ORDINANCE NO.525
Series of2018
WHEREAS, the protection and promotion of the health, and the right to a clean
environment of its constituency is the primary concern of the City;
WHEREAS, it is the policy of the City to promote the conservation, protection and revival
of the ecosystem through prevention, control and abatement of air, water and land pollution,
nuisance, and spread of hazardous wastes in the environment, hand-in-hand with the sustained
development of the City;
WHEREAS, the city council being the tegislative body of the city and as mandated by
the Local Govemment code of r99r, has enacted and approved ordinances, in addition to and
in adoption of laws passed by the national govemment to protect the environment and impose
appropriate penalties for acts which endanger the environment;
WHEREAS, there is a need 1o update, integrate and codify these environmental laws to
ensure that they are in consonance and in keeping with modem standards of environmental
laws, and provide a comprehensive reference and guide for their implementation and
enforcement;

GENERAL PROVISIONS

SECTION 3.
OPERATIVE PRINCIPLES -This code is based on the vision, mission, goals and
objectives of the city to attain sustainable development based on the following principles:
a) The right to development must be fulfilled so as to equitably meet developmental and '
environmental needs of present and future generations;
b) ln order to achieve sustainable development, environmental proteciion shall constitute
an integral part of the development process and cannot be mnsidered in isolation from
it;
c) Active participation of all residents to attain sustainable development;
dl The use of environment-friendly and appropriate technologies is a basic foundation for a
heahhy and progressive generation;
e) climate change is a reality and adaptation and mitigation to its impacts can be
addressed by intensifying preparedness through access, availability and provision of
accurate information and skills to the people of Valenzuela City;
f) The polluter shall bear the cost of pollution;
gl The state shall protect and promote the right to health of the people.

line with the Valenzuela City's policy to promote the conservation, protection and revival of the
ecosystem through prevention, control, and abatement of air, waler, landpollution and nuisance
as embodied in the following national and local laws and policies:

Philippines;

Administrative penalty - a legal mechanism that allows the local government to penalize lhe
violation of this ordinance, which consist of the imposition of monetary fine. lt is intended to
provide an alternative enforcement mechanism that is more cost- effective, timely and practical
than prosecuting the offender through the court system.

motorcycle vehicles.
Designated smoking Area - refers to a designated smoking area within a building, which may
be in an open space, or a totally enclosed delineated room or area with proper ventilation inside
an accommodation and entertainment establishment or enclosed public place where a person is
allowed to smoke without violating the Ordinance. 1) Accommodation and entertainment
establishments or enclosed public places with air conditioning facilities shall establish and
designate a smoking area or room that is fully ventilated and separate from the rest of the
premises where smoking is prohibited. 2) Designated Smoking Areas in Accommodation and
entertainment establishments or enclosed public places shall prominenfly display 'SMOKING
AREA" signages. Non-smoking areas shall likewise have legible, highly visible, and prominenfly
displayed "NO SMOKING AREA" signages.

Domestic Animal - any animal, such as horse, catfle, swine, fowl, etc., which has been
suppressed by man to live and breed in a tamed condition.
Domestic wastewater -
means wastewater derived principally from dwellings, business z
buildings, institutions and the like; Sanitary wastewater; sewage; The waste produced in the
course of a domestic ac{ivity
Drainage - artificial pipes or conduits provided by the LGU for carrying flood water (no sewage
nor waslewater shall pass through drainage systems)
Effluent - a general term denoting any wastewater, partially or completely treated or in its
natural state, flowing out of a drainage canal, septic tank, building, manufac{uring plant,
industrial plant, treatment plant, etc.
Enclosed area - refers to an area that is physically separated from adjacenf areas by walls or
partitions and a roof of ceiling. The walls or partitions must be continuous, interrupted only
by
doors and windows. The mere presence of a roof or ceiling over the structure, but without walls
or partitions sunounding said struc{ure, does not constitute an enclosed area;
Endemic species - means species or sub-species which is naturally occurring or found only
within specific areas in the country.
Establishment - a collective term construed to include all firms, institutions, entities, including
its premises, facilities, equipment, machinery, which are engaged in production, handring,
storing, transporting, selling, distributing, using, processing, and disposing any product
or
substance considered as a nuisance, orwhich are engaged in offensive tradeJ and occupation.

Exotic Species is a species living outside its native distributional range, which has anived
there by human activity, either deliberate or accidental.
Hazardous Tree -means a tree that is in inminent danger of falling and causing injury to a
person or damage to properly.
Homeowner - refers to the owner, lessee, us ary or any person who holds any tifle or

Hygienic septic Tank - a septic tank that is conducive to maintaining health and preventing
disease, especially by being clean, germ-free, unpolluted, uncontaminated and or in good
sanitary condition-

Organic Waste - a material that is biodegradable and comes from either a plant or animal-
Organic waste is usually broken down by other organisms over time and may also be referred to
as wet wasle. Most of the time, it is made up of vegetable and fruit debris, paper, bones and
human waste which quickly disintegrate;
Ornamental Plants - are plants that are grown for decorative purposes in gardens and
landscape design projects, as houseplants, for cut flowers and specimen display.
Owner - when applied to buildings or land, shall include any part owner, joint owner, tenant in
common, joint tenant or tenant by the entirety of the whole or part of such building or land.
Percon - is a person, firm, association, co-partnership, joint venture, corporation or any entity,
private or public in nature.
Person in charge - in case of public places or other establishments, this refers to the president
or manager in case of a company, corporation or association, the owner/proprietor as well as
the operator in case of a single proprietorship, or the administrator in case a government
property/building is involved. ln case of a public conveyance, the owner, the driver, the
conductor, and the caplain of a public conveyance.ln case of workplaces, lhe employer who
may be an individual employer, or a sole proprietor.Or if the employer is a corporation, all the
corporate officials.
Point'of-sale -
refers to any location at which an individual can purchase or otherwise obtain
tobacco products. For the purpose of these Rules, itineranuambulant vendors are not covered
by the term "point-of-sale';
Premises - refers to a tract of land and building or buildings thereon, including the open spaces
between the buildings located on the same tracl of land and within the perimeter of said tract of
land.
Pre-treatment Facility - means any apparatus or equipment used to modify the characteristics
of effluent prior to a wastewater disposal system, and includes grease traps, oil separators,
dilution pits and similar devices;
Public conveyance - any vehicle, whether mobile or stationary, available to the public as
mode of transport, such as, but not limited to jeepneys, buses, trains, tricycle and the other
similar vehicles:
Public Places - refer to enclosed or fined areas of all hospitals, medical clinics, schools,
public transpo terminals and ces, and buildings such a and p ublic offices

