users of all motor
vehicles. To ensure the cooperation of these groups, there is a need for an intensified and
sustained awareness raising campaign which shall focus on; (1) the harmful impact of gas
emission on the general public and workers in the transport sector; (2) the technological options
available to the transport seclor to prevent smoke belching, and (3) the commitment of the City
Government to enforce emission standards through strengthening of apprehension activilies.

SECTION Tl.Apprehension of smoke.belching vehicles shall be conducted in conformity to the


work instruclion and emission standard set forth in this code.

BELCHING VEHICLES.

'1.0 Purpose and Scope. This procedure defines in detail the proper conduct of roadside
apprehension, consistent with the provisions of the Clean Air Act of 1999 and its
lmplementing Rules and regulations OF DENR Administrative Order (DAO 200G81) and
LTO's Memorandum Circulars.

2.0 Responsibilities

2.1. The main responsibility of the Apprehending Team is to ensure that vehicles
mmply with the emission standards set forth under this Code. The team shall be
composed of twelve (12) to thirteen (13) persons, as follows:

2.5. SPOTTER(s| identifies through visual means smoke-belching vehicles and


relays the information to the flaggers and apprehending officers of the team

emitting smoke and therefore, must be tested for smoke emission as
specified in the Vehicle Emission System Valenzuela City.

3.2.1.6.The APPREHENDING OFFICER request the driver present a copy of


the Vehicle OR and CR and his/her driveis license.

3.2.1.7.The APPREHENDING OFFICER verifies the documents for


authenticity.

3.2.1.8. While the APPREHENDING OFFICER verifies the documents, the


MACHINE OPERATOR boards the vehicle and informs the
passengers that the team is conducting smoke-belching test in
consonance with the Clean Air Act (R.A. 8749).

The amount shall be paid upon presentation of the vehicle for testing to determine whether or
not it has already complied with the emission standards set in this Code. Passing the emission
test shall be a requirement for the release of the confiscated driver's license and/or vehicle plate

The Office of the City Mayor, upon the recommendation of CENRO shall issue Accreditation
Certificates to private Emission Testing Centers to conducl emission testing for the City, ONLY

SECTIONT6.FINES AND PENALTIES FOR VIOLATION OF STANDARDS FOR
STATIONARY SOURCES -The visible emission standard for smoke and opacity or any
equivalenl method approved by the DENR shall be applied stationary sources with air
emissions. Any violation shall be punishable as follows:

a) First Offense - One Thousand (P1,000.00) Pesos and issuance of Notice of Violation.

b) Second O'ffense -
Three Thousand (P3,000,00) Pesos and issuance of Cease and
Desist order (CDO) for the pollution source.

c) Third Offense - Five Thousand (P5,000.00) Pesos and recommendation for the
issuance of a Closure Order to the BPLO.

Forthe first offense, a period of compliance of not more than six (6) months shall be given to the
establishment to institute corrective measure after which, the concerned establishment shall be
charged of second offense and third offense, respectively for continuous violation.

ln case of irreparable or grave damage to the environment as a @nsequence of any violation or


omission of the clean Air Act, cENRo shall recommend the filing of appropriate criminal
charges against the violators, and shall assist lhe public prosecutor in the litigation of the case.

TITLE THREE
AREA SOURCE OF POLLUTION

sEcrloN 77Area sources operating without the required permit from DENR-EMB NCR shall
be issued with a Notice of violation (NoV) and a fine of Five Thousand (ps,ooo.oo) pesos.
Thereafter, the case shall be endorsed to DENR-EMB NCR for appropriate action.

construction companies to submit an Environmental lmpact Assessment to the Zoning
Office when applying for Locational Clearance.

Every owner/developer in Valenzuela Cily, such as but not limited to, shopping Malls,
Residential Condominium, Residential SuMivision, Commercial Subdivision and Residential
Townhouses is hereby required to submit to the City Zoning Office, a copy or copies, as
required, ofthe Environmental lmpact Assessment Study, duly approved and certifted by '
the DENR, as one ('l I of the requirements for the issuance of a Locational Clearance.

TITLE FOUR
ANTI.SMOKING

SECTION 79. COVERAGE. - Public Conveyances or any other means of public transport,
accommodation and entertainment establishments, public buildings, enclosed public places
within Valenzuela City's jurisdiction.

