SECTION 10 : FINANCIAL TERMS AND CONDITIONS

1. ACCEPTANCE OF LIABILITY

1.1. The person responsible for the account (hereafter the Account Holder) as set out in the
standard Application for Admission (hereafter the Application) herewith assumes liability for the
Account, alternatively binds him-/herself as co-debtor and surety for payment of all fees to the
School.
1.2. The legal guardian, as described in the Application, binds him-/herself as surety and co-debtor
for the payment of all fees by the Account Holder or any other payments that may arise from
this Agreement.
2. TERMS OF PAYMENT
2.1. It is recorded that fees are determined at the beginning of the year and that the account holder
Is informed of the result in writing

2.2 The Account Holder shall immediately inform the School if he/she has not received an invoice
and breakdown of fees at the start of the academic year

2.3 Fees are payable monthly in advance by means of debit order, electronic funds transfer or cash
deposit at the bank on or before the 2nd (second) day of each calendar month or annually in
advance by means of electronic funds transfer at the bank. No Cash will be accepted at the School

2.4 The school reserves the right to charge interest of 15% (fifteen percent) on all account that are
in arrears by 30(thirty) days or longer

2.5 Payment of monthly fees is not subject to presentation of a statement. Payments are made in
accordance with the applicable fee structure of the School for every annual period.

2.6 Fees are payable for the annual period over 11 (eleven months only.

2.7 In the event where an existing account is/has not been managed in the proper manner to the
satisfaction of the School, no further applications or re-enrollment for the next school year will be
considered.

2.8. The account holder is liable to pay the school fees annually (the whole year up front) or by debit
order monthly.

2.9. It is compulsory that the account holder signs the contract in the presence of a witness at school

3. BREACH OF CONTRACT

In the event where the undersigned surety, Account Holder or legal guardian commits a breach of
contract of any of the terms of this Agreement, the school ma in its sole discretion

3.1. Refuse the learner entry to the School’s premises until the breach has been remedied: or
3.2. Claim damages from the Account Holder and / or the surety and legal guardian: or
3.3. Take whatever legal steps that may be necessary.
4. GENERAL

This Agreement constitutes the whole Agreement between the parties relating to the subject matter
hereof. No amendment or consensual cancellation of this Agreement or any provision or term
thereof or of any Agreement, bill of exchange or other document issued or executed pursuant to or
in terms of the Agreement an no settlement of any disputes arising under this Agreement and no
extension of time, waiver or relaxation or suspension of any of the provisions or terms of this
Agreement or of any Agreement, bill or exchange or other document issued pursuant to or in terms
of this Agreement shall be binding unless recorded in a written document signed by the parties. Any
such extension, waiver or relaxation or suspension which is so given or made shall be strictly
construed as relation strictly to the matter in respect whereof it was made or given.

5. JURISDICTION

This Agreement is subject to South African law.

6. CREDIT INFORMATION

The Account Holder, surety or legal guardian hereby consents to the disclosure and exchange f
personal financial information to a credit bureau or financial institution in accordance with the
National Credit Act.

7. DOMICILIUM

The parties choose as their domicillia citandi et executandi the addresses set out in the Application.

8. LEGAL FEES

In the event where the School takes legal action against the Account Holder, he/she will be liable for
all legal fees on an attorney client scale, collection costs and commission, interest and tracing fees.

9. VOLUNTARY TERMINATION

9.1 The Account Holder, Surety and Legal Guardian acknowledges that:
9.1.1 Only a limited amount of learners could be placed and enrolled during every specific school
year and that once that limit has been reached, other potential learners having applied
would have to be declined as a result of this limit being reached and would inevitably be
enrolled at a different school or similar institution elsewhere;
9.1.2 The School receives more applications for the enrollment of learners than the maximum
amount of positions available;
9.1.3 The annual school fees are determined as a result of inter alia the maximum number of
learners that could be accommodated during that specific period and that any reduction in
this figure would have a detrimental impact in the calculation of the annual school fees,
which could not be revisited during the school year;
9.1.4 To help parents, annual fees are divided into 11 months.
9.1.5 It is difficult to near impossible to find a replacement learner to fill a position of any enrolled
learner leaving the school during any term of the school year;
9.1.6 It is in the circumstances considered reasonable that the Account Holder, Surety and Legal
Guardian would remain liable for and pay the school fees for the remainder of the entire
school year in the event of the relevant learner leaving the School mid-term.
9.1.7 The parties therefore agree that in the event of any of the Account Holder, Surety and
Legal guardian wishing to terminate the Agreement and the learner leaving the School, the
following conditions shall apply:
9.1.8 The Account Holder shall provide 30 days clear written notice of the intention to terminate
the Agreement and have the learner leave the School. This is for administrative purposes;
9.1.9 The Account Holder, Surety and Legal Guardian would notwithstanding such termination,
remain liable for and pay the school fees for the remainder of the entire school year; Therfore
no refunds on fees already payed will be considered.
9.1.10 The School may however, in its absolute and unfettered discression, waive (in writing) the
entitlement to fees for a portion of the remainder of the school year in the event of an
acceptable substitute learner being found.