R,A. 9147 - An Aci Providing for the Conservation and Protec{ion of Wildlile Resources and
their Habitats.
Rolocation Tree - means a living tree that, according to a tree plan, an owner intends to
relocate or has relocated or that, according to this Ordinance, an owner must plant to replace a
tree on a site.
Separate Sewerage System - this involves the collection of sewage from households which '
will be conveyed through the sewer pipelines going to a Sewage treatment Plant or STP;
Septage- a combination of scum, sludge, and liquid from household septic tanks, thickened
and partially treated sewage that is removed from a septic tank;
Septage i,lanagement - also known as 'desludging" this involves the depository of the
households sewage to a properly designed septic tank and collected by a desludging truck
going to a Septage Treatment Plant (STP);
septage Trcatm€nt Plant - a series of structure purely for the process of treating septage in
order to comply with DENR effluent standards;
sewage - any wastewater containing human, animal, or vegetable waste matter in suspension
or solution, including human excreta and urine, and may possibly contain liquids consisting of
chemicals in solution;
Sewer or sewer lines - pipes or conduits for carrying sewage and/or wastewater;
sewerage Disposal system - is the proper disposal of effluent using either a separate
Sewerage System, combined Drainage system, or Septage Management whichever is required
or accepted by existing environmental laws and policies;
Sludge - a solid particle of domestic sewage which settles at the bottom of the sedimentation
tank, and is digested by anaerobic bacteria purely from domestic sources,
Smoking - refers to the act of carrying a lighted cigarette or other tobacco products, whether or
not it is being inhaled.
Sound Amplifying Equipment - is any machine or device for amplification of the human voice,
music or any other sound, but shall include: 1. Automobile radios, stereo players, or television
receivers used and heard only by the occupant of the vehicle which the same is installed;
Radio, stereo, players, phonographs or television receivers used in a house orapartment withi
any residenlial zone or within 500 feet thereof 3. Horns or other devices authorized b
law on any vehicle when use r traffic purposes

Sound Level (Noise Level) in decibels (dB) - is the sound measured with an "A weighing
and slow responses by a sound level meter, except an impulsive or rapidly varying sounds
levels, the fast response shall be used.
Sound Truck - is any motor vehicle or any other motor vehicle regardless of automotive power,
whether in motion or stationary which carries or is equipped with or which has a mounted '
thereon, or attached thereto any sound amplifying equipment.
Sprees and Revelries - refers to any occasion of celebration or rejoicing, aftended by a group
of persons and is usually accompanied by drinking of liquor, singing, and other acts of jubilation.
Tobacco - refers to agricultural crmponents derived from the tobacco plant, which are
processed for use in manufacturing of cigarettes and other tobacco products;
Tobacco Products - refers to any product that consist of loose tobacco that contains nicotine
and is intended for use in a cigarette, including any producl containing tobacco and intended for
smoking, oral or nasal use. Unless stated othen rise, the requirements of this Ordinance
pertaining to cigarettes shall apply to other lobacco produc{s.
Trees - means a self-supporting, perennial, woody plant thal has a trunk or stem and a root
system.
Tree Planting lay out - means a simple graphical representation in form of sketch indicating
the location of the trees and plants to be planted or shall be incorporated to the site
development plan.
Tree Protection Plan - are annotated to demonstrate necessary tree prolection measure
required during the construction process.
vertical Gardening - is a garden that grows upward (vertically) using a trellis or other support
system, rather than on the ground (horizontally). Anything grown on a trellis or even a fence is
technically part of a vertical garden.
videoke / video Karaoke Machine, unit - Any equipment or musical contrivance comprising
of television set or monitor, video player, amplifier, speakers, microphones and any sound
system used for sing-along whereby lyricsof a song with accompanying visual backdrops are
seen on a monitor or screen.
Wastewater Treatment Plant - a series of struciure thal processes the treatmenl of sewag
mostly from domestic origin, but may include pr+treated liquid wastes from industries a
similar establish and may also accept the treatment of septage, provided there

CHAPTER FOUR
OFFICE
SECTION 5. IMPLEMENTING OFFICE -The City Environment and Natural Resources Office
(CENRO), Waste Management Division, Flood Control Division and Clean and Green Division
under the Public Sanitation and Cleanliness Group (PSCG), City Agriculture Office (CAO), City
Veterinary Office (CVO),Task Force Disiplina (TFD),City Health Office (CHO) - Sanitation Office,
Office of the Building Official (OBO), Business Permit and Licensing Office (BPLO),Zoning
Office,Public Safety Division (PSD), Valenzuela City Transportation Office (VCTO) and Traffic
Management Office under the Public Order and Safely Group (POSG)shall be known as
"Office" lor brevity, are mandated to develop and implement Valenzuela City's Comprehensive
Environmental Protec'tion, Conservation and Management Program as provided in this
Environmental Code.
SECTION 6.
RESPONSIBILITIES OF THE OFFICE - The imptementing office shail devetop

Management Program, with the following specific functions, duties and responsibilities:

2.',t.a Ensure the efficient management and administration of waste collection of the
City, consistent with the rules and regulations to Republic Act 9003;
2.1.b Ensure lhat all domestic waste and garbage in the City are collected and I
disposed of in places designated by the Cily Government in accordance with the
provisions of Republic Act 9003, the rules and policies intended thereto;
2.1.c Devise, develop and formulate systems and procedures for the proper and
effeclive operation and administration of waste management in the City, which
shall also include its improvement and development;
2.1.d Provide technical and other forms of assistance to the barangays as partners of
the City Government in waste control and management and to ensure the
cleanliness of Community in general;
2.'.t.e Conduct information, education and communication campaign on the ecological
solid waste management through seminars, meetings, installation of billboards,
tarpaulins signages, distribution of flyers and other effective non-traditional
information strategies;
2.1.f lmplement civic consciousness programs geared towards environmental
protection as mandated by the national government agencies in coordination
with the barangays and non-govemment institutions;
2.',t.9 Execute and enforce all laws, ordinances and regulations relating to waste
Management and recommend prosecution of any violation thereof;
2.'t.h Exercise such other powers and perform such other duties and functions as may
be prescribed by law or ordinance.
2.2.a Does streetsweeping operations and maintains cleanliness on all major and
secondary roads within the jurisdiction of Valenzuela City.
2.2.b Weeding along sidewalks of major and secondary roads within the areas of
operation.
2.2.c Clearing of paper posters along the roadsides
2.2.d Responsible for trimming and tree cutting operations.
2.2.e Collec{s debris (garbage, soil and other waste materials) along the roadside.
2.2.t Remapping on major and secondary roads.
2'2.9 Removal of posters, tarpaulins, signages and other campaign material along th
roadside.
2.2.h Tree Planting
2.2.i Performs clean up operations:
r Before, during and after any special events of the city.
. On assisting emergency vehicular accident.

2.3.a Enforce and implement all existing National Laws (i.e. Republic Act No. 9275 or
Clean Water Act, Republic Act No. 9003, Solid Waste Management Act,
Presidential No. 1067, The Water Code of the Philippines, and the likes) and
various City Ordinances pertaining to rivers and watenvays proteciion and
preservation;
2.3.b lmposition and collection of administrative fines and issuance of appropriate
Environment Violation Receipt(EvR) in case of violation of this Ordinance and t
other various Ordinances pertaining to the protection of rivers and watemays;
2.3.c Raise public awareness regarding the importance and significance of rivers and
waterways and encourage active public participation in its rehabilitation and
preservation by conducting, organizing and coordinating trainings, seminars,
cleaning programs and such other activities that will promote direct and aclive
participation from all sectors of society;
2.3.d Report and monitor all violations, compliance and condition of all rivers and
wateMays within the City;
2.3.e Assist in the prosecution of violator/s of all existing National Laws and City
Ordinances pertaining to rivers and watenrvays proteclion and preservation;
2.4.1 Such other powers, functions and duties as may be delegated to it.
a. The City Agriculture Office and other concerned agencies shall determine and
recommend adaptable and suitable species of native/indigenous trees and
ornamental plants, or shrubs that can be planted along open spaces, parks,
creeksides/riverbanks.
c Develop plan and strategies and implement the same upon the approval of the
Sanggunian orthe City Mayor, particularly those which have to do with
veterinary related aclivities which the Sanggunian or the Mayor is empowered to
provide, to the limitations provided for under the Local Government Code
d. Mon and manage the Valenzuela City Pound and assume the dut
res sibilities provided for in n3, paragraph 3.2 of O No.36,

e Stray animal collection shall be undertaken by the Animal Control Unit and shall
be kept in the Valenzuela City Pound.
7. SANITATION OFFICE

10. ZONING OFFICE AND LOCAL ZONING BOARD OF ADJUSTMENT AND APPEAL
a Zoning Office and Local Zoning Board shall require every owner/developer in lhe
City, such as but not limited to lndustrial, Shopping Malls, Residential
Condominium, Residential Subdivision, Commercial subdivision, and Residential
Townhouses a copy or copies of the lnitial Environmental Examination, duly
certified by a licensed Environmental Planner as one (1) of the requirements for
the issuance of a Locational clearance.

SECTION 9.
THE RIGHT OF ENTRY AND AUTHORITY TO INSPECT AND ]UIONITOR

SECTION 10. INTERFERENCE AND FALSE REPRESENTATION -lt shall be unlawful for an
person to resist or in any way interfere with any officer, employee, or authorized representative
of the Office in the performance of his/her duty, or who shall impersonate or falsely represent
any officer, employee, or authorized representative of the Office, or wear without authority any
uniform or logo adopted by the Office. , or who shall deface, change or alter, falsify, remove, or
destroy any notice, poster, or making placed in or on any building, premises, or part thereof, or
any person in charge of any building, premises, or place, or parl thereof, who shall knowingly
permit or allow the same to be done.
CHAPTER FIVE
BIODIVERSITY MANAGEMENT
ln case the owner requested the city for the cutting/balling out of the tree/s and its proper
disposal, it shall befree of charges.ln case an accident occurs during the cutting/balling out and
disposal thereof, the City Government of Valenzuela shall not in any way be held accountable
on the accident.
SECTION '12, The planting of indigenous trees, fruit-bearing trees and ornamental plants shall
be the center of activities during the celebration of "Arbor Day" in Valenzuela City every l5h
of June.
SECTION 13. At the Barangay level, all Barangay Officials, Public and Private Partners, Civic
Organization, Community Members and School Authorilies including officers and members of
Parents and Teachers Association (PTA) in coordination with CAO, CENRO and Clean and
Green Division shall be the prime movers in pursuing the objec{ive of Arbor Day celebration by
implementing tree planting projects and giving instructions and guidance to participants, and
infusing in their minds the significance and importance of planting trees to one's environment.
SECTION 14. ENDANGERED AND EXOTIC SPECIES - lt shall be unlawful to sell endangered
and exotic species in malls or any establishments as ln the same manner, il shall likewise

not less than six (6) months, or both, atthe discretion of the Couft.
TITLE ONE
VALENZUELA CITY TREE PLANTING
SECTION 17. COVERAGE. - The commercials, industrial, residential used for commercial and
business purposes, memorial lots, parking area and the like are covered in this Ordinance.
b.) The Zoning Administrator shall provide CENRO a list of all issued Locational
Clearance covered by this Ordinanc,e for their monitoring and proper
implementation.
c.) Both new building permit and business permit application and renewal of
business permit, Tree Planting lay out shall include in the requirements on
applying of Locational Clearance with the City Zoning Office
d.) The Office of the Building Official may issue the Certificate of Occupancy
provided that any proof of on-going completion or any proof of compliance being
made.