SECTION S0.PROHIBITED ACTS.The following acts are declared unlawful and prohibited by
this Code:

af Selling or distributing tobacco products in a school, public playground or other facility


frequented by minors, or within 100 meters from any point of the perimeter of these
places;
b) Smoking Ban in Public Places - Smoking shall be absolutely prohibited in the following
public places:

1) Centers of youth activity such as playschools, preparatory schools, elementary


schools, high schools, colleges and universities, youth hostels, and recreational
facilities for persons under eighteen (18) years old;
2) Elevators and stainrays;
3) Location in which fire hazards are present, including gas stations and storage areas
for flammable liquids, gas, explosives or consumable materials;
4) Within the building and premises of public and private hospital, medical, dental and
optical clinics, health centers, nursing homes, dispensaries, and laboratories;
5) Public conveyances and public facilities including airport and ship terminals, train
and bus stations, restaurants and conference halls, except for separate smoking
areas; and
6) Food preparation areas;

c Knowingly allowing, abetting or tolerating smoking in modation establishments,

SECTION St.PERSONS LIABLE.The following persons/individuals are deemed liable under


this Code.

a) Any person smoking within the prohibited areas mentioned in Section S0hereof;

b) The President or Manager in case of a company, corporation or association or the owner


proprietor or operator in case of single proprietorship of accommodation and
entertainment establishment , whether tourism-accredited or not, who knowingly allows,
abets, and tolerates and/or fails to warn, advise or report violators of this Ordinance to
any Policeman or nearest police station within three (3) hours reckoned from the time of
violation;

SECTION 86. ENFORCEMENT MODALITIES

I. INFORilIATION DISSEMINATION

within 60 days after the effeciivity of this ordinance, the public lnformation office in
coordination wilh the BPLo and the city Health office shall give copies of this
ordinance and its primer to all establishments and legitimate vendors that sell
tobacco, cigarette and other tobacco products.

Establishments applying for a new license to operate business in valenzuela city


shall be given copies of this Code and its primer.

Establishments are given a period of thiny (30) days from the effeciivity of this code
to comply with the requirements of this Code.

Failure to comply with the requirements set forth in this code shall be a ground for
cancellation of business permits by lhe Business permit and Licensing office
(BPLO).

Ninety (90) days after the effectivily of this code, an inspection team consisting of

Valenzuela City.

Should the inspection team find violations of any provisions of the Code, it shall issue
citation tickets indicating the violation and the conesponding fine. Failure of any
violators to pay the fine indicated in the Citation Ticket is a ground for denying
renewal of its business permiulicense.

For non-compliant advertisements and/or promotional materials, the owner or


administrator of the point-of-sale establishments shall be responsible for the removal
or shall cause the removal of said non-compliant outdoor advertising within three (3)
days from receipt of notice from the inspection team, or its duly authorized
representative.

IV. INDIVIDUALVIOLATORS

ln the course of inspection, the inspection team may apprehend violators and may
request the assistance of the Philippine National Police (PNP) to apprehend
violators. They shall also issue Citation Ticket to individual violators and are
authorized to file criminal charges against them.

V. RE{NSPECION

The inspection team shall re.inspect lhe cited establishment to determine its state of
compliance within ten (10) days reckoned from the expiration of the ten (10) day
period indicated in the citation ticket. lf the establishment still fails to comply within
ten (10) days from the receipt of the first citation ticket, the inspeclion team shall
recommend to the Office of the City Mayor the cancellation of the establishment's
business license and permit and its closure.

VI. ENFORCEMENT ON INDIVIDUAL SITIOKER

The Smoke Free Task Force and any authorized person by the ARB shall issue a
citation ticket stating the violation and the penalty to a person apprehended for
smoking in a prohibited area. The issuer/s shall then forward their copies of issued
citation tickets to the City Health Office at least twice a week.

VII. CITATION TICKET SYSTEM

Violators of this Code shall be informed of their violation and the penalty associated
with such violation by means of a Citation Ticket System with the following
guidelines:

VIII. SMOKING CESSATION PROGRAM AND FACILITY:

The City Heatth Office, with the assistance of the CSWDO Officer shall promote a
Smoking Cessation Program and encourage participation of the public and private
facilities in this program so that the smokers who are found violating this Code may
be referred to the said facilities.