10. CANCELLATION

10.1 The parties agree that the School shall be entitled to summarily terminate the enrolment of any
learner and cancel this Agreement, whether with immediate effect or on other notice period,
under circumstances where the learner is found guilty of an offence which, in the sole and
absolute discression of the school, renders his/her continued enrolment at the School improper
or unfeasible.
10.2 The parties agree that in the event of such cancellation, the following conditions shall apply:

10.2.1 The Account Holder, Surety and Legal Guardian shall be provided with a written notice of the
cancellation of the Agreement and for the learner to leave the School together with the
reasons therefor.
10.2.2 The Account Holder, Surety and Legal Guardian would notwithstanding such cancellation and
based on the principal recorded in paragraph 9.1 above, remain liable for and pay the school
fees for the remainder of the entire school year and NO REFUNDS ON FEES ALREADY PAYED WILL BE
CONSIDERED

10.2.3 The School may however, in its absolute and unfettered discression, waive (in writing) the
entitlement to fees for any portion of the remainder of the school year in the event of an
acceptable substitute learner being found.

COVID-19 AND OTHER PANDEMIC TRANSMISSION INDEMNITY FORM
Please read through before signing this legal document.

1. I acknowledge the contagious and unpredictable nature of the coronavirus disease that
makes it difficult to prevent transmission, and I hereby voluntarily execute this pandemic
Transmission Indemnity Form (Indemnity) in my capacity as the parent or legal guardian of
______________________________________ ( the Learner), as well as in my personal
capacity, to and in favour of The King’s School.
2. I acknowledge that the Department of Health and many other public health authorities still
recommend practicing social distancing, and the Hostels has put in place preventative
measures and other protocols to reduce the spread of contagious diseases, even so, the
Learner’s return to the School may subject him/her to the risk of being infected. I also
acknowledge that the learner is under no obligation to reside in the Hostel if I and/or the
boarders have any safety concerns, and notwithstanding this, I have freely consented to the
Learner’s return to the Hostel fully aware of and on the voluntary assumption of the
aforementioned risk.
3. I understand this is an important legal document indemnifying the Hostel against the
transmission of corona and other contagious pandemics on the premises and that by signing
this Indemnity I hereby waive certain legal rights that may exist and that I may otherwise
have against the King’s Hostels and others. I understand that I have had the opportunity to
review this indemnity with an attorney of my choice.
4. I understand that if at any time after the return to the King’s Hostels, the hostel learns that
any learner, employee, director, agent, contractor or officer is infected with COVID-19 or has
tested positive for COVID-19. The King’s Hostels shall advise me of such fact but shall be
under no obligation to disclose the identity of such person to me.
5. I undertake to follow and obey and to impress on the Boarder to follow and obey all rules,
instruction, directions and requirements of the King’s hostel as they may be changed,
modified or amended by the King’s Hostel before, during and after the return to the King’s
Hostels including, without limitation:
5.1 All rules, instructions, directions and requirements as may be applicable to the King’s
Hostels response to the COVID-19 pandemic and the need to limit any transmissions of
COVID-19 and:
5.2 Agreeing to have followed the necessary protocols on a daily basis and at intervals as
determined from time to time by the King’s Hostel and/or as required by and Regulations
issued by the Government under the Disaster Management Act 2002 (Act. 57 of 2002)
6. I hereby agree to defend and irrevocably and unconditionally indemnify and hold harmless
the King’s Hostel and its directors, employees, agents, contractors and officers or each of
them ( Indemnified Parties), form and against any claim for damages or losses and/or from
any other claims, judgments, penalties, costs or other liability or expense (including, but
without limitation legal costs) of any nature whatsoever (whether direct, consequential or
otherwise), whether for death, personal injury, illness or other loss or harm sustained by the
Learners, arising out of, resulting from, relating to or in connection with the transmission of
COVID-19 at the King’s Hostel
7. I hereby irrevocably and unconditionally release, waive, discharge and abandon any and all
claims, suits, action, demand or proceeding that I, or the Learner, may have against the
Indemnified Parties with respect to death, personal injury, illness, or any other loss or harm,
arising out of, resulting from, relating to or in connection with the transmission of COVID-19
at School.
8. If any term or provision of the Indemnity is deemed invalid or unenforceable, such term shall
be deemed to be modified or limited to the extent necessary to make the term valid and
enforceable.
9. This Indemnity supplements the Parent Contract and/or Enrolment Contract (as amended
from time to time) that I have entered into with the School and in the event of a conflict
between the provisions of this Indemnity and the Parent Contract and/ or Enrolment
Contract (as amended form time to time), the provisions of this Indemnity shall prevail.
10. The governing law and alternative dispute resolution provisions of the Parent Contract
and/or Enrolment Contract (as amended form time to time) shall apply mutatis mutandis to
his Indemnity.
11. While the School’s employees will use reasonable endeavors to limit learner to learner and
teacher to learner physical contact, there will be instances where contact is made between
learners while learners adapt to the new guidelines and/or when learners need to be
comforted and assisted by staff. I agree that it will not be possible for the school to
guarantee that this contact will not occur with children on site.