1.1 Trees must be planted so that each parking space is no more than
twelve(12) meters from a tree trunk, unless the parking lot has continuous
islands running the length of the parking lot with minimum 2.4 meters width;
then the requirement will increase to five(S) meters from a tree trunk.
1.2 Bus and taxi lots will be required to plant trees ten(10) meterc apart around
the perimeter of the parking lot in a minimum 3 meters wide planting strip. lf
there is parking on the perimeter of the bus and tractortrailer lots, bollards
or wheel stops are required.
2.1 Trees must be planted so that each parking space is no more than three
(3) meters from a tree trunk. Trees planted must be large maturing shade
trees.
Minimum planting area per large maturing shade tree shall be 3 square
meters.
2.2 Small maturing trees may be planted where overhead power distribution
lines would interfere with normal growth. Minimum planting area per small
maturing tree shall be one(1) square meter. The entire planting area must
contain amended on-site soil, as specified in the tree ordinance guideli

1. The property owner must include in the tree suNey all existing trees of two (2)
inch DBH or greater which heishe proposes to satisfy these planting
requirements.
2. Only healthy trees and those that have been protected during the entire
development period, beginning prior to the commencement of site work and
continuing through to issuance of the certificate of occupancy in accordance
wilh approved tree protec{ion requirements, may satisfy these tree planting
requirements.
3. lf an existing tree will obstrucl the construction site, a permit must be secured
prior to the removal or relocation, more so the removed tree must be replace by
the same species or other approved species of trees within the vicinity of the
area.
a. The land owner when required to submit an existing tree planting lay out for tree
save area boundaries shall be required to be surveyed and be described in metes
and bounds.
b. All applications for grading, building, demolition, land use, change of use or rezoning
permits on all property, except single-family subdivision shall require a tree survey.
The survey shall identify all trees within the tree protection zone and all planted trees
that grow parlially or wholly within the city righlof-way.
c. The Cily Environment and Natural Resources Office shall make an inveniory of the
trees in the Public Property such as Schools, Cemeteries, Hospitals, Parks and all
other property use for public purpose governed by any contract or MOA .
d. City Govemment of Valenzuela thru Public lnformation Office, two (2) months before
the effectivity of this ordinance, must inform all Private property owners having a lot
of 200 square meters and above to secure and fill-up Tree survey form from
CENRO.
e. Tree Survey form must be submitted on the time of payment of Real Property Tax or
Renewal of their Business Permit, However, if the required Tree Survey Form is not
yet available on the time of paymenl of Real Property Tax or Renewal of Permits, it
will be a post audit requirement in the issuance of building permit and business
permit.
f. The property owner must submit furnished copy of the accomplished Tree Survey
Form to the CENRO.
g. The CENRO shall furnish a copy to OBO, Zoning Office and City Agriculture.
h. lf the property owner was found no trees planted in the vicinity of their property, they
must submit a Tree Planting lay out in compliance of Section 4 of this Ordinance.

i. ln case that a commercial land or building do not have a vacant lot for planting trees,
the owner of the said commercial land or building is required to install a vertical
gardening wherein its size is appropriate to the size of their building or premises.
They may choose an omamental plants suggested by the Valenzuela City
Agriculture Office found in letter (f) of section 4 of this ordinance.
k. ln case an industrial land or building does not have enough space or vacant lot to
plant trees, the owner of the said industrial land or building must adopt a property, it
may be public or private for them to plant trees suitable to the said area.Owner of the
industrial lot may seek an assistance and recommendation from their Punong
Barangay. A Memorandum of Agreement (MOA) shall be made between the '
industrial lot owner and the owner of the adopted property for their mutual
responsibilities in taking care and protecting the existing trees. On the other hand,
the Punong Barangay will act as the witness to the said MOA. However, if the
Punong Barangay re@mmends a certain public property owned by the school, the
MOA will be between the Department of Education, represented by the school's
division superintendent and the industrial lot owner. Whereas, if the property is
owned by the City Government, the agreement will be made between the City Mayor
and the department head in-charge of the particular government entity.
l. All Punong Barangay shall make a land inventory and maintain a data base of vacant
lots maybe utilized for tree planting in relation to letter (k) of this section. The Punong
Barangay must furnish a copy of the said data base to Zoning Office, OBO and
CENRO.

I. PRIVATE PROPERTY
a. Any person owning or occupying real property bordering on any street where
trees and plants have branches, limbs, trunks, or other parts projecting into the
public street or property shall prune such trees or keep them trimmed in such a
manner that they will not obstruct or shade the stree ights, obstruct or interfere
with the passage of pedestrians on sidewalks, obstruct vision of traffic signs, or
obstruct views of any street or alley intersection.
b. Any person owning or occupying real property bordering on any street, park or
other public properly, on which there may be trees and plants that are diseased
or insect infested, shall remove, spray or treat any such trees in a manner that
will not infect or damage nearby public vegetation or cause harm to the
community or citizens therein.
c. lt shall be the duty of the property owner to maintain all trees and plants planted
pursuant to, or protected by, this ordinance in a heahhy condition in accordance
with this section and the tree ordinance guidelines developed by the CENRO.
Trees shall be allowed to grow to their natural height and form.
d. When trees that are subjec{ to or protected by this ordinance die, missing, or are
otherwise deemed unheahhy by the CENRO, they shall be removed and
replaced by the property owner to comply with any existing planting plan or as
directed by the CENRO. New owners of properties already in compliance must
maintain that compliance. Trees of the same, approved species as those existing

Nothing in this section is intended to impose a requirement that the property

of trees on private property that cau se obstructions, present insec{ or disease

public heahh, safety, or welfare, the CENRO may act without prior notification to
the property owner or occupant.
a. Agents, officials or other qualified persons designated by the city are authorized to
inspect the sites subject to this chapler to determine compliance with this chapter or
rules or orders adopted or issued pursuant to this Ordinance.
b. No person shall refuse entry or access to any authorized city representative or agent
who requests entry for the purpose of inspection, nor shall any person resist, delay,
obstruct or interfere with such authorized representative while in the process of
carrying out official duties.
c. lf, through inspeclion, it is determined that a property owner or person in control of
the land has failed to comply or is no longer in compliance with this Ordinance or
rules or orders issued pursuant to this Ordinance, the city will serve a writen notice
of violation. The notice may be served by any means authorized, or any other means
reasonably calculated to give actual notice, such as facsimile or hand delivery. A
notice of violation shall identify the nature of the violation and shall set forth the
measures necessary to achieve compliance with this Ordinance. The notice shall
inform the person whether an administrative penatty or other penalty provided by the
Ordinance. The notice shall advise that failure to correc{ the violation within the time
specmed will subject that person to the Administrative penalties or any other
authorized penalty action as provided.
The City shall have the power to conducl such investigation as it may reasonably
nec€ssary to carry out its duties as prescribed in this Ordinance, and for this
rpose may enter at reasonable times upon any property, public or private, for the
purpose of investigating and ins pecling the su