SECTION 87. PENALTIES - The following penalties shall apply

a) Violation of Secton 80 and Section 8'l - on the first ofiense, a fine of not less than
Five Hundred Pesos (P500.001 but not more than One Thousand Pesos (Pl,000.00)
shall be imposed or eight (8) hours community service at the discretion of the court.

On the second offense, a fine of not less than One Thousand Pesos (P{,000.00) but
not more than Three Thousand Pesos (P3,000.00) shall be imposed.

On the thid offense, in addition to a fine of not less than Three Thousand Pesos
(P3,000.00) but not more than Five Thousand Pesos (P5,000.00), the business
permit and license to operate shall be cancelled or revoked. ln this case, the imposable
penalty is that which is provided for by Section 32 of R.A. 9211, otheruise known as the
Tobacco Regulatory Act of 2003.

b) Violation of Section 82- on the firsl offense, any person or any business entity or
establishment selling, distributing or purchasing a cigarete or any other tobacco
products tolfrom a minor shall be fined the amount of not less than Five Thousand
Pesos (P5,000.00) or an imprisonment of not more than thirty (30) days, or both at the
discretion of the court.

For succeeding offenses, both penalties shall apply in addition to the revocation of the
business licenses and permit to operate by the Business Permits and Licenses Office
BPLO) in case of business entities or establishment

lf a minor is caught, selling, buying or smoking cigarettes or any tobacco producls, the
provisions of R.A 93214, otheMise known as the Juvenile Justice and Wetfare Act of
2006 and Article 189 of Presidential Decree No. 603 otheruvise known as the Child and
Youth Welfare Code, as amended, shall apply.

The parents/guardian of the minor who violated this Code shall suffer the penalty of
a fine imposed in Section 87 of this Code.

SECTION 88. FUNDS. - The fines collected arising from the Violation of Section 80, 81 and 82,
respectively, shall be used by Anti-Smoking Regulatory Board (ARB) in the implementation ofl
this Code such as, but not limited to information, campaign propaganda and all other means in
order to strengthen the regulation of the Anti-Smoking campaign. ln accordance thereto, all
collections arising there from shall be collected and allocated in a separate account in the
Treasury to be called as the ANTI-SI|OK|NG REGULATORY BOARD (ARB) FUND.

CHAPTER EIGHT
WATER POLLUTION

TITLE ONE

SEWAGE, SEPTAGE AND WASTEWATER MANAGEMENT SYSTEM

SECTION 89.DECLARATION OF POLICY - lt shall be the policy of Vatenzuela City to share


the responsibility in the management and improvement of water quality within its territorial
jurisdiction. To meet these objectives, the City shall implement measures to prevent and control
water pollution while promoting health and sanitation.

SECTION 90.SCOPE AND APPLICATION - The following structures within Valenzuela City are
covered by this Code:

a) All residential structures including, but not limited to, an apartment, house and/or
land on which another's dwelling is located and used for residential purpose and
shall include not only buildings parls or units thereof used solely as dwelling places,
boarding houses, dormilories, rooms and bed spaces offered for rent by their
owners, but also those used for home industries, retail stores or other business
purposes il the owner thereof and his or her family actually live therein and use it
principally for dwelling purposes;
b) Commercial establishments, including but not limited to, restaurants (including
eateries or carinderia), convenience stores, hardwares, malls, groceries, markets,
Mash, condominiums, motels, hotels, hostels, resorts, recreational
_establishments, auto-repair shops (talyer), poultries and livestock rearing
establishments, etc.;

d) Governmental structures, including, but not limited to, barangay halls, govemme
offices, etc.; and
e) lnstitutional structures, including, but not limited to, schools, colleges and
universities, health facilities, churches, etc.

