LEAVE AND LICENSE AGREEMENT

THIS AGREEMENT IS MADE on 1st of November, 2023 BETWEEN MR. BAPAN


SENGUPTA, son of Late Chinmoy Sengupta, by faith – Hindu, by Nationality:
Indian, by occupation – Service, residing at B-507 Meera Arcade, Plot No. 14,
Sector-20, Kharghar, Navi Mumbai 410210, hereinafter referred to the LICENSOR (
which term shall include his successors and assigns ) ONE PARTY AND

RUBAIYA SULTANA , wife of Sri Kumud Mallick , by Nationality : Indian, by


occupation – Service , Permanently residing at Bithari , P.O. Bithari , Pin No.
743286 , District : North 24 Parganas , West Bengal, hereinafter referred to as the
LICENSEE ( which term shall include his successor and assigns ) of the SECOND
PART.

AND WHEREAS, the licensor is owner of the Flat being No. H, on the 2 nd Floor,
Block -1 , measuring 884 sq.ft. super built up area lying and situated at Panchsheel
Vatika Housing Complex, Premises No.BH-25, M.B. Road, P.O. Birati, P.S. Nimta,
Kolkata - 700051. District: North 24 Parganas, Ward No. 13, under the North Dum
Dum Municipality, West Bengal .

AND WHEREAS, the licensee has requested the licensor to allow the licensee to
occupy and use temporarily about 884 sq.ft. Super built up area, Flat No. H, on the
2nd floor, Block 1 of the said Housing Complex on leave and license basis for
residential purpose.
AND WHEREAS the licensor has agreed to allow on leave and license basis the
licensee to occupy and use the said flat measuring about 884 sq.ft. super built up
area of the said Housing Complex on temporary basis of members of the licensee /
second party.

NOW THESE PRESENTS WITNESSTH AND THE PARTIES HEREBY AGREE AS


FOLLOWS: -

1. It is neither a lease agreement nor a tenancy agreement under the


provisions of West Bengal premises and Tenancy Act. 1997 nor Transfer
of the property Act.

2. The first party shall provide an accommodation consisting of the said flat
measuring about 884 sq.ft. Super built up area, Flat No H on the 2nd
Floor, Block-1 of the said Housing Complex in good condition for purpose
of residential use.

3. The licensee/ second party shall pay a sum of Rs. 20,000/- (Twenty
thousand) only at the time of execution of this agreement to the licensor in
advance as security deposit and the first party /licensor shall refund of the
said advance money of Rs. 20,000/ without interest after deduction at any
damages as aforesaid flat at the time to the determination as and when
leaving the said flat herein below described end of period.

4. The licensee shall pay to the licensor a sum of Rs. 12000/- (Eleven
thousand only) per month as license fee or compensation for occupation
of the said flat payable in advance by the 5th day of each current English
month.

5. This Agreement shall be in force for 12 (Twelve) months subject to the


discretion of the first party / licensor in any event, the period and
enforceability of this Agreement shall not exceed 12 months from the date
of execution of this.

6. The licensee / second party agrees and undertakes to surrender the


licensor / first party and vacate the said occupied flat after the expiry of
31st October, 2024 and to give khas possession in favour of the
licensor without any notice.

7. The said occupied charges will be increased by 10% after 12 months if


both the parties agree to extend the stipulated period.

8. The licensee / second party shall not assign or sublet or part with the
possession of the said flat.

9. The licensee shall be bound to compensate the licensor for any act of
damage caused to the premises by the licensee as may be determined by
the licensor.

10. The licensee shall be bound to pay electric charges consumed by the
separate-meter per month to be paid by the licensee in due time to the
first party / licensor

11. The licensee / second party shall not make any addition, alteration or
remodeling of any portion of the occupied portion.

12. The licensee / second party shall compel to leave the said occupied
portion within one month’s notice if any illegal and unsocial or
misunderstandings are taken place between the parties.

13. The licensee may leave the said occupied portion before the stipulated
period with one month’s notice in advance before leaving the said flat and
garage.

14. The said flat and garage for the licensor own purpose, the licensor may
give one month’s notice to the licensee or second party before the
stipulated period.

15. The licensee shall at all times during the continuance of the license keep
and maintain the rooms with all fittings and features clear, tidy, healthy
and free from dust.

16. The licensee shall not be entitled to transfer the license to any other
person or allow any persons to occupy the said flat except by family
members of the licensee.

17. The licensor shall have the right to enter into and inspect the portion of
the occupied rooms given to licensee on leave and license basis.

18. The licensor and licensee and their heirs, executors and assignees would
be bound to abide by terms and conditions embodied therein.

SCHEDULE OF THE PREMISES FOR THE RESIDENTIAL PURPOSE BY THE


LICENSEE

Area of the occupied portion of Flat No H, on the 2nd Floor, Block-1 , measuring 884
sq.ft. super built up area lying and situated at Panchsheel Vatika Housing Complex,
Premises No.BH-25, M.B. Road, P.O. Birati, P.S. Nimta, Kolkata - 700051. District:
North 24 Parganas, Ward No. 13, under the North Dum Dum Municipality, West
Bengal .

IN WITNESS WHEREOF the both parties have put their signatures respectively on
the day month and year first above written.