SECTION 25. IMPLEMENTING RULES AND REGULATIONS. - While this Ordinance and the
provisions hereof are already operative upon the Ordinance's effectivity, the City Mayor, through
its authorized agency, may issue the additional, appropriate, and relevant rules and regulation
forthe proper implementation of this Ordinance or its provisions.
TITLE TWO
TITLE THREE
ECOTOURISM ZONE
SECTION 28. ECOTOURISM ZONE. -The l0lhectare area of Barangay Tagatag as indicated
and shown in the Zoning Map of Valenzuela City, Metro Manila, is hereby declared as
ecotourism zone.

All application for building, business and related permits shall be required to submit appropriate
clearances from the Barangay Council of Barangay Tagalag, City Tourism Office, City
Environment and Natural Resources Office, City Planning ffice and other ffices concerned as
maybe mandated by the City Mayor.
The administrative penahies collected in the enforcement of this Code shall be exclusively
earmarked for the following programs and activities:

CHAPTER SIX
SOLID WASTE MANAGEMENT
a) Develop the city solid waste Management plan that shall ensure the long-term
management of solid wasle, as well as integrate the various solid waste management
programs and strategies of the barangay in its area of jurisdiction. ln the development
of
the solid waste Management plan, it shall conduct consuhations with the various
seclors of the commun ity. The City Solid Waste Man lan must include an

every three (3) years thereafter. There is no prohibition from implementing re-use,
recycling and composting activities designed to exceed the 25% goal.
b) Adopt measures to promote and ensure the viability and effective implementation of
solid waste management programs in its component barangays:

various political subdivisions and in cooperation with the private sector and the NGos;

accumulate source separated recyclable materials to be collected by the
barangay or private collector; and
2l Notify the occupants of such buildings of the requirements of the Act and the
regulation promulgated pursuant thereto.
d. For all commercial, institutional and industrial establishments, the owner or head of
the institution shall strictly comply with the following requirements;

for the implementation and enforcement of the ecological solid waste management systems
within the territorial jurisdiction of the Cily. Waste colleclion shall be conducted at the barangay,
and further sorting and segregation at the Materials Recovery Facility,

SECTION 42. WASTE SEGREGATION AND VOLUtIE REDUCTION AT SOURCE - Volume
reduction at the source shall be the first priority of the ecological SWM system. The City
Government promotes among its constituents the reduction and the minimization of wastes
generated at source; responsibility for sorting and segregation of biodegradable and non-
biodegradable wastes shall be at the household level, business, commercial, industrial and
institutional centers, and in all other point sources of solid wastes.
a.) There shall be a separate container for its type of waste from all sources. For bulky
waste, it will suffice that the same be mllected and placed in a separate container and in
designated area.
b.) The solid waste container depending on ils used shall be properly marked or identify for
on sight collection as "compostable", recyclable or special waste, .or any other
classification as may be determined by the NSWMC, and;
c.) For premises containing six (6) or more residential units, the owner of person in charge
of such premises shall stric{ly comply with the following requirements:
1) Provide for the residents at the designated area and container in which to accumulate
source separated recyclable materials to be collected by the barangay or private
collec{or; and
2) Notify the occupants of such buildings of the requirements of this ordinance and the
regulations promulgated puGuant thereto.
d.) For all commercial, institutional and industrial establishments, the owner or head of the
institution shall strictly comply with the following requirements;

r SECTION 44. MINIMUM STANDARDS FOR THE COLLECTION, TRANSPORT AND
HANDLING OF SOLID WASTES -The following shall be the minimum standards and
requirements for the collection, transport and handling of solid waste:
a.) All collectors and other personnel directly dealing with collection of solid waste shall be
equipped with personal proteclive equipment and paraphemalia such as, but not limited
to gloves, masks and safety boots, to protect them from the hazards of handling solid
wastes.
b.f The City Health Officer shall provide necessary training to the collectors and personnel
to ensure that the solid wastes are handled propedy in accordance with the guidelines
pursuant to the Act and to the training manuals developed by NSWMC.
c.) The equipment used in the collection and transportation of solid waste (or materials
which have been separaled for the purposes of recycling) shall be fabricated, operated
and maintained in such a manner as to minimize health and safety hazards to solid
waste management personnel and the public.
d,) Equipment shall be maintained in good condition and kept clean to prevent the
harbouring of vectors and the creation of nuisances.
e.! The use of separate mllection schedule and/or separate trucks or haulers shall be
required for specific types of wastes. OtheMise, vehicles used for the collection and
transporl of solid wastes shall be the appropriate compartments to facilitate efficient
storing of sorted wastes while in transit. The waste compartment shall have a @ver to
ensure the containment of solid wastes while in transit.
f.f Vehicles shall be designed to consider road size, condition and capacity to ensure the
safe and efficient collection and transport of solid waste.
g.) For the purpose of identification, vehicles shall bear the body number, the name and
telephone number of lhe contractor/agency collecting solid waste.

c) The sitting of the transfer station shall consider the land use plan, proximity or collection
area, and accessibility of haul routes to disposal facility. The design shall give primary
consideration to size and space sufficiency in order to accommodate the storage of
waste, and vehicles for the loading and unloading of wastes.
d) The following records shall be kept and maintained, and submitted to the DENR upon
request:

e) Waste shall be removed from the transfer station within twenty four (24) hours of its
receipt.

site accurate to within ten percent (10%) and adequate for overall planning purposes
and tracking of success of waste diversion goals; and

ocrurences, unauthorized loads, injury and property damage.