SECTION9I.PRINCIPLES OF SEWAGE A}{D SEPTAGE IUIANAGEMENT - The City of


Valenzuela shall abide by the following sewage and septage management principles:

a) Excreta from residential areas without septic tanks and untreated wastewater from
commercial, industrial, institutional and public establishments shall not be allowed to
be discharged to open drainage canals or piped drainage systems;
b) All buildings and structures, whether residential, commercial, industrial,
governmental, and inslitutional, should be required to have proper sewage treatment
or septage management system.

i.) All residential struclures shall have the prescribed design of septic tanks as per
Presidential Decree No. 1096 othenvise known as National Building Code of the
Philippines and Republic Act 1378 also known as the National Plumbing Code of
the Philippines.

ii.) All commercial and industrial establishments shall have the approved design of
septic tanks or wastewater treatment facility based on the determination of septic
tanks or waslewater treatment facility based on the determination of the Office of
the Building Official (OBO).

iii.) All governmental and institutional establishments shall have the approved design
of septic tanks or wastewater treatment facilities.

iv.)Commercial, industrial, governmental, and institutional slructures that are


required to have wastewater treatment facilities shall have an operational
wastewater treatment facility either on-site or by seruice off-site as requked in the
Republic Act 9275 also known as Philippine Clean Water Act of 2OO4.

c) No wastewater shall be discharged to waterways without any treatment, and must


comply with the DENR Administrative Order No. 35 on wastewater or effluent
standards.
d) For sewered areas, no wastewater shall be allowed to discharge on the sewer
pipeline unless pre-treated to the level of domestic wastewater quality;
e) All food establishments (e.9. restaurants, eatery, food chains, carinderia, etc.)
discharging organic and inorganic wastes shall be required to have an oil and grease
trap installed in their respective kitchen areas;
f) All septic tanks must be accessible at all times.

al For existing structures:

i.)Government buildings, residential, commercial, industrial and institutional with


inaccessible and/or non-compliant septic tank shall opt for any of the following
ac{ions within two (2) year upon the effectivity of this Code: (a) upgrading of the
septic tank to make it accessible and compliant with national standards, or (b)
connection lo existing sewer lines of water utilities, as applicable; or, (c)
construction of communal septic tank.

ii.) Commercial, industrial, institutional, governmental establishments that are v


required to have a sewage treatment plant and wastewater treatment facility shall
comply within two (2) year within the effectivity of this Code; and

iii.)Water Discharge Permit or Clearance/permits required by the DENR, DOH and


other existing laws shall be a post audit requirement in the issuance of business
permit.

b) New struc{ures

i.) No building permit shall be issued for residential, commercial, induslrial,


institutional, and governmenlal structures unless the design of the seplic tank or
wastewater treatment facility in the building plan conforms with existing
environmental laws and policies; and

ii.f Water DischargePermit or clearances/permits required by the DENR, DOH and


other existing laws shall be a post audit requirement in the issuance of a
business permit.

SECTION 93.DES|GN OF SEPTIC TANKS All septic tanks shail be designed to exctude
storm water from downspouts, and such other requirements and specifications as provided by
national standards. The Building Official, pursuant to Presidential Decree No. 1096 otheruise
known as the National Building Code of the Philippines and Republic Act '1378 or the National
Plumbing Code of the Philippines, is mandated to ensure that appropriate standard designs of
septic tanks shall be enforced in the approvals and inspection procedures.

SECTION g4.MANDATORY DESLUDGING OF SEPTIC TANKS.

a) All owners and users of septic tanks shall be required to desludge once every five (5) to
seven (7) years.
b) The opening of septic tanks, for desludging purposes, shall only be done with the
authority of the owner or user.

SECTION 95. REGULATION Ot.I DESLUDGERS.

a) Only DENR and/or DOH accrcdited entities, complete with permits, shall be allowed to
provide septage collection and transporl services. Collected septage shall only be
disposed and treated in a DENR and/or DOH accredited disposal/treatment facility with
pertinent permits.
bl Septage removed from septic tanks shall be transported only by a DOH/DENR
accredited septage hauler/pumper to the approved septage treatment facility pursuant to
the regulations prescribed by the DOH. Unless olherwise provided by law, no septage
hauler/pumper shall be allowed to collect transport and upload or dispose of septage in
other places, including bodies of water, agricultural fields and the drainage system within
the city.
c) All entities engaged in desludging activities are required to secure Permit to Transport
from the DOH/DENR, Environmental Sanitation Clearance from DOH, Sanitary Permit
from the City Heatth Ofiice, and other perlinent permits as may be deemed necessary as
part of the requirements for issuance of annual business permit from the City.