PUBLIC TRANSPORT

Whilst every care is taken, The King’s School Hostel will not be held responsible for any damage to
property or loss of property or injury to any pupil during a trip.

Where the services of an operator are provided for transport, it is agreed and understood that The
King’s School is acting only as an agent to arrange such services and accepts no responsibility what
so ever for any default of the operator.

The King’s School Hostel staff and supervisors are dedicated to providing a professional and
personalized service to the students of The King’s School. However, the school and the staff are not
responsible or liable for any accidents or any injury of any person on the hostel property or whilst
pupils are on a school excursion. The school and staff are also0 not responsible or liable for the loss
or destruction of or damage to any property of the hostel pupils.

procedures or unreasonably refusing to submit

substantially damages the school/hostel learner

6. Obscene, indecent or sexually explicit behaviour, Hearing with
gestures or attempts to make unwanted physical suspension
contact and/or and/or
expulsion
sexual harassment, inappropriate sexual and/or
innuendos or graphic comments and/or alternative
sanction
committing a sexual offence and/or

intentional and offensive, insulting, abusive,


racist or lewd behaviour and/or

storage, creation, sale or distribution of


pornographic, obscene or offensive material,
publications, symbols, email, text, SMS, MMS,
cartoons, objects or material that incites
violence.
7. Sabotage, malicious, wilful damage to Hostel or Hearing with
other’s property and/or suspension
and/or
unauthorised occupation of any school/hostel expulsion
property or facility or having the effect or and/or
depriving others from using this property or alternative
facility. sanction

unauthorised preventing or seeking to prevent


free assembly by others on the hostels property
and/or

blocking off any entrances or exits to or from the


school premises with the intention or effect of
interfering with free access/aggress by others

8. Actions that expose others to serious danger or Hearing with
injury or expose the hostel to potential suspension
accidental loss or damages, whether due to and/or
wilful, grossly negligent or unintended acts expulsion

unsafe acts or behaviour that endangers the sanction
safety and welfare of others.
9. Serious misconduct or actions that may bring Counselling /
the reputation of the hostel, learners or other hearing with
stakeholders into disrepute. suspension

expulsion
10. Any other misconduct considered to be very Counselling /
serious and possibly justifying expulsion as a first hearing with
offence. suspension

11. SEXUAL CONTACT
No sexual contact between students are allowed
on school/hostel property
Sexual contact with a student is forbidden. No
boys and girls are to talk to each other.
The presence of a student of the opposite sex is
not permitted in the hostel.
No dating or relationships.
No sexual remarks
If a female student falls pregnant, she will be
asked to leave the school. If the father is a
student of the school he will be asked to leave
the school.

12. PORNOGRAPHY
The possession and or the distribution of
pornography in whatsoever form is not
permissible on the school grounds, whether
intended or unintended and is subject to
immediate expulsion.
13. CELLPHONES
No cell phones are allowed
14. EDUPADS
 Sound must be turned off.
 Batteries must be charged.
 No game playing or listening to music or
watching movies on educates.
 You are not allowed to use the Educed of
another student.
 No sharing or borrowing
 Internal storage is to be reserved for
academic purposes
 No external devices are allowed. it will
be confiscated
 Students must take care and look after
their edupads

15. THE USE OF ONLINE OR SOCIAL MEDIA
 You may not engage in activities on
social media that could be connected
with, and bring the school in disrepute.
 Do not present your personal views as
that of the school on any social medium.
 Do not discuss the personal information
of fellow learners, staff or teachers on
any social medium.
 Do not use any social medium to attack,
defame, intimidate, harass
(e.g.”sexting”), abuse or bully any
learner or staff member or their family
members of the school.
 Do not spread malicious rumours or
show disrespect to staff or learners on
social media

SERIOUS MISCONDUCT
Continual repetition of any of the below misconduct may

32. The Head of Hostels will place a student in a Counselling Parental Hearing with
hostel on arrival at The King’s Hostels. The and/ or contact suspension
student will remain in that position for the entire reprimand and/or and/or
year at our hostels. No student may move from and/or warning counselling expulsion
his/her allocated place without the written and/or demerit and/or final and/or
permission from the Head of Hostels warning alternative
sanction
33. The weekend during exams is a closed weekend Counselling Parental Hearing with
for students. Students may not go home on and/ or contact suspension
these weekends unless it is declared an open reprimand and/or and/or
weekend. We schedule extra study hours during and/or warning counselling expulsion
these weekends to enable students to prepare and/or demerit and/or final and/or
for the exams. A student with a average below warning alternative
60% on his report will be grounded. NO sanction
STUDENT IN THE HOSTEL MUST FAIL.