Composting facilities shall conform to the following sitting, design and operating standards and
criteria:
a) The Facility shall not be sited in areas subject to frequent flooding, unless
engineering controls are provided in the design lo prevent inundation of the facility.
1. Facilities shall be designed such that compost piles, windrows, residues and
processed material will not come in contact with surface storm run-off.
2. Where excess leachate storage is provided, discharge of leachate into any body
of water is prohibited unless such discharge meets the limits prescribed by the
DENR standards for effluents. Where leachate needs to be stored, it shall
comply with the provisions of Section 'l(k) of Rule XIV of this lRR. Provisions
shall be made such that leachate is re-circulated back into compost piles or
windrows as much as possible.

separate colleciion systems or convenient droFoff locations for recyclable materials and
particularly for separated toxic components of the waste stream like dry cell batteries and tires
to ensure that they are nol incinerated or disposed of in landfil The City Government shall
coordinate with the NEC during formulation of related ordi on this matter.

SECTION 49. AVAILING OF THE NATIONAL SOLID WASTE MANAGETVIENT FUND - ThE
City Government shall initiate effort to secure the approval of the NSWMC of the City Solid
Waste Management Plan and satisfy the criteria to avail of the Php 1,500,000.00 funding to
implement the plan.

SECTION 52. PROCESS FOR AVAILING THE LOCAL FUND -The Cily SWM Board shall
prescribed a simple procedure and proforma for fund application within fifteen days upon
approval of its ordinance. An efficient system of accepting, appraising and approving of
proposals will be established by the Board. Furthermore, report proforma as well as procedures
for the handling of the government funds, will be provided by the board. ln general, the
availment process shall start from the submission of a projecl/activity concept dra\ivn from the
City SWM plan. Once the concept proposal is approved, the proponent shall submit a detailed
version of the proposal for review and final decision by the board. Subjec{ to detailed guidelines
which the City SWM Boards will promulgate, the general process. ln no case shall the
community Fund be used for the creation of positions or payment of salaries.
SECTION 53. POWER TO COLLECT SOLID WASTE MANAGEMENT FEES - The Cily SWM
Board shall imposed fees on the SVVIVI services provided for by the City Government. ln
determining the amounts of the fees, the City SWM Board shall include only those costs direclly
related to the adoption and implementation of the SWM Plan and the setting and collection of
the local fees. This power to impose fees may be ceded to the private sector and civil society
groups which have been duly accredited by the City SWM Board: provided the SWM fees shall
be covered by a contracl or Memorandum of Agreement between the board and the private
sector or civil society group. The fees shall pay for the costs of preparing, adopting and
implementing the Cily SWM Plan prepared pursuant to the Ac{. Further, the fees shall also be
used to pay the ac{ual costs incurred in collecting the local fees and for project sustainability.

SECTION 56. COLLECTION AND RETENTION OF FINES -The collection of fines under the
penal provisions of the Act may be conducted by the City SWM Board or any other authorized
body. The colleclion shall be receipted. Ahernatively, the Local SWM Board and/or any duly
authorized body shall retain 40% portion of the collected fees from fines and remit 60% of the
same to the fund, as prescribed herein. Thereafter, the retained percentage is deposited under
the Local Fund, the procedure for which shall be defined by the City SWM Boad within fifteen
days upon effec{ivity of this ordinance.
SECTION 57. SPECIAL ACCOUNT -The City SWM Boards shall establish appropriate special
accounts for the fines, fees donalion and other monies collecled or generated under the Act and
this lRR. Thus, establishment of such special account is hereby authorized by the Cily Council
for that purpose.

barangays, shall allocate a portion of their funds, to public education and information activities
on ecological waste management particularly biodegradable and non-biodegradable wastes
including, but not limited to, installation of billboards on collection days for specific waste types,
other outdoor signages, stickers, flyers, conduct of seminars, and other effctive non-traditional
information strategies.

SECTION 65. INFRACTION - The dweller, lessee or the actual occupant of a residential
establishment found violating the preceding section shall be liable under this Code, to wit:
For commercial establishments and industrial with residential and commercial waste, the
following schedule shall be followed.
ln cases where there is no actual occupant in the subject premises at the time of violation of this
ordinance, the registered owner of the land, house or building shall be liable.
SECTION 66. NOTICE - Persons like under this Code shall be given written notice of violation,
personally or by registered mail, together with the Violation Receipt and two (2) pictures as
proof of violation of this Code. A copy of the Violation Receipt shall be fonrarded to the
Treasure/s Office of Valenzuela City. Payment of fines shall be paid to the Treasurels Office of
Valenzuela City.
No permits, license, clearance, certifications or any request from the City Government of
Valenzuela shall be issued to violators of this ordinance unless the said administrative fines are
fully settled.
CHAPTER SEVEN
AIR POLLUTION
SECTION 67. THE PHILIPPINE CLEAN AIR ACT -Republic Act 8749 otherwise known as the
Philippine Clean Air Act of 1999 aims at providing for a comprehensive air pollution control
policy in the country.

Since tricycle drivers are considered as belonging to the marginalized sec{or of society, there
shall be two phases in the implementation of the provisions applicable to them. There shall be a
grace period of six (6) months from the date of enactment of this Code for the conducl of a
massive information campaign and another six (6) months for the warning violation with no
penalties and charges yet imposable.
Any vehicles plying within the City of Valenzuela, which is not complying with the emission
standards set in this Code, may be apprehended and subjected to emission control test.
ln case the vehicle fails the test, the driver shall be issued a Violation Receipt and his/her
drivefs license and/or vehicle license plates will be confiscated. The Drive/s licenseA/ehicle
License Plates will only be released to the violator after the vehicle has passed the emission
control test and upon lhe payment of testing fee and fines provided for, under Sec{ion 73and 74
hereof.
The enforcement and the implementation of the emission standards shall require the active
cooperation of the importers, local assemblers, owners/operators and the users of all motor
vehicles. To ensure the cooperation of these groups, there is a need for an intensified and
sustained awareness raising campaign which shall focus on; (1) the harmful impact of gas
emission on the general public and workers in the transport sector; (2) the technological options
available to the transport seclor to prevent smoke belching, and (3) the commitment of the City
Government to enforce emission standards through strengthening of apprehension activilies.