SECTION 96.USER FEES AND OTHER OPTIONS.

a) The City Government of Valenzuela may appropriate or raise funds to subsidize


necessary expenses for the establishment and/or operation and maintenance of sewage
treatment of septage facility through appropriate local property taxes and enforcement of
a service fee system.

b) The City Government of Valenzuela may pursue funding assistance from both local and
foreign sources, either public or private, through mutual agreements subjec{ to existing
accounting and auditing rules and regulations.

c) Further, the City Government of Valenzuela and its barangays may raise funds and
allocate budget to subsidize necessary expenses for the construction of communal
septic tanks in their areas of jurisdiction.

SECTION gT.SEWERAGE SYSTEM MANAGEMENT.

a| The City Government of Valenzuela shall provide assistance in securing necessary


permits, right of way, lEC, land acquisition to the water utilities in the installation and
maintenance of sewer lines and construction of wastewater treatment facilities within the
CitY.

b) Only domestic wastewater sources shall conneci to existing sewer lines

structures to "domestic wastewater quality" in accordance with the requirements forth

d) Said connection to existing sewer lines shall be subject to sewerage service


charges/fees (if any) in accordance with existing laws, rules, or regulations as identified
by the water utilities.

SECTTON 93.PROHIBITED ACTS.

The following acis are prohibited and shall be subjec{ to the imposition, assessment and
collection of administrative penalty provided herein:

a) Refusal to desludge as required by this Code:


bl Refusal of new and existing residential, commercial, industrial, governmental, and
institutional facilities to connect to available sewer lines;
c) Dumping of septage, untreated wastewater (not wilhin the standard set forth by DENR)
and solid waste to drainages, canals, rivers, and other natural and artificial watenrvays
and other open areas;
d) Desludging and transporting of septage without the necessary permits and accreditation
from the authorized permitting agencies;
el Hiring/availing the services of illegal/non-accredited desludger, transporter by any
person or establishment to desludge septic tanks or dispose of their wastewater; and
f) Building/structure (residenlial, commercial and industrial without necessary septic tank in
accordance with the P.D. No. 1096 (National Building Code of the philippines and R.A.
'1378 or the National Plumbing Code of the Philippines;
g) Building/Structures (commercial, industrial, government and institution buildings) without
necessary Wastewater Treatment Facility and Sewage Treatment plant (STp) if
required;
h) Allowing the construction of structure (house/building without the required septic tank
shall also be held liable.

SEGTION 99. MONITORING AND EVALUATION.

The City Building fficial, in coordination wilh the Cily Health Ofiice - Sanitation ffice, the City
Environment and Natural Resources office (cENRo), Business permit and Licensing office
(BPLO) or its equivalent, shall be required to evaluate the compliance of structures and facilities
to the provisions of this Code.

SECTION lOO.PENALTIES.

Any owner or user of residential, commercial, industrial, governmental, and institutional


struclures who fails to comply with the provisions of this Code shall incur the followin gfines and

complaint, Bantay llog personnel shall have the power and authority to enter, inspecl and
examine the establishment complained of to inquire compliance with the existing laws and

employee or investigate any fact, condition or matter which may be necessary to determine any
violation. or which may aid in the effective enforcement of this Act and its implementing rules
and regulations, provided that the inspection team shall be duly authorized in writing by the
head of City External Service Ofiice to conduct such inspection, specifying therein the date of
inspection, the names of inspection personnel and the complaint filed against sald
establishment.

ln the implementation and enforcement of this Section, the inspeciion team shall be composed
of the following members, specialized technical personnel from the city Environment and
Natural Resources Office, Bantayllog, Office of the Building Official, Task Force Disiplina and in
special cases, the Housing and Resettlement Office.

The administrative penahies collected in the enforcement of this Code shall be exclusively
earmarked for the following programs and activities:

i.) Preservation and conservation of rivers and wateruvays;

ii.) lnformation, dissemination and public awareness campaign regarding the importance
and significance of rivers and waterways and en@urage active public participation in
its rehabilitation and preservation by conducting, organizing and coordinating
trainings, seminars, cleaning programs and such other activities that will promote
direct and ac{ive participation from all sectors of society;

iii.l Procurement of equipment and maintenance thereof;

v.) Other programs and activities analogous to the foregoing

be the sole implementing authority for this Code and may issue such necessary executive and
any other orders for the purpose. Whenever t e City Mayor so determines, Bantayllog, thru the

TITLE THREE
SANITATION STANDARDS FOR PUBLIC TOILETS

SECTION 't07. SCOPE. The provisions of this Code covers all public toilets within the City of
Valenzuela accessible to the general public including those provided for by gasoline stations,
private and public schools, department stores and the likes, supermarkets and other
establishments.

SECTION 108. GENERAL PROVISIONS. For purposes of clarity in implementation, the


following provisions shall be enforced:

a) Design and Construction. All public toilets must have a solid floor (either tiled or I

paved) with a properly working flushing system and the appropriate septic tank for
proper waste water disposal. Likewise, all public toilets must have a properly working
door which can be locked from the inside.

b) Water Supply. All public toilets must be provided with an adequate running water supply
from a properly funciioning plumbing system.

c) Furnishings. All public toilets need to be furnished with the following fiXures:

c.1An adequate toilet bowl with a properly working flushing systems;

c.2A properly working hand wash basin with furnished soap;

c.3A properly covered refuse receptacle (waste basket);

c.4ln the case of businesses with a capital expenditure of more than Two Hundred Fifty
Thousand Pesos (Php250,000), a properly working bidet.

d) Maintenance.All public toilets must be kept reasonably clean and properly treated with
disinfectants at least once every twenty four (24) hours.

SECTION 109. PENALTIES. For purposes of clarity in implementation, the following provisions
shall be enforced:

(a) Any violation of any of the provisions of Section 108 of this Code will be given a Notice
of Violation and issued an order for compliance with a reasonable period of 30 days with
an accompanying penatty of Five Hundred Pesos (Php500.00) payable on the renewal
of the establishment's business permit. lf the said establishment fails to comply with the
provisions of this Code within the 30-day grace period, a second Notice of Violation will
be issued with an accompanying fee of One Thousand Pesos (php't,OOO.O0) also
payable upon the renewal of its busin license. lf the establishments still refuses to
comply with the provisions of this C e for another 30 days after the issuance of a

any other noxious waste unless the site has been designated for such purpose and with
the approval of the local health office or other concemed agencies.

b) By-products such as bagasse, rice hullsand other similar particles shall not be stored or
dumped in an open or exposed area without any covering or protective material which
shall prevent such by-producis from scattering or being blown away by the wind.

c) There shall be no structure, materials, equipment, machinery, or vehicles abutting unto


public streets or sidewalk that affecls and obstruc{s the convenient passage of traffic and
passer-by.Streets used as ng for vehicles or for any other purpose shall be
subjected to the approval th local heatth authority under existing local regulations

d) Any structure or parts thereof that was decayed, damaged by fire or termites,
declared as "condemned" and to which in an assessment of the health ofticer that the
struclural integrity is questionable and shall constitute a hazard to public heatth and
safety shall be demolished within such reasonable time as the local officer may order
after due written notification of the owner or operator.

e) Machinery, equipment, or any structure or material placed u nprotected, unguarded,


insanitary, or situated or operated in a public or private premises which constitute as
nuisanc€ shall be confiscated or abated within thirty (30) days after its assessment by
the local health office and writlen notification of the owner or operator. l

f) Establishments that are emitting dense smoke or noxious fumes, vapors, gas, dust, soot,
or cinders, in unreasonableor toxic quantity that adversely affec{ heatth and sanitation
shall be dealt accordingly by the local health officer concerned.

s) Establishments engaged in the processing and manufacturing of explosives,


inflammable liquids, and other toxic and hazardous substances shall be located 300
meters away from densely populated areas (residential, commercial, and institutional
areas).

h) Public or private premises or buildings/struG{ures construcled, altered or operated in


violation of the Code on Sanitation of the Philippines (P.D. 856), the Buitding Code of the
Philippines (P.D. 1096), the Civil Code of the Philippines, its implementing rules and
regulations, and other existing laws and local ordinances shall be declared as nuisance
and the local health ofilcer shall have the authority or the power to order in writing the
operator, to conec{ or remove the said nuisance within such reasonable time as the local
health ofiicer may order.