The Mayor of Valenzuela Cily is hereby authorized to create by Executive Order an Anti-
Smoking Regulatory Board (ARB) to implement the provisions of this Code. The Board

implementation, enforcement and monitoring of this Codeas well as to conduc{ educational
awareness campaigns, informalion dissemination programs, and capacity building programs,
that will inform the constituents and train enforcement officers.
I. INFORilIATION DISSEMINATION
within 60 days after the effeciivity of this ordinance, the public lnformation office in
coordination wilh the BPLo and the city Health office shall give copies of this
ordinance and its primer to all establishments and legitimate vendors that sell
tobacco, cigarette and other tobacco products.
Establishments are given a period of thiny (30) days from the effeciivity of this code
to comply with the requirements of this Code.
Failure to comply with the requirements set forth in this code shall be a ground for
cancellation of business permits by lhe Business permit and Licensing office
(BPLO).

Ninety (90) days after the effectivily of this code, an inspection team consisting of
representatives from the city Heatth office (cHo), city Engineer,s ofEce and the
Business Permit and Licensing office shall conduct inspections in priority areas of
Valenzuela City.

Should the inspection team find violations of any provisions of the Code, it shall issue
citation tickets indicating the violation and the conesponding fine. Failure of any
violators to pay the fine indicated in the Citation Ticket is a ground for denying
renewal of its business permiulicense.
IV. INDIVIDUALVIOLATORS
ln the course of inspection, the inspection team may apprehend violators and may
request the assistance of the Philippine National Police (PNP) to apprehend
violators. They shall also issue Citation Ticket to individual violators and are
authorized to file criminal charges against them.
V. RE{NSPECION
The inspection team shall re.inspect lhe cited establishment to determine its state of
compliance within ten (10) days reckoned from the expiration of the ten (10) day
period indicated in the citation ticket. lf the establishment still fails to comply within
ten (10) days from the receipt of the first citation ticket, the inspeclion team shall
recommend to the Office of the City Mayor the cancellation of the establishment's
business license and permit and its closure.
The Smoke Free Task Force and any authorized person by the ARB shall issue a
citation ticket stating the violation and the penalty to a person apprehended for
smoking in a prohibited area. The issuer/s shall then forward their copies of issued
citation tickets to the City Health Office at least twice a week.
Violators of this Code shall be informed of their violation and the penalty associated
with such violation by means of a Citation Ticket System with the following
guidelines:

within three (3) regular business days from date of violation to pay the fine imposed.

The City Heatth Office, with the assistance of the CSWDO Officer shall promote a
Smoking Cessation Program and encourage participation of the public and private
facilities in this program so that the smokers who are found violating this Code may
be referred to the said facilities.
a) Violation of Secton 80 and Section 8'l - on the first ofiense, a fine of not less than
Five Hundred Pesos (P500.001 but not more than One Thousand Pesos (Pl,000.00)
shall be imposed or eight (8) hours community service at the discretion of the court.
On the second offense, a fine of not less than One Thousand Pesos (P{,000.00) but
not more than Three Thousand Pesos (P3,000.00) shall be imposed.
On the thid offense, in addition to a fine of not less than Three Thousand Pesos
(P3,000.00) but not more than Five Thousand Pesos (P5,000.00), the business
permit and license to operate shall be cancelled or revoked. ln this case, the imposable
penalty is that which is provided for by Section 32 of R.A. 9211, otheruise known as the
Tobacco Regulatory Act of 2003.
b) Violation of Section 82- on the firsl offense, any person or any business entity or
establishment selling, distributing or purchasing a cigarete or any other tobacco
products tolfrom a minor shall be fined the amount of not less than Five Thousand
Pesos (P5,000.00) or an imprisonment of not more than thirty (30) days, or both at the
discretion of the court.
For succeeding offenses, both penalties shall apply in addition to the revocation of the
business licenses and permit to operate by the Business Permits and Licenses Office
BPLO) in case of business entities or establishment

lf a minor is caught, selling, buying or smoking cigarettes or any tobacco producls, the
provisions of R.A 93214, otheMise known as the Juvenile Justice and Wetfare Act of
2006 and Article 189 of Presidential Decree No. 603 otheruvise known as the Child and
Youth Welfare Code, as amended, shall apply.
The parents/guardian of the minor who violated this Code shall suffer the penalty of
a fine imposed in Section 87 of this Code.
SECTION 88. FUNDS. - The fines collected arising from the Violation of Section 80, 81 and 82,
respectively, shall be used by Anti-Smoking Regulatory Board (ARB) in the implementation ofl
this Code such as, but not limited to information, campaign propaganda and all other means in
order to strengthen the regulation of the Anti-Smoking campaign. ln accordance thereto, all
collections arising there from shall be collected and allocated in a separate account in the
Treasury to be called as the ANTI-SI|OK|NG REGULATORY BOARD (ARB) FUND.
CHAPTER EIGHT
WATER POLLUTION
TITLE ONE
SECTION 90.SCOPE AND APPLICATION - The following structures within Valenzuela City are
covered by this Code:
a) All residential structures including, but not limited to, an apartment, house and/or
land on which another's dwelling is located and used for residential purpose and
shall include not only buildings parls or units thereof used solely as dwelling places,
boarding houses, dormilories, rooms and bed spaces offered for rent by their
owners, but also those used for home industries, retail stores or other business
purposes il the owner thereof and his or her family actually live therein and use it
principally for dwelling purposes;
b) Commercial establishments, including but not limited to, restaurants (including
eateries or carinderia), convenience stores, hardwares, malls, groceries, markets,
Mash, condominiums, motels, hotels, hostels, resorts, recreational
_establishments, auto-repair shops (talyer), poultries and livestock rearing
establishments, etc.;

offices, etc.; and
e) lnstitutional structures, including, but not limited to, schools, colleges and
universities, health facilities, churches, etc.
a) Excreta from residential areas without septic tanks and untreated wastewater from
commercial, industrial, institutional and public establishments shall not be allowed to
be discharged to open drainage canals or piped drainage systems;
b) All buildings and structures, whether residential, commercial, industrial,
governmental, and inslitutional, should be required to have proper sewage treatment
or septage management system.
i.) All residential struclures shall have the prescribed design of septic tanks as per
Presidential Decree No. 1096 othenvise known as National Building Code of the
Philippines and Republic Act 1378 also known as the National Plumbing Code of
the Philippines.
ii.) All commercial and industrial establishments shall have the approved design of
septic tanks or wastewater treatment facility based on the determination of septic
tanks or waslewater treatment facility based on the determination of the Office of
the Building Official (OBO).
iii.) All governmental and institutional establishments shall have the approved design
of septic tanks or wastewater treatment facilities.