SECTION 112. BREEDING PLACES AND HARBORAGE OF VERMIN.

a) The owner or operator shall be responsible for the control of vermin and its breeding
places within his establishments or premises.

b) The growth of weeds, grasses, and bushes outside, within the premises of ihe
establishment, or in any public or private vacant lots shall be controlled to
prevent the breeding or harborage of harmful insects and animals (e.g. spiders,
scorpions, or snakes).

c) No person shall use any dangerous toxic chemical in spray or in mist form in
concentrations exceeding the maxim permissible standard set by the Fertilizer and
pesticide Authority and other regulatory agencies for the purpose of weed

d) The control, method, procedure and frequency shall be in accordance with


provisions of Chapter XVI - "Vermin Control" of the Code of Sanitation of the Philippines
(P.D. 856) and its implementing rules and regulations.

SECTION 113. ANIMALS AND CARCASSES WHICH ARE INJURIOUS TO HEALTH.

a) A dead animal shall be disposed by its owner within twenty-four (24) hours after its death
and in such a manner complying with Chapter XVll - "Refuse Disposal'of the Code on
Sanitation of the Philippines (P.D. 856) and its implementing rules and regulations and i
other local ordinances.

b) Whenever a dead animal is indiscriminately disposed in any privale public place to which the
owner of such animal is unknown, the local health officer has the authority to direct his
authorized representative to bury it in a manner complying with chapter XVlll "Refuse
-
Disposal" the code on sanitation of the phitippines (p.D. 856) and its implementing rules
and regulations.

c) The sanitary requirements for the segregation, storage, colleclion, transport, and
finaldisposal of refuse shall be in compliance with chapter xvlll "Refuse Disposal,,of

thecode on sanitation of the philippines (p.D. 856) and its implementing rules and
regulations and all olher pertinent laws, rules and regulations, and local ordinances.

according to its best usage as staled in the Department of Environment and Natural
resources standards, rules and regulalions.

SECTION 1,I5. ANIMAL STOCKADE MAINTAINED IN A MANNER INJURIOUS TO HEALTH.

a) All animal stockade shall be kept reasonably clean and free from accumulation of
manure and other refuse.

b) All animal stockade, whether temporary or permanent, shall be required to have a


flooring which is impervious, free from cracks and crevices, and properly sloped (2 o/o) to
provideefiicient drainage.

c) Adequate water supply both for drinking and cleaning and for other domestic purposes
shall be provided in the establishment.

d) Every animal stockade or other animal enclosures shall be provided with a waterlight.
easy to carry, and vermin-proofed receptacle for manure and other litler arising within
the premises ofthe stockade. Such receptacle shall always be securely covered except
on the time of emptying and shall be preferably disinfected after every use. No manure
shall be allowed to accumulate except in such receptacle.

e) All domestic animals such as those kept as pets, or used in the livestock industry and for
other purposes shall be under the effec{ive control of its owner or the operator of the
establishment. All stray animals shall be impounded by the local government concerned.

f) Livestock which are temporarily confined in abattoir/slaughterhouse shall be covered by


Chapter lV - 'Market and Abattoirs' of the Code on Sanitation of the philippines (p.D.
856) and its implementing rules and regulations.

sEcTtoN 116. EXCESSTVE NO|SE.

levels shall be so located in appointed areas designated under existing zoning laws and
other local zoning ordinances.

b) All persons exposed to noise which exceeds the maximum allowable noise levels
emanating within any construction site, establishment or premises such as those emitted
from certain equipment, machinery, vehicle tools or devices, shall be provided with
appropriate personal proteciive equipment (PPE).

premises which seryes as a nuisance and is the subject of complaint of the residents
within the area, the people may file a written complaint to the local health officer who in
return shall notify the owner or operator to abate such nuisance within thirty (30) days
after such notification or within a shorter time prescribed by the local health officer the
latter shall prohibit such nuisance or provide measures to prevent such nuisance at the
expense of the owner or operator or person concerned.

SECTION 118. ILLEGAL SHANTIES IN PUBLIC OR PRIVATE PROPERTIES.

moderation in creating unnecessary noises, or any activity which may tend to influence