SECTION 93.DES|GN OF SEPTIC TANKS All septic tanks shail be designed to exctude
storm water from downspouts, and such other requirements and specifications as provided by
national standards. The Building Official, pursuant to Presidential Decree No. 1096 otheruise
known as the National Building Code of the Philippines and Republic Act '1378 or the National
Plumbing Code of the Philippines, is mandated to ensure that appropriate standard designs of
septic tanks shall be enforced in the approvals and inspection procedures.
a) All owners and users of septic tanks shall be required to desludge once every five (5) to
seven (7) years.
b) The opening of septic tanks, for desludging purposes, shall only be done with the
authority of the owner or user.

a) Only DENR and/or DOH accrcdited entities, complete with permits, shall be allowed to
provide septage collection and transporl services. Collected septage shall only be
disposed and treated in a DENR and/or DOH accredited disposal/treatment facility with
pertinent permits.
bl Septage removed from septic tanks shall be transported only by a DOH/DENR
accredited septage hauler/pumper to the approved septage treatment facility pursuant to
the regulations prescribed by the DOH. Unless olherwise provided by law, no septage
hauler/pumper shall be allowed to collect transport and upload or dispose of septage in
other places, including bodies of water, agricultural fields and the drainage system within
the city.
c) All entities engaged in desludging activities are required to secure Permit to Transport
from the DOH/DENR, Environmental Sanitation Clearance from DOH, Sanitary Permit
from the City Heatth Ofiice, and other perlinent permits as may be deemed necessary as
part of the requirements for issuance of annual business permit from the City.
b) The City Government of Valenzuela may pursue funding assistance from both local and
foreign sources, either public or private, through mutual agreements subjec{ to existing
accounting and auditing rules and regulations.
c) Further, the City Government of Valenzuela and its barangays may raise funds and
allocate budget to subsidize necessary expenses for the construction of communal
septic tanks in their areas of jurisdiction.
Commercial buildings and structures are required to pre-treat all wastewater from their
structures to "domestic wastewater quality" in accordance with the requirements forth
tn th hiti ppine Clean Water Act of 2004 (R.A. 9275), before the same disch ed.

TITLE THREE
SANITATION STANDARDS FOR PUBLIC TOILETS
SECTION 't07. SCOPE. The provisions of this Code covers all public toilets within the City of
Valenzuela accessible to the general public including those provided for by gasoline stations,
private and public schools, department stores and the likes, supermarkets and other
establishments.
a) Design and Construction. All public toilets must have a solid floor (either tiled or I
paved) with a properly working flushing system and the appropriate septic tank for
proper waste water disposal. Likewise, all public toilets must have a properly working
door which can be locked from the inside.
b) Water Supply. All public toilets must be provided with an adequate running water supply
from a properly funciioning plumbing system.
c) Furnishings. All public toilets need to be furnished with the following fiXures:
c.4ln the case of businesses with a capital expenditure of more than Two Hundred Fifty
Thousand Pesos (Php250,000), a properly working bidet.
d) Maintenance.All public toilets must be kept reasonably clean and properly treated with
disinfectants at least once every twenty four (24) hours.
SECTION 109. PENALTIES. For purposes of clarity in implementation, the following provisions
shall be enforced:
(a) Any violation of any of the provisions of Section 108 of this Code will be given a Notice
of Violation and issued an order for compliance with a reasonable period of 30 days with
an accompanying penatty of Five Hundred Pesos (Php500.00) payable on the renewal
of the establishment's business permit. lf the said establishment fails to comply with the
provisions of this Code within the 30-day grace period, a second Notice of Violation will
be issued with an accompanying fee of One Thousand Pesos (php't,OOO.O0) also
payable upon the renewal of its busin license. lf the establishments still refuses to

d) Any structure or parts thereof that was decayed, damaged by fire or termites,
declared as "condemned" and to which in an assessment of the health ofticer that the
struclural integrity is questionable and shall constitute a hazard to public heatth and
safety shall be demolished within such reasonable time as the local officer may order
after due written notification of the owner or operator.
f) Establishments that are emitting dense smoke or noxious fumes, vapors, gas, dust, soot,
or cinders, in unreasonableor toxic quantity that adversely affec{ heatth and sanitation

a) The owner or operator shall be responsible for the control of vermin and its breeding
places within his establishments or premises.

prevent the breeding or harborage of harmful insects and animals (e.g. spiders,
scorpions, or snakes).
c) No person shall use any dangerous toxic chemical in spray or in mist form in
concentrations exceeding the maxim permissible standard set by the Fertilizer and
pesticide Authority and other regulatory agencies for the purpose of weed

a) A dead animal shall be disposed by its owner within twenty-four (24) hours after its death
and in such a manner complying with Chapter XVll - "Refuse Disposal'of the Code on
Sanitation of the Philippines (P.D. 856) and its implementing rules and regulations and i
other local ordinances.
b) Whenever a dead animal is indiscriminately disposed in any privale public place to which the
owner of such animal is unknown, the local health officer has the authority to direct his
authorized representative to bury it in a manner complying with chapter XVlll "Refuse

cl The quality of bodies of water shall be maintained in a safe and satisfactory condition
according to its best usage as staled in the Department of Environment and Natural
resources standards, rules and regulalions.
a) All animal stockade shall be kept reasonably clean and free from accumulation of
manure and other refuse.
c) Adequate water supply both for drinking and cleaning and for other domestic purposes
shall be provided in the establishment.
d) Every animal stockade or other animal enclosures shall be provided with a waterlight.

b) All persons exposed to noise which exceeds the maximum allowable noise levels
emanating within any construction site, establishment or premises such as those emitted
from certain equipment, machinery, vehicle tools or devices, shall be provided with
appropriate personal proteciive equipment (PPE).

SECTION ll7. NOISE NUISANCE - The maximum allowable noise quality standards (in
decibels) in general areas shall be as follows:
Class AA - A Section or contiguous area which requires quietness within 100 meters from

American National Standards lnstitute (ANSI) Sl.4-1974or other specification accepted
by the Department of Environment and Natural Resources (DENR).

premises which seryes as a nuisance and is the subject of complaint of the residents
within the area, the people may file a written complaint to the local health officer who in
